Large Firms Start Building Comprehensive Health Practice Groups
“Health Law” as a distinct discipline has been around for more than three decades, yet only recently have some of Canada's major firms begun building comprehensive health practice groups.

According to Michael Watts , Co-Chair of the new National Health Care Group at Osler, Hoskin & Harcourt LLP, the change can be largely attributed to Chaoulli v. Quebec (Attorney General) [2005] S.C.J. No. 33. “From a lawyer’s perspective,” said Watts, “health care was a publicly funded provincial issue. With Chaoulli, it became a national issue.” He noted the Supreme Court found there were “parallel private and public health care systems thriving in Europe and in Britain ….. And they said, ‘Our health care system is broken and you have to fix it.’ ”

As a result, he predicts “a paradigm shift in public perspective re: paying for health care services.” He said, “Osler did their due diligence and assessed that health care is a place they want to turn their attention to. If you look at the future – three to five to 10 years down the road – health care will be very different than it is today. The private sector will have a role.
