Pamela K. Peelor joins the firm’s Naples, Florida office as a director in the Estates and Trusts Group. She focuses her practice in the areas of estate planning, estate administration, and the representation of fiduciaries in matters involving estates, trusts and private foundations. She received her J.D. from the University of Pittsburgh in 1977 and her B.S. (Cum Laude) from Ursinus College in 1974. Ms. Peelor is a former partner at the Pittsburgh office of Clark &Peelor where she practiced from 1989 until 1999. Prior to joining Cohen & Grigsby, Ms. Peelor was senior vice president and senior trust advisor at Wachovia Bank in Sarasota, Florida. Phillips Lytle to Participate in Series of Seminars on Zoning, Land Use and SEQRA
Adam Walters, the current Chair of Phillips Lytle’s Environment and Energy Practice Group, will be will be participating in a Lorman seminar on August 23, 2006 in Albany at the Crowne Plaza. The seminar, which will run from 8:30 a.m. to 4:30 p.m., will focus on Basic Zoning Law, compliance with the State Environmental Quality Review Act or SEQRA, and how to prepare a zoning application. The zoning and land use seminar is geared towards developers, project managers, engineers, municipal officials, attorneys and other members of the land use community. Additionally, Mr. Walters will be leading a series of land use seminars to provide an in-depth overview of land use subject area in Albany, Buffalo, Syracuse and Rochester throughout 2006.

Mr. Walters is a Partner with Phillips Lytle LLP, one of the region’s largest full service law firms. He practices in the areas of environmental law and land use planning focusing on environmental impact review pursuant to the State Environmental Quality Review Act and the National Environmental Policy Act, as well as land use laws including zoning, site plan reviews, historic preservation law and wetlands permitting. COURT APPROVES SETTLEMENT BETWEEN EMPLOYEES AND NYCCOC
On August 15, 2006, the United States District Court in Manhattan approved a settlement among the New York Convention Center Operating Corp. (“NYCCOC”) ( the state authority charged with operating the Javits Convention Center) and three individual employees of NYCCOC with a class of current and former African-American and Hispanic NYCCOC employees. The agreement resolves class proceedings in a case styled Cokely, et al. v. NYCCOC, et al. that was commenced in 2000 alleging, among other things, racially biased distribution of work opportunities and treatment of minorities. The settlement requires NYCCOC to institute a range of human resources programs aimed at enhancing its policies and procedures, already in place, to prevent and remedy any discrimination in the workplace. The settlement also calls for a payment of approximately $8.4 Million to be paid to minority class members who are or were during the relevant period freight handlers, show carpenters, and part-time housekeepers, which payment includes a total of $3 Million in attorneys’ fees and costs, as approved by the Court. While the Defendants in this action have maintained that the plaintiffs’ charges are baseless, they have agreed to the settlement and the implementation of the remedies provided for by the Decree in the interest of ending a time consuming and very expensive litigation.

Flaschen, Bingham Lead Active Bankruptcy Cases
Hartford partner Evan Flaschen and Bingham McCutchen were recognized as the top special counsel lawyer and top special counsel law firm, respectively, for active bankruptcy cases through August 16, 2006. Flaschen led all attorneys with seven active cases. Seven attorneys from other law firms tied for second place with three active cases each. Bingham McCutchen tied with one other firm for the first-place ranking among law firms, with 14 active cases.

Norton Journal of Bankruptcy Law and Practice
A new section of the U.S. bankruptcy code has removed doubt that has surrounded plan support agreements in connection to prenegotiated Chapter 11 cases in the aftermath of Delaware bankruptcy court decisions in 2002, according to an article by Hartford counsel Kurt Mayr. According to the article “Unlocking the Lockup: The Revival of Plan Support Agreements under New §1125(g) of the Bankruptcy Code,” the voluntary or involuntary filing of a bankruptcy petition in the middle of a prenegotiated plan process should no longer pose the threat that continuing and completing the process after the bankruptcy filing will violate §1125(b) or risk the vote of creditors who are participating in the process. Debate about the plan support, or “lockup,” agreements began after the U.S. District Court in Delaware issued two decisions that cast significant doubt on the propriety of such agreements even if a miniscule amount of activity related to the agreements took place after the debtor filed for Chapter 11, Mayr wrote.

Hartford partner Mark Oland offered his thoughts on real estate investment trusts (REITs) and how one Hartford-based real estate firm may be getting into a lucrative practice. CBRE Realty Finance Inc., the finance arm of CB Richard Ellis, filed paperwork with the Securities and Exchange Commission to become a REIT, which means it would purchase real estate with investors' money, with the expectation of selling the properties within a certain timeframe for a certain return on investment. “Their name is a Tiffany name in this country and around the world,” Oland said of CB Richard Ellis. “But the one piece they were never in was real estate investment.” A REIT must return 90 percent of all income to its investors. To invest in the REIT, investors must have a net worth of $150,000 or a gross annual income of at least $45,000 and a net worth of at least $45,000. The minimum investment is $5,000. "There are a whole lot of these (REITs) who have done this and raised enormous amounts of money," Oland said. "REITs work very hard to make sure they're not admitting investors who aren't qualified. It's effectively like a bond, but the risk is greater than a bond.

The Section of Environment, Energy and Resources (SEER) of the American Bar Association has elected Fennemore Craig attorney Lauren (Larry) J. Caster as chair of the 10,000-member section for 2006/2007. He previously served in numerous other leadership positions in the Section.
