Thelen Lands Top Public Utilities Commission Lawyer
Thelen Reid Brown Raysman & Steiner LLP announced today that Peter Allen, a senior attorney and former administrative law judge at the California Public Utilities Commission (CPUC), has joined the firm’s Energy, Utility, and Infrastructure practice in San Francisco.

Mr. Allen has extensive contacts within the regulatory arena and substantial experience on issues affecting renewable energy. Given the importance of regulatory issues to renewable and other emerging energy technologies, the firm’s clients will receive exceptional benefits from Mr. Allen’s expertise.

Mr. Allen’s broad experience is invaluable to clients facing regulatory and environmental issues. He represents clients in proceedings before the CPUC and other agencies, primarily in the areas of energy, renewable and alternative energy, and the California Environmental Quality Act (CEQA). As an Administrative Law Judge, Mr. Allen is known for his work on high-profile energy policy proceedings, many on expedited schedules, including allocation of $30 billion in electricity contract costs, implementation of California’s Renewables Portfolio Standard, utility asset sales and leases, and siting of electric transmission lines and substations.

As the CPUC’s lead CEQA attorney, Mr. Allen advised the proper application of CEQA to major energy and telecommunications projects, including electric transmission lines, long-distance fiber optic cables, and the proposed sale of PG&E’s hydroelectric system and watershed lands.

In addition to his CEQA work, Mr. Allen represented witnesses before legislative committees, negotiated settlements of complex electricity proceedings before the Federal Energy Regulatory Commission, and represented staff witnesses in particularly sensitive cases before the CPUC relating to claims of deliberative process privilege. As interim assistant general counsel, Mr. Allen supervised the work of the commission’s attorneys in enforcement proceedings in the areas of energy, telecommunications, water, and transportation.

Thelen partner Mark Weitzel, Chair of the firm’s Infrastructure and Asset Finance Practice, said that Mr. Allen’s CPUC experience will be a great asset to what is already a leading energy practice. “Peter is a highly respected energy and environmental lawyer in California,” Mr. Weitzel said. “He brings a great deal of regulatory expertise and will add further strength to our already bustling renewables practice.”

Siemens Medical to Acquire Dade Behring in Tie-up of Medical Supply Manufacturers
Skadden is representing Dade Behring, Inc. with the antitrust aspects of its approximately US$7 billion acquisition via a tender offer by Siemens Medical Solutions Group, a subsidiary of Siemens AG (Germany). The transaction was announced on July 25. Both Dade Behring and Siemens Medical Solutions are manufacturers of medical supplies.

Disney Buys Club Penguin
The Walt Disney Company announced on Aug. 1 it has acquired Club Penguin, the online virtual world for children, for approximately $700 million. Skadden lawyers represented Disney on the transaction, and also on the acquisition financing.

Phelps Dunbar Partner Receives Lifetime Achievement Award
Phelps Dunbar LLP is pleased to announce that Reuben V. Anderson, a partner in the firm's Jackson office, was presented The Mississippi Bar's 2007 Lifetime Achievement Award. Judge Anderson was honored during The Mississippi Bar's 102nd annual meeting Farewell Brunch and Awards Program on Thursday, July 14, 2007 in Destin, Florida.

The Mississippi Bar presents the Lifetime Achievement Award to those individuals who have devoted service to the public, profession and the administration of justice over the span of a professional career. Only individuals who have contributed significantly to the system of justice and/or to our legal profession are qualified to receive this award.

Judge Anderson, the first African-American Supreme Court Justice in Mississippi, practices in the areas of commercial litigation, regulatory and governmental matters and gaming. In addition to his work with Phelps Dunbar, he has cultivated a professional resume spanning three decades of legal service. He has held many key positions including: Jamie L. Whitten Chair of Law and Government at the University of Mississippi, Fall of 1995; Mississippi Supreme Court Justice, 1985-91; Circuit Court Judge for the 7th Circuit Court District, 1981-85; County Court Judge for Hinds County, 1977-81; Municipal Judge for the City of Jackson, 1976-77; Partner, Anderson, Banks, Nichols & Stewart, 1968-77; Mississippi Associate Counsel, NAACP Legal Defense and Educational Fund, Inc., 1967-75. Judge Anderson is also among a select group of lawyers, recognized in the category of Litigation: General Commercial, listed in a nationwide client survey published in Chambers USA, America's Leading Lawyers for Business.

Stacie Collier Recognized by Providence Business News; Nixon Peabody LLP Attorney Honored As One of Providence’s “40 Under Forty”
Ms. Collier represents management in labor and employment matters. She provides legal and practical counsel to clients regarding personnel issues, including employee handbooks, hiring, and discipline and discharge. She has also had a significant amount of experience performing training in the workplace on topics such as preventing workplace harassment and discrimination, as well as management of medical leave laws.

Ms. Collier said, “I am privileged to receive this honor from Providence Business News. As an attorney and a working mother, I feel honored that my work has been recognized, and I am proud that I have been able to balance a busy practice while remaining active in the local community.”

In addition to her client work, Ms. Collier actively participates in pro bono work. For example, she has provided advice and counseling to small nonprofits, has represented an ACI inmate in a constitutional challenge and has defended indigent clients who would otherwise be unable to afford counsel. She has logged more than 300 hours of pro bono work while working at Nixon Peabody. Ms. Collier is also active in the Rhode Island community, serving as the chair of the Capital City Community Centers Board of Directors, which is dedicated to working with Rhode Island’s poor, giving them the tools needed to achieve better lives. She is also a founding member of the Rhode Island Business Group on Health.

Latham & Watkins Adds Mergers and Acquisitions Partner to its Highly Regarded Practice

WCM Wins Favorable Result at Essex County, Personal Injury Trial
WCM’s resident New Jersey partner Robert Ball recently secured a defense result in the case of McNish v. Castellano, et al. In this case, McNish was in a car operated by a co-defendant when the co-defendant lost control of the vehicle and crashed into a house. Prior to the accident, the plaintiff and co-defendant had been at a Christmas party at our client’s restaurant where, they argued, they had been allowed to drink to excess which was the principal cause of the resulting accident.

Using co-defendant’s own testimony, we made it clear to the trial judge that co-defendant did not manifest any visible signs of intoxication. Consequently, we argued there was neither a legal nor factual basis upon which liability against our client could be founded. The trial court agreed and pressed the plaintiff to voluntarily discontinue her claims against our client which she did.
