Barbara A. Ruga to Address the Michigan Public Employer Labor Relations Association on September 28
Clark Hill attorney Barbara A. Ruga will address the Michigan Public Employer Labor Relations Association during their annual conference on September 28. Ruga’s presentation is entitled “Pre-Employment Hiring/Retention Issues: Legal Defense or Admission of Wrongdoing.”

Ruga has been practicing law for nearly 30 years in the areas of education, labor relations and employment law. She predominantly represents public school districts in a wide range of employment and school law matters, and frequently lectures to public school districts on employment matters.

Ruga has published several books and articles in the field of employment law, including articles in the Michigan Council of School Attorneys Newsletter. She was the co-editor and author of “Michigan Wrongful Discharge and Employment Discrimination,” (ICLE, 1990-1994) and “Wrongful Discharge Cases in Michigan,” (1984 and 1987 editions).

Ruga has been active locally on bar association committees, professional, charitable and local governmental projects.

Ruga earned her J.D. and B.A., cum laude, from the University of Michigan.

Local Nixon Peabody Attorneys Tee-Off for Tee-Ball! Firm Offers the Roberto Clemente Foundation with Pro Bono Services and Sponsors First-Ever Tee-Ball Tournament Held on Gracie Mansion Lawn
Nixon Peabody LLP attorneys joined forces on August 17 with New York City Mayor Michael R. Bloomberg and Roberto Clemente, Jr., the president of the Roberto Clemente Sr. Foundation, for the first-ever Gracie Mansion Tee-Ball Tournament. The tournament celebrated youth athletics, teamwork, and community sports with 5-to-7-year-old little leaguers from all five New York City boroughs.

Nixon Peabody has been providing pro bono services to the Roberto Clemente Foundation. The firm, along with Major League Baseball, the New York Yankees, and the New York Mets, sponsored the Tee-Ball Tournament. Led by attorneys Trisha Smith and Michael Cooney, a team at Nixon Peabody has been advising the Clemente family on focusing its charitable and community activities, and using its foundation to enhance the legacy of Roberto Clemente.

Nixon Peabody Grows Technology and Intellectual Property Practice; Three Former Federal Circuit Clerks Bring Life Sciences and Patent Litigation Experience, and Boost Seventy-Five Member Practice
Nixon Peabody LLP announces the expansion of its Technology and Intellectual Property (TIP) Practice with the addition of three new attorneys in its Washington, DC, office. Jeff Schwartz and Lawrence Sung, Ph.D., join as partners; Mary Webster joins as counsel. All three join Nixon Peabody from Schwartz, Sung & Webster, an intellectual property law boutique known for representing clients in patent litigation and high-level patent portfolio development and management.

Richard D. Rochford, chair of Nixon Peabody’s TIP Practice, said, “With the addition of Jeff, Lawrence, and Mary, Nixon Peabody is gaining three phenomenal patent practitioners. They are all former Federal Circuit clerks, which adds further depth to our national patent litigation practice. We are very excited to have them join us. Dr. Sung is a nationally known professor of IP law, currently at the University of Maryland School of Law. He has developed a superior reputation in the IP bar, and is a prolific writer and speaker. He coauthors the book Patent Infringement Remedies with Judge Randall R. Rader of the U.S. Court of Appeals for the Federal Circuit. He also recently chaired a session for the National Academy of Sciences on intellectual property and toxicogenomics. Dr. Sung is a graduate of the University of Pennsylvania (B.A., Biology) and of the American University Washington College of Law (J.D., cum laude). He obtained his doctorate in microbiology from the U.S. Department of Defense Uniformed Services University.

Mr. Schwartz has significant experience in handling high-profile patent and IP appeals. He has litigated patent cases in various U.S. district courts, and has appellate experience before the Federal Circuit and the U.S. Court for Veteran Appeals. A registered patent attorney, he is an active writer and speaker, and has coauthored The Patent Law Handbook with Lawrence Sung. Mr. Schwartz is a graduate of the U.S. Military Academy (B.S., Engineering Mechanics) and of Georgetown University Law Center (J.D., magna cum laude ). He also holds a master’s degree in systems management from the American Technological University .

Ms. Webster, who has significant life sciences industry experience, practices biotech patent law for corporate and university clients. Ms. Webster also has teaching experience as a law professor, and is a graduate of the University of Wisconsin (B.S., Bacteriology) and a graduate, magna cum laude, of the American University Washington College of Law. She has a master’s degree in microbiology from the University of South Florida.

Latham & Watkins Adds Senior Corporate Attorney In Singapore, With Strong India Market Experience
Latham & Watkins LLP1 is pleased to announce that Rajiv Gupta has joined the firm's Singapore office as of counsel in the Corporate Department. Gupta will bolster the firm's leading corporate finance practice.

Gupta has extensive experience representing large investment banks and domestic and foreign issuers on offerings of equity, high-yield and investment-grade debt and convertible, equity-linked and derivative products.

2006 Asian Legal Business Southeast Asia
Latham & Watkins was awarded the highest number of trophies at the recent awards in Singapore, including the prestigious International Deal Firm of the Year for its outstanding client service and ""ability to combine rigorous analysis with astute judgment to give clients a competitive edge."" Latham picked up an additional seven deal awards including:

* Southeast Asia M&A Deal of the Year for the P.T. Adaro Indonesia deal, recognized by the judges as one of the largest and most complex LBOs in the Asian market in recent history;
* Southeast Asia Deal of the Year for the high yield bond offering and concurrent senior credit facility by Adaro Finance B.V.;
* Singapore M&A Deal of the Year for the firm's work on the landmark Colony Capital acquisition of the hotel business of Raffles Holdings Limited, with Latham acting on behalf of the lead arrangers;
* Equity Market Deal of the Year for the ICICI Bank Limited transaction in India;
* Debt Market Deal of the Year and Singapore Deal of the Year for the ground-breaking Chartered Semiconductor Manufacturing $925 million combined offering; and

The judging panel considered deal value, complexity, innovative deal structure, the timeframe for completion and significance to the market in naming the winners of the deal categories.

King & Spalding Named One of the Top Defense Practices in the Nation
King & Spalding, a leading international law firm, has been selected by the National Law Journal as one of the top defense practices in the nation. The firm was one of only 14 law firms chosen for inclusion in the newspaper’s second annual listing of defense-oriented firms of singular achievement, published August 21, 2006.

The paper chose defense firms that managed an overall impressive track record, scored at least one significant defense win within the past 12 months (i.e., prevailing in a bench or jury trial in which the financial stakes were high, or where a win might set the tone for litigation strategy or determine the outcome of similar cases nationally) and devoted at least half their litigation resources to defense work.

King & Spalding was cited for three noteworthy cases: TradeCard Inc. v. S1 Corp., Colaccio v. Apotex Inc. and Buynie v. Airco, with mentions of King & Spalding partners Holmes J. Hawkins III, Chilton Davis Varner and W. Ray Persons. Brief descriptions of these cases follow:

Tradecard Inc. v. S1 Corp., No. 03-1468-akh (S.D.N.Y. 2006). Lead counsel Holmes Hawkins defeated a $12 million patent infringement claim against S1 Corp. and Bank of America over software used to process international financial transactions. The jury also declared Tradecard's patent invalid.

Colaccio v. Apotex Inc., No. 05-5500 (E.D. Pa. 2006). Chilton Varner represented GlaxoSmithKline PLC in this products liability suit alleging that the antidepressant Paxil can lead to suicide and violence. The firm secured the first dismissal in such a suit on the ground that the U.S. Food and Drug Administration's approval of the product's packaging precluded a failure-to-warn claim.

Buynie v. Airco, No. ESX-L-5502-03 (Essex Co., N.J., Super. Ct. 2006). Lead counsel Ray Persons. The firm defeated class certification of employees of a New Jersey chemical plant who claimed related health problems. Through lengthy discovery, the team demonstrated that the circumstances of the various plaintiffs were too different to support certification.

In its description of the firm, the newspaper reported, “King & Spalding's litigation group, which at 455 lawyers represents better than half the 800-attorney firm's bench strength, appears to have had another successful year. With headquarters in Atlanta and offices in Houston, London, New York and Washington, the firm represents more than 250 public companies, including half of the Fortune 100.
