O’Melveny Wins Asylum for Peruvian Man
O'Melveny recently obtained a grant of asylum for a 33-year-old Peruvian man persecuted in his home country because he is gay and HIV positive.

New York associate Amy Slusser and counsel John Rousakis represented our client, under the supervision of partner Andy Frackman. Former associate Mona Houck also assisted in assembling evidence and helping to draft the declaration, while legal assistant Lamia Azize provided invaluable translation assistance. Immigration Equality, which referred the case to the O'Melveny, also provided vital guidance.

Our client faced persecution from the time he was a child because of his sexual orientation. He was expelled from school as a young teenager because the headmaster thought that he was gay. He was forced to change schools twice more because he was continually harassed by other students. His family disowned him. In 2001, he was detained, sexually assaulted, and beaten by the Peruvian police because he is gay.
In 2005, the family of his former boyfriend, along with police affiliated with that family, stalked our client at his home and work and threatened to kill him. The local police precinct refused to protect him and advised him to move. Although he moved several times to protect himself, his former boyfriend's family located him and tried to kidnap him. Though friends and neighbors thwarted this attempt, his attackers told him that they would find him and kill him.

Our client decided to flee Peru and come to the United States because he had a friend in the New York area. Through Immigration Equality, he learned that he could file an application for asylum. After collecting records from Peru and testimony from his friends, O'Melveny filed an affirmative application for asylum. At his interview, the asylum officer told our client that his story was very compelling. On July 25, the director of the New York asylum office approved his application.

""Our client is overjoyed with the result and has expressed his heartfelt thanks to all who helped with his case,"" said Slusser.
