Stephen Hoffman Chairs NY Bar Association Task Force on Attorney-Client Privilege
The President of the New York State Bar Association has appointed Siller Wilk partner Stephen D. Hoffman to chair a Task Force on the Attorney-Client Privilege that has been formed in response to the practice of state and federal prosecutors, regulators and agencies of requesting that corporations waive their attorney-client privilege and the protection of the work product rule in various circumstances, including plea agreements, deferred prosecution agreements, decisions as to whether to commence enforcement proceedings, and sentencing.

The Task Force is charged with reviewing the issues associated with this practice and issuing a report and recommendations concerning the nature and extent of this practice by state and federal prosecutors, regulators and agencies in New York State, the reasons that such prosecutors, regulators, and agencies believe the practice should be permitted, and whether the practice serves the public interest or whether recommendations should be made for its modification or cessation.

Steve will chair a Task Force of 15 distinguished attorneys, including two former United States Attorneys and prominent corporate litigators and criminal defense attorneys. The Task Force has already issued comments on the United States Sentencing Guidelines and an interim report, both of which were adopted as the official position of the New York State Bar Association. The Task Force expects to issue its final report by the end of 2007.
