What goes around, comes around, for Osler partner
Inco Ltd. will be putting a piece of Canadian legal history to rest on August 16 when it buries its poison pill takeover defence plan. In 1988, Inco unveiled Canada's first poison pill and found itself in the middle of a furious national investor debate. The legal pharmacists who designed Inco’s pill were Osler, Hoskin & Harcourt heavyweights Peter Dey, now a Bay Street financier, and Brian Levitt, now co-chair of the law firm, and then junior associate Clay Horner.

Eighteen years later, it was Mr. Horner who had to shred Inco’s poison pill. Now Osler’s other co-chair, Mr. Horner steered negotiations that led to last week’s agreement to strike down the pill in August. “A lot has happened in the rights plan world since 1988.” Mr. Horner said.
