Panel Highlights Strategies for the Advancement of Minority Women Attorneys at Large Firms
More than 100 law firm and community leaders attended a recent program hosted by Jenner & Block and the American Bar Association Commission on Women in the Profession, which discussed the “sobering statistics” uncovered in the Commission’s study, “Visible Invisibility: Women of Color in Law Firms.” The panelists discussed the study which examines the challenges faced by women of color who matriculate through private practice. The study revealed that women of color in large firms perceived that they were more likely than white men to be denied desirable assignments and excluded from networking opportunities. "Our hope is to use the study's findings as a meaningful tool in the legal profession," said Pamela J. Roberts, Chair of the ABA's Commission on Women in the Profession, who moderated the discussion.

Jenner & Block Managing Partner Gregory S. Gallopoulos introduced the panel, which included Jenner & Block Partner Charlotte L. Wager; Susan R. Lichtenstein, Corporate Vice President and General Counsel of Baxter International Inc.; Vincent A.F. Sergi, National Managing Partner of Katten, Muchin, Rosenman LLP; Mary L. Smith, Senior Litigation Partner at Tyco International (US) Inc. and Member of the ABA's Commission on Women in the Profession; and Christina M. Tchen, Partner at Skadden, Arps, Slate, Meagher & Flom LLP. The program was organized by Tamara Askew, Programs and Projects Manager for the ABA's Commission on Women in the Profession and Jenner & Block Partner E. Lynn Grayson, who chairs the Firm's Women's Forum.

The panelists highlighted several areas in which firms can strive to address the challenges faced by minority women. Above all, they stressed that firms need to implement initiatives to ensure that minority women are receiving quality work assignments. "The real issue -- the starting point issue for women of color -- has got to be about the work," said Ms. Tchen.

Ms. Wager encouraged attorneys in leadership positions to proactively approach partners assigning work and recommend minority women attorneys for assignments. The panelists suggested that firms' diversity committees closely monitor work assignments and intervene when necessary to confirm that all individuals are involved in meaningful work.

In addition, several panelists recommended that firms focus on creating effective mentoring programs. Ms. Lichtenstein urged firms to pair young women attorneys of color with successful white male partners rather than matching them with mentors of the same race and gender. Mr. Sergi added that firms should consider providing mentor training for partners.

Ms. Wager also emphasized the significant impact that marketing and networking can have on the professional advancement of minority women. “Firms should provide attorneys with the resources to create visibility and gain exposure both within and outside of the firm,” she said.

Six Associates Join Much Shelist
"Chicago-based law firm Much Shelist has recently added six new Associates. Myles A. Cochran has joined the Real Estate practice group, from Associate at Stahl Cowen Crowley LLC in Chicago. Joining the firm’s Litigation & Dispute Resolution practice group are Andrea E. Forsyth, from Assistant State’s Attorney in the Criminal Appeals Division of the Cook County State’s Attorney’s Office; Christopher J. Petelle, from Assistant State’s Attorney in the Criminal Appeals and Civil Divisions of the Cook County State’s Attorney’s Office; and Autumn L. Sharp, from Associate in the Columbus, Ohio, office of Jones Day. Additionally, the Business & Finance practice group has added Chad J. Van Den Top, from Senior in Transaction Advisory Services at Ernst & Young in Chicago.

Joseph M. Martin has also joined the Business & Finance practice group after spending a year as a volunteer attorney at the Cabrini Green Legal Aid Clinic. Prior to that, Martin worked for seven years as an Associate in the commercial finance practice at Goldberg Kohn in Chicago and served as an Associate focusing on finance and securitization at Mayer, Brown & Platt (now Mayer, Brown, Rowe & Maw LLP) in Chicago."

Wiley Rein Files Supreme Court Amicus Brief on Behalf of the Self-Insurance Institute of America
Wiley Rein has filed an amicus curiae brief with the Supreme Court of the United States in LaRue v. DeWolff, Boberg, & Associates, Inc. The brief was filed on behalf of the Self-Insurance Institute of America (SIIA), a non-profit organization of nearly 1000 members that serve tens of millions of health plan beneficiaries. SIIA is dedicated to the advancement and protection of the self-insurance industry, and provides practical information and recommendations to the public and the government on a range of subjects relevant to the effective functioning of the self-insurance system, including provisions of the Employee Retirement Income Security Act of 1974 (ERISA) that concern the rights of self-insured health plans and plan participants.

Mr. LaRue sought to recover $150,000 after the ERISA plan fiduciary for his 401(k) retirement account allegedly failed to invest plan assets as instructed by Mr. LaRue in breach of the terms of the plan. The lower court rejected Mr. LaRue’s claim as a matter of law even though Section 502(a) of ERISA expressly requires plan fiduciaries to “make good” on “losses to the plan” that result from breach of the “duties imposed” on them under ERISA, and Section 502(a)(3) allows plan participants to recover “appropriate equitable relief” to “enforce any provision of...the terms of the plan.”

Wiley Rein’s amicus brief argued that the successful functioning of the self-insurance industry in general—and self-funded plans in particular—depends on the integrity of plan assets. The brief explained that SIIA’s members have a compelling interest in ensuring plan solvency and preserving the right to recover assets from plan fiduciaries, as well as plan participants that convert or dissipate funds that rightfully belong to the plan. The brief further addressed the practical implications of the issues presented in the context of the broader purposes of ERISA.

Gayle Horwitz named Secretary to Board of Directors of Cleveland Jewish News
Vorys, Sater, Seymour and Pease LLP is pleased to announce that Gayle I. Horwitz, an associate in the law firm's Cleveland office, has been named Secretary of the Board of Directors of the Cleveland Jewish News. Ms. Horwitz joined the Board in 2006.

Ms. Horwitz practices with the litigation group, where she represents corporations, non-profits and government entities in a variety of contract and employment disputes. She is also the President of the Northeast Ohio Chapter of the American Constitution Society, a member of the Hon. William K.
