Andrews Kurth Recognized for Support of Commuting Workers
The Houston-based law firm of Andrews Kurth was recently designated one of the Best Workplaces for CommutersSM by the U.S. Environmental Protection Agency (EPA) and U.S. Department of Transportation (DOT).

Best Workplaces for Commuters, a voluntary partnership program designed to cut traffic congestion and traffic-related air pollution, recognizes employers that provide environmentally friendly commuter benefits to employees. This designation identifies Andrews Kurth as an organization committed to reducing pollution, commuting costs, traffic congestion and employee stress caused by single-occupant vehicle commuting.

Andrews Kurth helps employees pursue environmentally-friendly and cost-effective commuting strategies by providing flexible work schedules, monthly transportation allowances, discounts on the METRO stored value cards and monthly rail passes.

""We are proud to make this commitment to our employees and to the environment,"" said Bill Livesay, the firm's executive director. ""The Best Workplaces for Commuters program demonstrates that a healthy business and a clean environment are not mutually exclusive.""

According to Margo Oge, EPA director of the office of transportation and air quality, the effects of incentive programs like Best Workplaces for Commuters can be dramatic. ""If just half of all U.S. employees were covered under these commuter benefits,"" said Oge, ""traffic and air pollution could be cut by the equivalent of taking 15 million cars off the road every year, saving American workers about $12 billion in fuel costs. That's both cleaner air and real savings for families.""

Best Workplaces for Commuters www.bwc.gov is a public-private partnership developed by the EPA and DOT. EPA and DOT have established a voluntary National Standard of Excellence for employer-provided commuter benefits. The program challenges employers across the country to voluntarily meet the National Standard of Excellence.

Stuart Krause and Bruce Goodman Speak to Association of Corporate Counsel in Israel about International Arbitration and Mediation
With the State of Israel increasingly involved in international trade and with an increased emphasis on settling disputes through arbitration and mediation, two attorneys from the Manhattan-based firm of Zeichner Ellman & Krause LLP recently made a presentation to the Association of Corporate Counsel in Israel. The topic was “International Commercial Arbitration and Mediation.”

“Cost is increasingly of concern to Israeli corporate counsel. This mirrors a trend to lowering litigation costs in the U.S., and both arbitration and mediation can avoid expensive and lengthy litigation,” said Stuart Krause, who made the presentation along with Bruce Goodman. Both attorneys have spent considerable time in Israel and are familiar with the country, language, customs and business climate.

Krause’s presentation focused on mediation. He said that Israel’s legal climate is amenable to mediation and courts are requiring parties to mediate disputes before litigation.

“In Israel, arbitration and mediation are becoming larger issues as the Israeli economy grows,” Krause said. “With Israel’s economy expanding internationally, Israeli corporations need and want to be prepared. This was the first presentation of the association devoted to these topics. Previous presentations mainly focused on transactional issues and doing business in the United States.”

Goodman discussed international arbitration and the need to carefully draft arbitration clauses to prevent disputes over wording and intent when arbitration takes place.

“Arbitration can be a cost-efficient way to resolve disputes, and a company can better control its litigation costs if the process is set up correctly, and the appropriate venue selected, instead of taking the risk that the company will be before a foreign country’s court, which may be biased against Israeli companies,” he said.

More than 50 corporate counsel, including several from some of Israel’s largest corporations, attended the event at the Sheraton Moriah in Tel Aviv.

Wiggin and Dana Files Amicus Brief in U.S. Supreme Court Cases Regarding Integration in Public Schools
Wiggin and Dana LLP has filed an amicus brief with the United States Supreme Court in two cases, slated for oral argument in December, involving public school integration.

The cases (Parents Involved in Community Schools v. Seattle School District No. 1 and Meredith v. Jefferson County Board of Education) were filed by parents opposed to student assignment plans for public schools in Seattle, Washington and Louisville, Kentucky. The plans, which were adopted voluntarily by these school districts, apply when students choose to attend or transfer to schools other than their local schools and ensure that school populations reflect the racial makeup of the districts as a whole.

Wiggin and Dana filed the brief supporting the school districts on behalf of a group of social scientists led by Amy Stuart Wells at Teachers College, Columbia University, and that school's Campaign for Educational Equity. Referencing extensive research, the brief argues that, should the court subject the plans to strict scrutiny, the districts have a compelling interest in supporting integration given the long-term benefits of K-12 integration for students and society.

""These cases involve local decisions by communities and parents to adopt, voluntarily, school assignment plans that use modest measures to ensure that their students experience a diverse educational environment at a young age,"" said Kenneth D. Heath, an attorney in the firm's Appellate Practice Group, who led the Wiggin and Dana team working on the brief. ""The social science evidence demonstrates compelling, lifelong benefits from this kind of experience, and we hope this research assists the Justices as they consider these cases.""

The team also included Robert G. Huelin and Gregory M. McLaughlin.

Jane Kotake is a partner in the firm’s commercial real estate practice. Her clients include many of the region’s leading builders and developers. She earned a law degree from Syracuse University (J.D., 1995) and received her undergraduate degree from Vanderbilt University (B.S., 1992).

Darryl Moss is an associate in the commercial real estate practice, representing builders and developers in the creation of mixed-use and other complex planned real estate developments throughout the country. He also advises clients on other real estate matters, including RESPA and brokerage matters. Darryl earned his law degree from Emory University (J.D. 2000) with honors and his undergraduate degree from the University of Wisconsin (B.S., 1996), also with honors.

John Nelson is a general litigation attorney who represents clients in a variety of disputes related to real estate, professional liability, construction projects and contracts. He also handles personal injury litigation, for both plaintiffs and defendants. He earned his law degree from Emory University (J.D., 1994) and his undergraduate degree from the University of West Florida (B.A., 1991).

Ashoo Sharma, a general litigation attorney, represents clients in matters arising from real estate brokerage and real estate contracts. Ashoo’s practice also focuses on insurance defense, commercial litigation and employment law matters. Ashoo earned her law degree from the University of Georgia (J.D. 2001) and an undergraduate degree from Georgia State University (B.A., 1997). An active member of the Georgia legal and business community, Ashoo has served as the executive vice president of Georgia Indo-American Chamber of Commerce, as vice president and board member of the IndusBar of Georgia and currently serves as a Barrister in the Bleckley Inn of Court.

Kyle Williams practices general civil litigation with an emphasis on matters affecting real estate builders, developers, contractors and agents. He also represents real estate professionals in defense of malpractice claims and lawsuits as well as handling personal injury and premises liability lawsuits. He earned his law degree from the University of Tennessee College of Law (J.D., 2001) and received his undergraduate degree from the University of Tennessee at Martin (B.S., 1998).

WWHGD Handling $4 Billion Vegas Construction Project
The Las Vegas Strip is getting a $4 billion facelift and Weinberg, Wheeler, Hudgins Gunn & Dial, LLC, is helping make it happen. The law firm has been selected by Boyd Gaming Corporation to handle all construction contracts, and any ensuing disputes, as the hospitality giant develops a mixed-use resort on the 63-acre site now occupied by the once legendary Stardust Resort & Casino. It will be demolished in 2007.

With a scheduled opening in early 2010, the new resort – Echelon Place – will include 5,300 hotel rooms, 1 million square feet of meeting and convention space, 350,000 square feet of retail stores and a 140,000 square foot casino. Echelon Place is regarded as the second most expensive single hospitality industry development ever undertaken after the MGM Mirage's $6 billion CityCenter project.

Boyd Gaming brought in WWHGD early to negotiate the day-to-day project needs with the goal of avoiding formal disputes and limiting liability and claims. David Larson, managing partner of WWHGD’s Vegas office, and Lee Roberts are leading the firm’s team of lawyers.
