SHB Named to NLJ’s Elite “Defense Hot List”
Shook, Hardy & Bacon’s “exemplary, cutting-edge defense work” has been recognized for the second consecutive year in The National Law Journal’s “Defense Hot List.”

The July 16, 2007, edition of the NLJ features three trial successes for each of the 10 firms named to this year’s distinguished list. The editors were impressed by the diverse nature of SHB’s work as exemplified in Derr v. Foot Locker, Inc. (Bill Martucci and Kristen Page); Ball v. Bayard Pump & Tank Co. (Dave Erickson, Paul Williams, Joel Mosher, and Seth Miller); and Green v. Alpharma (Rob Adams, John Johnston, Don Kemna, and Steve Soden).

The NLJ reported that SHB’s victory in Derr v. Foot Locker, Inc. “showed why clients hire firms with lots of resources” and described the firm’s ability to use mock jury trials to prepare clients for the actual courtroom battle.

Satterlee, Grever Prevail for Utility Client in Appellate Court
The Missouri Court of Appeals has ruled that SHB client City Utilities of Springfield, Missouri, can construct a new $800-million power plant in a decision that may put an end to the Sierra Club's battle to keep the facility from operation. City Utilities needs Southwest Power Station Unit 2 to meet the electricity needs of southwestern Missouri over the next 20 years. The Sierra Club has been fighting the facility’s construction both in court and at the ballot box as part of its national campaign to prevent construction of coal-fired power plants. The appellate decision is one of the first in the nation in which a court has ruled in favor of a utility on every single objection raised by the Sierra Club.

The court’s opinion marks the culmination of a nearly three-year legal dispute over the Missouri Department of Natural Resources (MDNR) permit to construct the power plant. Even though MDNR's permit requires City Utilities to install state-of-the-art pollution-control technologies, the Sierra Club opposed the permit on the grounds that the air pollution emission levels allowed by the permit were inadequate to protect human health and the environment.

The Sierra Club originally appealed issuance of the permit to the Missouri Air Conservation Commission, which conducted a full evidentiary hearing. The advocacy group hired technical experts from around the country to challenge the permit's emission limits, control technology selection, and health and welfare review, but City Utilities and MDNR demonstrated to the Commission that the permit was appropriate and sufficiently protective of health and air quality in the region.

Sierra Club continued its appeal through the Circuit Court of Greene County, Missouri, which affirmed the Commission's order upholding the permit, to the Southern District Court of Appeals. In a complete victory for City Utilities, the Court of Appeals rejected each and every challenge raised by the Sierra Club.

Bar Honors Willis for Distinguished Service
The Atlanta Bar Association presented Rogers & Hardin LLP partner Jeff Willis with its 2006-2007 Distinguished Service Award for his work as chair of the Elections Committee. Mr. Willis was recognized for his leadership of the committee from 2005 through 2007.

Patent Litigator Joins Quinn Emanuel New York
Thomas D. Pease has joined the firm’s New York office as a partner. Mr. Pease has more than twelve years of intellectual property litigation experience, specializing in complex patent cases in the electrical and computer engineering fields.

Before joining Quinn Emanuel, Tom was a partner with Kirkland & Ellis LLP, where his clients included Infineon, Micron, Samsung, Agere, Lucent, and Osram Sylvania. He has expertise in patent cases involving a wide range of technologies, including semiconductor chips, fabrication processes, packaging technologies, data and telecommunications networks and protocols, and electroluminescent phosphors.

Tom graduated magna cum laude from St. John’s University Law School in 1994, where he served as Articles and Notes Editor of the St. John’s Law Review. In 1989, he graduated from Boston University with a degree in Electrical Engineering.

Cummings & Lockwood Attorney Appointed as Coordinator of Disaster Legal Services
The law firm of Cummings & Lockwood LLC is pleased to announce that Rani Newman Mathura, a Private Clients Group associate in the Firm?s Greenwich office, has been appointed as Coordinator of Disaster Legal Services for 2004-2005. Disaster Legal Services is the pro bono arm of the American Bar Association?s Young Lawyers Division, which works under contract to the Federal Emergency Management Agency (FEMA).

As Coordinator, Ms. Mathura is responsible for arranging for legal services to be provided to those counties that are declared federal disaster areas by the President. Recently, she oversaw the provision of legal services to victims of the California fires, the California earthquake and the flooding that occurred in various states.

In 2001, Ms. Mathura developed, maintained and trained volunteers to staff the Connecticut Bar Association?s disaster relief hotline which fielded thousands of nationwide calls from those seeking legal services in connection with the September 11, 2001 terrorist attacks. In recognition of her work, June 14, 2002, was declared "Rani Newman Mathura Day" in the State of Connecticut.

Ms. Mathura received the Connecticut Law Tribune?s 2002 "Advocacy of the Law Award" as a "New Leader of the Law." She is also active with the Connecticut Bar Association?s Young Lawyers Section where she has served several terms as Co-Chair of the Trusts, Estates and Tax Committee.

Merchant & Gould Welcomes Two New Attorneys to Seattle Office

David L. Garrison

David L. Garrison joins the firm as Of Counsel. Mr. Garrison has worked in the Seattle area as an intellectual property attorney for more than 30 years. Prior to joining Merchant & Gould, Mr. Garrison worked in private practice. He specializes in domestic and international patent and trademark prosecution, litigation, client consultation, mediation, arbitration and licensing with an emphasis on The Russian Federation and the Commonwealth of Independent States. He served as a member of the Board of Governors of the Federal Circuit Bar Association and is active in the FCBA and the American Intellectual Property Law Association. He edits the compilation of Eastern European intellectual property laws entitled "Intellectual Property in Eastern Europe and the CIS" published by Oceana Publishing. Mr. Garrison received his J.D. from George Washington University and has an undergraduate degree in chemical engineering from Oregon State University.

Brian N. Platt

Brian N. Platt joins the firm as an associate. Mr. Platt has spent two years as a law clerk in the United States District Court in Seattle. Prior to his time at the court, he worked as a patent litigation associate at Perkins Coie. He is a 2003 summa cum laude graduate of Seattle University School of Law, and a registered Professional Engineer in the State of Washington.
