Chambers USA 2007 Honors Blackwell Sanders
Chambers USA: America's Leading Lawyers for Business ranked Blackwell Sanders No. 1 for its corporate work in Missouri, Kansas and Nebraska; the firm was also ranked No. 1 for labor and employment and real estate in Missouri. Foley Expands Litigation Department With Addition of Dennis Kinnaird in Los Angeles
Foley & Lardner LLP announced today that Dennis E. Kinnaird has joined its Los Angeles office as a member of the Litigation Department and the General Commercial Litigation Practice.

“Dennis’ 40 years of trial experience will be invaluable in serving clients in all areas of litigation,” said Jon Wilson, chair of the firm’s Litigation Department. “Dennis has an extensive commercial litigation background and is widely recognized for his expertise in federal trial practice, trial of complex cases, defense of complex criminal cases, white collar crime cases and legal malpractice actions. These skills will provide a great resource to the firm in representing clients both nationally and on the West Coast.”

Kinnaird joins Foley after spending most of his career at Munger Tolles & Olson LLP, where he handled cases involving alleged violations of securities laws, income tax evasion, contract fraud and disputes, violations of corporate political contributions, legal malpractice, broker dealer defense, Employee Retirement Income Security Act (ERISA) claims, bad faith insurance claims, will contests and business torts. He has particular experience defending cases initiated by the Federal Savings and Loan Insurance Corporation, Federal Deposit Insurance Corporation and Regional Transportation Commission. Over the course of his career, this wide variety of cases has contributed to Dennis’ courtroom skills, with a particular emphasis on challenging and protracted jury trials.

Prior to his private practice, Kinnaird served six years as an Assistant United States Attorney in the Central District of California, specializing in business fraud, government contract fraud and income tax evasion. In this capacity, he spent three years as the chief of the Special Prosecutions Section, which was responsible for prosecuting fraud and organized crime.

He is a Fellow of the American College of Trial Lawyers and has previously served as chairman of the Committee for Southern California and as a member of the Ninth Circuit Judicial Conference, Los Angeles County Bar Committee for Evaluation of Candidates for the Federal Court and the California State Bar Committee for Judicial Evaluation.

Fennemore Craig expands Real Estate Practice Group with the
The Tucson office of Fennemore Craig has expanded its Real Estate Practice Group with the addition of associate Katharine Burns Milliman.

Prior to joining Fennemore Craig, Milliman worked as a litigation associate at Kirkland & Ellis in Chicago. She also served as a Public Interest Law Initiative Fellow at the Legal Assistance Foundation of Metropolitan Chicago, where she worked in the Immigration Project.

Milliman holds a law degree from Cornell Law School, a master’s degree in historic preservation from the University of Vermont, and a master’s degree in history from the University of Chicago.

Timothy J. Berg, Fennemore Craig Managing Partner, Named To Head National Organization
Timothy J. Berg, managing partner of Fennemore Craig, has been chosen president-elect of the American Academy of Appellate Lawyers.

Berg began his term as president-elect on August 1. The American Academy of Appellate Lawyers was formed “to advance the principles and tenets of appellate practice in state and federal courts by bringing together the leading attorneys in the nation who devote their practices to appellate representation,” according to the organization’s Web site.

Berg practices in the area of civil appeals and public utilities regulation. He has participated in the briefing or argument of over two hundred appeals before the United States Courts of Appeals for the Ninth Circuit, the Second Circuit, the Fourth Circuit, the Fifth Circuit, the Eleventh Circuit, the Federal Circuit, the Supreme Court of Arizona and both divisions of the Arizona Court of Appeals.

His appellate practice spans a broad field of substantive areas, including employment law, medical malpractice, product liability, environmental, state and local taxation, business torts, real property and mineral rights, bankruptcy and public utilities law.

Berg was listed in the 2007 Best Lawyers in America®, Business Litigation and Public Utility Law and Chambers USA Leading Lawyers for Business directories.

He holds a law degree from the University of Arizona and a bachelor’s degree from Arizona State University.

WHAFH Brings Antitrust Suit Against Evanston Northwestern Healthcare
A lawsuit filed Aug. 7 piles onto a Federal Trade Commission decision announced a day earlier that Evanston (Ill.) Northwestern Healthcare’s 2000 acquisition of Highland Park (Ill.) Hospital was anti-competitive under federal antitrust law.

Citing the commission’s conclusion that the merged system bullied its prices above competitive levels, the complaint seeks class-action status and asks for monetary damages on behalf of Evanston resident Jeffrey Porter and everyone who paid for care in the past seven years at Evanston Northwestern’s three hospitals.

The class would include insurance companies as well as patients who paid out of pocket for all or a share of their bills, according to Mary Jane Fait, a partner in the Chicago office of Wolf Haldenstein Adler Freeman & Herz, the firm that filed the complaint.

Fait said that the firm was aware of the disputed merger, which the FTC challenged in 2004, and was watching for the long-awaited opinion. “The findings were pretty clear-cut and definite about overcharges and increasing prices to healthcare payers,” she said.

She declined to elaborate on Porter’s identity or experience with the hospitals, all of which are located in Chicago’s northern suburbs.

Evanston Northwestern declined to comment. “We haven’t been served yet,” spokeswoman Jennifer Mitchell said.

The FTC decision allows the system to remain intact but orders it to negotiate separately for Highland Park’s managed-care contracts. -- by Gregg Blesch

Dallas Real Estate Attorneys Represent Crescent Real Estate Equities in $382 M Deal
The Dallas office of Bracewell & Giuliani advised Crescent Real Estate Equities in its recent sale of North Texas office properties to Equastone Acquisitions LLC.

The deal involved the sale of 12 Class A commercial office buildings and a single 40-acre tract of undeveloped property. The gross purchase price was $382M. The properties, located primarily in North Dallas, total approximately 3 million square feet of prime office space.

The Bracewell & Giuliani team was led by Dallas real estate partners Bill Millard and Brock Bailey and also included Chris Fuller and Monica Berry, associates at the firm.

The Crescent in-house team, under the direction of David Dean, Managing Director and General Counsel, and Dan Smith, Senior Vice President and Corporate Counsel, included Cris Baird, Asset Management Counsel, and Bobby Nandipati, Associate Counsel.

Michael Levinson of Cooley Godward Kronish acted as outside counsel for Equastone on the deal

John W. Stevens Joins von Briesen & Roper, s.c.
Mark A. Shiller, Chair of the Wealth Management Section of von Briesen & Roper, s.c., announced today that Attorney John W. Stevens has joined the Mequon office as a Shareholder. Paralegals Dale Stevens and Angela Schiller, who have worked with Stevens for many years, also join the firm’s Wealth Management Section in the Mequon office.

Stevens concentrates his practice in estate planning and probate law. Before joining von Briesen & Roper, Stevens maintained offices in both Cedarburg, Wisconsin and Carefree, Arizona. Stevens will transfer his Cedarburg, Wisconsin practice to the Mequon office of von Briesen & Roper and continue to maintain his office in Carefree, Arizona.

Mark Shiller said, “John is a great addition to our trusts and estates practice. He is a skilled practitioner with an established Wisconsin practice, and will certainly help us expand our ability to serve our clients with ties to the State of Arizona.”

Stevens is a member of the Fellows of the Wisconsin Law Foundation, the Fellows of the American Bar Association, the State Bars of Wisconsin and Arizona, the American Bar Association and the Ozaukee County Bar Association. He is the past President of the Greater Cedarburg Community Foundation, the Cedarburg Cultural Center, the Wisconsin Law Foundation and the Fellows of the Wisconsin Law Foundation. He received both his J.D. (1964) and B.A. (1961) from the University of Wisconsin. Stevens resides in Port Washington, WI, with his wife.
