New Jersey Special Counsel Named "Rising Star"
Sedgwick Newark special counsel David E. Cassidy has been selected as a 2006 New Jersey "Rising Star." Rising Stars are identified by their peers as top, up-and-coming lawyers who are 40 years old or younger and who have been practicing 10 years or less. Only 2.5 percent of New Jersey attorneys receive this honor. Cassidy's name will appear in the August 2006 issue of New Jersey Super Lawyers – Rising Stars Edition and New Jersey Monthly (in a special supplement).

Albert Boro Jr. Appointed to State Bar Antitrust Executive Committee
Albert J. Boro, Jr., a partner in Pillsbury Winthrop Shaw Pittman LLP's San Francisco office, will serve on the Executive Committee of the California State Bar's Antitrust and Unfair Competition Section. He will begin his term in October 2006 and serve until September 2009.

The executive committee oversees and governs the activities of the section, which is among the State Bar's most active with over 1,350 attorney members. It publishes three treatises on antitrust and unfair competition law, and regularly provides continuing education programs to its members.

Boro is a member of Pillsbury's litigation group, and he focuses his practice on antitrust law, complex business and commercial litigation, and white collar criminal defense. In the area of antitrust, he has represented clients in major multi-defendant cases in both federal and state courts that have included parallel criminal investigations. He has helped clients create and implement compliance policies, and has advised clients in a variety of industries including technology, energy, petroleum products, carbon fiber, retail grocery and consumer electronics.

Prior to joining Pillsbury, Boro was a law clerk to U.S. Supreme Court Jutsice Byron R. White from 1987 to 1988, and to Judge Walter J. Cummings of the U.S. Court of Appeals for the 7th Circuit in Chicago from 1986 to 1987. Boro earned his law degree from the University of California at Berkeley, Boalt Hall School of Law in 1986, and also earned a Masters of Public Policy and Bachelor of Arts in Economics from the University of California at Berkeley.

Phelps Dunbar Partner Appointed Chair of the American Health Lawyers Association's Quality Council
Phelps Dunbar LLP is pleased to announce that Dinetia M. Newman, a partner in the firm’s Tupelo office, has been appointed Chair of the American Health Lawyers Association’s (AHLA) Quality Council. The AHLA Quality Council has jurisdiction over peer reviews and evaluates membership satisfaction with all content that the AHLA produces, whether that content is in electronic, spoken or written format. Ms. Newman also serves on the Board of Directors of the AHLA, the nation's largest, nonpartisan, 501(c)(3) educational organization devoted to legal issues in the healthcare field.

Ms. Newman’s health law practice includes assisting hospital and physician clients in structuring business arrangements in compliance with Medicare and Medicaid billing rules, including compliance with change-of-ownership provisions, assisting in preparation and negotiation of a variety of contractual arrangements between hospitals and physicians, establishing and representing operating managed care organizations, advising clients regarding state certificate-of-need laws and other state licensure issues, and assisting clients in developing and implementing corporate compliance programs regarding Medicare billing issues, Anti-kickback Act and Stark issues. Phelps Dunbar Partners Recognized as “Florida Legal Elite”
The “Florida Legal Elite” selection process began with notifying and inviting members of The Florida Bar to participate in a balloting process. Nominators were asked to provide the names of Florida lawyers they hold in the highest regard, through working with them personally or recommending them to others. Nominators were allowed to cast only one vote and could not vote for themselves. These nominations were then counted by an independent research firm, and a panel of prominent lawyers reviewed and selected those lawyers who received the most votes.

Karl J. Brandes is a partner in the firm’s regional commercial litigation practice group. He practices in the civil trial area. His commercial litigation practice includes: petroleum marketing; other trade regulation; class action; environmental; computer; construction; condominium; personal injury, including insurance and self-insured defense; toxic tort; product liability; landlord and tenant disputes; and other real property, including ADA claims. Karl is certified as a state and federal court mediator and has mediated cases in each of the subject areas described above. He also serves as an arbitrator for the United States District Court for the Middle District of Florida. Karl received his J.D. from Golden Gate University.

John D. Mullen is a partner in the firm’s regional employment law practice group. John advises and represents employers throughout Florida in the defense of all types of discrimination and retaliation claims, in federal and state court trial practice and in arbitration and administrative proceedings. He also litigates covenants not to compete and trade secret claims, and counsels employers regarding human resources policies and practices. John also represents clients in securities class actions and directors’ and officers’ liability disputes, and represents securities firms and individuals in securities arbitration proceedings. John received his J.D. from the New York University School of Law.

John E. Phillips, Jr. is a partner in the firm’s regional employment law practice group. He has represented employers regarding employment discrimination and related claims filed with the state and federal courts as well as charges of discrimination filed with the Equal Employment Opportunity Commission, the Florida Commission on Human Relations and local EEO agencies. He also prepares employment contracts; litigates breaches of employment contracts and enforcement of non-competition agreements; develops and reviews clients’ personnel policies, employee and supervisor handbooks, and employee applications; audits policies for compliance with EEO and wage-and-hour laws; acts as management counsel in organized labor disputes and labor grievances; and advises clients about FLSA and unemployment compensation issues. John received his J.D., cum laude, from Boston University.

Seth M. Schimmel is a partner in the firm’s regional commercial litigation practice group. His practice is devoted primarily to construction and commercial litigation, which includes construction defect and delay claims, professional liability and errors and omissions, and real estate and commercial business disputes. He also prepares and negotiates construction contracts and counsels owners, developers, engineers and contractors on their administration. His experience includes both commercial and residential projects, including condominiums, office buildings, shopping malls, educational facilities, power plants and roadways. Seth received his J.D. from Vanderbilt University.

Patton Boggs LLP Recognizes Colleagues For Outstanding Pro Bono Achievements
Patton Boggs is pleased to announce the winners of the firm’s 2005 Pro Bono Awards. The Pro Bono Awards are presented each year to associates and partners in recognition of their outstanding pro bono achievements.

Shana Burleson from the Patton Boggs Dallas office was named the 2005 Pro Bono Associate of the year and Douglas Mishkin, a Washington DC-based attorney was named the 2005 Pro Bono Partner of the Year. This is the eleventh year for which an Associate of the Year Award has been given and the seventh year for the Partner Award. The honors are based on the recommendations of the firm’s Pro Bono Committee, co-chaired by partners Denise Vanison and Michael Forshey.

Managing Partner Stuart M. Pape conferred the awards and honorable mention honors to a diverse group of associates and partners from three of the firm’s offices. “In conferring this honor, we consider not only the quantity of pro bono work, but also such factors as variety and depth of the commitment. We also look for a consistent commitment to public interest law, initiative in seeking pro bono opportunities, and a willingness to take on low-profile work which is unlikely to attract attention, as well as work for high profile causes,” stated Mr. Pape.

Ms. Burleson demonstrated her exceptional advocacy skills on a variety of pro bono matters, tackling one challenging case after another in 2005. She represented a young mother of two who was overwhelmed by a contentious divorce and the father’s refusal to pay child support, compromise on visitation, or cooperate on any level with the proceedings. Due to Ms. Burleson’s perseverance, she was able to negotiate a creative settlement and move the stalled process forward.

She also spent significant time on a hotly contested child custody case, as well as handling an emotionally charged adoption. Working with Dallas-based partner David Clouston, Shana ensured that two boys – removed from their parent’s home for neglect – did not remain permanent wards of the state, but were instead adopted by their concerned and loving uncle.

Finally, Shana found time to mentor the next generation of lawyers – coaching Southern Methodist University Law School’s moot court team all the way to the final round. SMU’s team won Best Oral Argument at the John Marshall Law School International Competition in Chicago, and finished second overall.

Douglas Mishkin is known as a skilled advocate, thoughtful counselor, and community leader, who demonstrates his principles through his work on a variety of causes. He is a mentor and model for young attorneys, and has been a vocal pro bono supporter since the day he arrived at the firm.

Mr. Mishkin has played a central role in a matter involving a high profile discrimination case against a public charter school in Washington DC. He also currently serves on the D.C. Superior Court Jury Instruction Task Force, a committee of leading Washington lawyers who advise the local court system. And, since 2002, Doug has served on the George Washington University Hospital Ethics Committee, which analyzes bioethical issues and proposes solutions for physicians. Committee members are on-call to answer critical emergency questions as they arise after hours and on weekends. In his spare time, Doug also participates in the Workplace Flexibility 2010 initiative, a campaign to support development of a comprehensive national policy on workplace flexibility at the federal, state and local levels.

Associate honorable mention awards were presented to attorneys who have made a significant impact on the firm’s pro bono success. These awards were presented to Marci Fulton and Peter Gould in the Denver office, Kevin Kinnan in the Dallas office and Tara Goebel, Billy Wynne and Travis Seegmiller in the Washington DC office. Partner honorable mention honors went to John Voorhees and Cole Wist in the Denver office, David Clouston in Dallas and Joseph Brand in the Washington office.
