U.S. Court of Appeals Decision Upholds FDA Approval Process for Experimental Drugs
The United States Court of Appeals for the District of Columbia Circuit ruled 8-to-2 in favor of the U.S. Food and Drug Administration (FDA) and its current policy regulating the use of experimental drugs that have not yet been approved. Zuckerman Spaeder LLP partners William Schultz and Carlos Angulo, with associate Maryll Toufanian, provided pro bono support to amici in this case, filing a brief in support of the current FDA standards on behalf of the National Organization for Rare Disorders (NORD). Foundation filed suit against the FDA and U.S. Department of Health and Human Services in an effort to allow the sale of investigational drugs to terminally ill patients. However, many patient advocacy groups, including NORD, supported the FDA’s position that allowing the use of drugs that have not been proven safe and effective in comprehensive clinical trials could undermine the incentive for testing drugs and deny patients and physicians critical information.

“Had the FDA and Department of Health and Human Services lost this important appeal, our country’s system for identifying safe and effective drugs would have been compromised,” said Schultz. “FDA has programs to permit patients to gain access to experimental drugs, usually as part of clinical trials, but if companies were permitted to sell drugs before they were proven safe and effective, then we might never get the information necessary to determine whether drugs work.”

Chernekoff Re-Appointed Membership Vice Chair of the ABA's Environmental Enforcement and Crimes Committee
Jones Walker partner Michael A. Chernekoff was recently re-appointed Membership Vice Chair of the Environmental Enforcement Crimes Committee of the American Bar Association's Section on Environment, Energy, and Resources. He served in this position in 2005-2006 and 2006-2007. His new term will run from August 2007–2008. As Membership Vice Chair, Chernekoff is responsible for planning and implementing activities that will encourage member participation and attract new members to join the committee.

Howrey Selected to The American Lawyer’s 2007 “A-List” Firm Honored for the Third Time in the Last Four Years
For the third time in the last four years, Howrey LLP has been ranked in The American Lawyer’s “A-List”, a ranking of the top twenty law firms in the United States.

The “A-List” ranks firms nationwide by calculating scores in four specific categories: revenues per lawyer; pro bono hours and attorney participation in pro bono activities; associate satisfaction; and workplace diversity. Howrey ranked tied for nineteenth in this year’s ranking.

Dykema Attorney Appointed Chair Of ABA Forum On Affordable Housing & Community Development Law
Rochelle E. Lento, Of Counsel in Dykema’s Real Estate Practice Group, has been appointed to serve a one-year term as Chair of the Forum on Affordable Housing & Community Development Law of the American Bar Association (ABA) beginning in August 2007 at the ABA Annual Conference. Prior to the appointment as Chair, Ms. Lento has served on the Governing Committee of the Forum for the past six years. Prior to that service, she was the Associate Editor and Editor-in-Chief of the Forum Journal on Affordable Housing and Community Development Law. She has also served as Conference Chair of the Forum’s Annual Conference in Washington, D.C. and participated as a panelist and moderator on numerous occasions. In 2005 Ms. Lento also co-edited an ABA book publication, The Legal Guide to Affordable Housing Development. The Forum's objectives are to: (1) serve as a lawyers’ clearinghouse with regard to information and programs related to affordable housing and community development; (2) serve as a coordinator of educational and training programs within the ABA for lawyers practicing in the area of affordable housing and community development; (3) hold one or more educational conferences per year; and (4) provide training programs focusing on new issues or ongoing concerns. For the upcoming year, the Forum will hold a Regional Conference in New Orleans in February 2008 entitled, "Affordable Housing Lessons from Katrina" and its 16th Annual Conference in Washington, D.C. in May of 2008. In addition, several law school career panels are planned to be held in Charlotte, North Carolina, New Orleans, Louisiana and Washington, D.C.

Ms. Lento’s real estate practice focuses on all aspects of affordable housing development, including the various state and federal programs supporting affordable housing. Prior to joining Dykema, she was Clinical Professor of Law at the University of Michigan Law School and Executive Director of the Law School’s Legal Assistance for Urban Communities Clinical Program. Ms. Lento is a member of the Detroit Metropolitan Bar Association, the Women Lawyers Association of Michigan, the American Bar Association and numerous civic and cultural associations.

A resident of Detroit, Ms. Lento earned a B.A. cum laude from the State University of New York in 1978. After college, she worked for the Association of Community Organizations for Reform Now and for Detroit City Councilwoman Maryann Mahaffey before earning a J.D. from the University of Detroit Law School in 1987.

Arent Fox Associate Leah Eisenberg Named Executive Officer of the Women’s Division of NYIC
Arent Fox LLP is proud to announce that Leah M. Eisenberg, an associate in the firm’s bankruptcy and financial restructuring practice, has been named as an executive officer of the Women’s Division of the New York Institute of Credit (NYIC). The appointment formalizes the role that Eisenberg took on in 2006 when she was asked to help launch the Women’s Division as a means of providing support to women building their own networks in the areas of finance and restructuring. Eisenberg is one of four founding executive officers of the NYIC’s Women’s Division.

Founded in 1918 as the New York Chapter of the National Institute of Credit, the NYIC is a networking organization for attorneys, banks, lending institutions, accountants and professionals in the finance, corporate and restructuring area. I n 1957 the NYIC was granted an absolute charter as an educational corporation by the Board of Regents of the State of New York. As a nonprofit organization, the NYIC’s faculty consists primarily of credit executives, accountants and/or lawyers who understand and appreciate the close relationship between those professions.
