Brown Rudnick Adds New Tax Partner to New York Office
Brown Rudnick, a premier international law firm, today announced that Patrick M. Cox has joined the firm’s New York
office as a Partner in the Corporate & Securities Department. Mr. Cox focuses his practice on taxation law and has extensive experience in general tax planning including issues of partnership, real estate, international and corporate taxation. Prior to joining Brown Rudnick, Mr. Cox was Counsel in the tax practice at Akin Gump Strauss Hauer & Feld LLP in New York.

NAOC Selects Brown Rudnick to Build Bipartisan Congressional Support on Issues Related to Military Munitions Response Services
The National Association of Ordnance and Explosive Waste Contractors (NAOC) today announced that it has retained Brown Rudnick to augment and manage its federal government relations program. Brown Rudnick’s Washington DC Government Law & Strategies Group will assist the NAOC Board of Directors and Government Affairs Committee with public policy and advocacy strategies. Specifically, Brown Rudnick will serve as a legislative representative to build bipartisan Congressional support for environmental issues associated with the Operational Range and Military Munitions Response Programs.

The NAOC represents and promotes the interests of its members and the public in all aspects of military munitions response services. NAOC members regularly perform characterization and cleanup of sites contaminated with munitions and explosives of concern (MEC), including unexploded ordnance (UXO). According to NAOC President Heather Polinsky, “NAOC’s primary goal is to act as one industry voice on issues related to military munitions response services. Fostering government-industry partnerships through active dialogue with government agencies and officials is key to advancing our
mission. When we looked to augment our current government relations program, we turned to Brown Rudnick. The DC team has over a century of collective experience in Washington, with in-depth knowledge of Congress, its members and their staff and a proven track record of success on behalf of their clients.”

Ruth Ravitz Smith, a Principal in Brown Rudnick’s Government Law & Strategies Group, will act as the NAOC team leader. She will be joined by a dynamic team of bipartisan Capitol Hill advocates, including fellow principals Michael Lewan, Doyce A. Boesch, and James J. Bonham.

Thirty-Five Dorsey Attorneys Named Minnesota Super Lawyers

Cozen O’Connor Member William J. Winning Elected Fellow of The American College of Trial Lawyers
Cozen O’Connor member William J. Winning has been elected a Fellow of the American College of Trial Lawyers (ACTL). Founded in 1950, the ACTL is dedicated to maintaining and improving the standards of trial practice, the administration of justice and the ethics of the profession. Fellowship is extended to experienced trial lawyers who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility and collegiality. Fellows of the ACTL include both plaintiff and civil defense attorneys, as well as prosecutors and criminal defense attorneys.

Resident in the Philadelphia office, Winning is chair of the white collar crime and complex criminal defense practice group. He concentrates his practice in the representation of individuals and corporations under investigation for or charged with violations of federal and state criminal law and has tried numerous cases to verdict in both federal and state courts. Winning also has significant experience representing clients in a variety of regulatory and government compliance matters.

A member of the National Association of Criminal Defense Lawyers, the Pennsylvania Association of Criminal Defense Lawyers and the American Bar Association, Winning is listed in Chambers USA, has been named in The Best Lawyers in America and was selected a Pennsylvania “Super Lawyer" by his peers, appearing in Philadelphia magazine and Pennsylvania Super Lawyers. Maryland Day Laborors to be Paid Their Wages for Hurricane Katrina Recovery Work.
A federal court in Maryland approved a settlement agreement last week that had been reached between Unlimited Restoration, Inc. (URI) and 46 Maryland day laborers who had not been paid for their work in the Gulf Coast following Hurricane Katrina Under the $100,000 settlement, negotiated by Zuckerman Spaeder LLP and CASA of Maryland, Inc., the workers will be paid their regular and overtime wages in full, less administration costs.

The Maryland workers had been recruited in and around Montgomery and Prince George’s Counties in September 2005, by a subcontractor of URI, MFC General Contractors, Inc., to clean up casinos in Mississippi damaged by Hurricane Katrina. After nearly two months of moving large debris from the water, shoveling away mud and cleaning out rotten food from refrigerators, the workers returned to Maryland and were not paid in full by MFC. In December 2005, CASA of Maryland, Inc., filed the case on the workers’ behalf for their unpaid wages. Leslie Berger Kiernan and Ellen D. Marcus of Zuckerman Spaeder LLP later joined the effort, providing pro bono services to the workers.

Also last week, U.S. District Judge Catherine C. Blake ruled against MFC and its principals, Miguel Canales and Fredis Canales, finding that there is no bona fide dispute that the workers are owed regular and overtime wages. The court left for a jury to determine the amount of additional damages that the workers are due.

“After nearly two years, it is a relief to know that our clients will finally be paid for their hard work,” said Marcus. “I hope that this case will not only encourage employers to act responsibly, but also inspire other workers who have been similarly mistreated to come forward and seek justice.”

“Immigrants are among the most vulnerable workers in our economy, “said Jessica Salsbury, a CASA attorney who worked on the case. “Compounding the horror faced by poor Gulf Coast communities in the wake of Hurricane Katrina, workers rights were and continue to be violated throughout the aftermath. This case is an important victory for low-wage workers everywhere.”

Powell Named Vice Chair for ABA Business Law Subcommittee
Norman M. Powell, a partner in the Business Planning, Transactions and Restructuring Section of Young Conaway Stargatt & Taylor, LLP, has been appointed Vice Chair of the Planning and Communications subcommittee of the Commercial Finance Committee of the Section of Business Law for the American Bar Association. In addition, Mr. Powell will serve as the Commercial Finance subcommittee liaison to the Membership Committee of the Section of Business Law. Mr. Powell’s term for both positions will run through 2010.

In his role as Vice Chair, Mr. Powell will have responsibility for continuing legal education programs and other initiatives including the subcommittee's newsletter.

The ABA Section of Business Law’s Committee on Commercial Financial Services consists of lawyers whose practices are concentrated in commercial lending. Most members represent financial institutions, although many regularly represent borrowers. The subcommittees focus on new developments in commercial lending law, including agricultural and agri-business, aircraft, maritime, and real estate financing, secured lending, lender liability, loan documentation, and loan participations and syndications.

USPTO Trademark Trial and Appeal Board Issues Final Amended Rules of Practice
There has been an important development at the U.S. Patent and Trademark Office, Trademark Trial and Appeal Board (“TTAB”). On August 1, 2007, the TTAB published its long-awaited "Miscellaneous Changes to Trademark Trial and Appeal Board Rules", which amend the Trademark Rules of Practice before the TTAB (PDF copy attached). This package of rules follows the February 2006 proposed rules, which generated much concern and debate amongst trademark practitioners in the U.S.

Oblon, Spivak was so concerned with the impact the February 2006 proposed rules would have on trademark owners that we created a blog, TTAB-Rules.com. The full discussion, including the comments by bar associations opposed to those proposed rules, can be found here: www.ttab-rules.com. This web site contains the original proposed rules, and much of the commentary and comments provided to the TTAB in opposition to the proposed rules.

The final rules published on August 1, 2007 remove many, but not all, of the objectionable portions of the proposed rules. The final rules will generally be effective on November 1, 2007, although a few provisions will be effective starting on August 31, 2007. Pending oppositions and cancellation proceedings are affected by these rules, as well as matters filed after those dates.

We are carefully studying the new rules, and will later provide our valued clients with our recommendations regarding the new rules.
