Four Larson • King attorneys named 2007 Super Lawyers

Super Lawyers is a comprehensive and diverse guide to outstanding attorneys, representing a wide range of practice areas, firm sizes and geographic locations. Only 5 percent of the lawyers in each state or region are named in Super Lawyers.

Labaton Sucharow Litigators Prepare for Trial in In re JDS Uniphase Securities Litigation
Very few PSLRA cases go to trial…but as they have done so successfully in the past in the In re Real Estate Associates trial, on October 1, 2007, Labaton Sucharow will take claims against JDSU to trial. The team is led by Barbara J. Hart. The core allegations on trial will be that insiders and key executives sold off close to a billion dollars in stock before the market was informed of the business slowdown of which they were then allegedly aware.

Appearing before the Honorable Claudia Wilken in the U.S. District Court for the Northern District of California on July 26, 2007 and awaiting a formal, written decision from the Court, Judge Wilken reserved October 1st as the commencement of the trial.

The case alleges that the company and four of its officers, who each sold hundreds of millions of dollars of JDS stock at enormous personal profit, made false and misleading statements from October 28, 1999 to July 26, 2001 regarding demand for company products, inventory levels, revenue recognition, and goodwill associated with two acquisitions. By the time the truth finished emerging about the financial condition of JDS Uniphase, the company had written down hundreds of millions of dollars in inventory and over $40 billion dollars of goodwill. These disclosures wiped out billions of dollars in shareholder value.

Labaton Sucharow serves as Lead Counsel to the Connecticut Retirement Plans and Trust Funds, which was appointed Lead Plaintiff by the Court.

Patent Attorney Authors Chapter in IP Legal Strategies Book
Briggs and Morgan, Professional Association, announces the release of Aspatore Books’ The Best Practices of Leading IP Lawyers: An Insider Look at Successful Case Strategies, Understanding Client Goals, and Interpreting IP Laws and Trends, which includes “Steering Clients Toward Successful Patents,” authored by Briggs and Morgan patent attorney Gerald E. Helget.

Helget’s chapter discusses the entire patent process from filing applications with the United States Patent and Trademark Office (USPTO) to building an intellectual property portfolio, patent laws, infringement and enforcement.

“The most important thing for a client to do is to first see a patent attorney, before developing any concept beyond a prototype,” Helget writes. “I am successful when my clients receive broad patent and trademark rights.”

Helget is a licensed patent attorney through the USPTO and has been building an intellectual property practice since 1983, based on a very strong technical background in a wide range of industries. He has successfully enforced the legalities of each aspect of the patent process. In his personal life, being an avid fisherman and hunter, Helget is in the final stages of developing his own invention relevant to big game hunting. He received his law degree from William Mitchell College of Law.

EnCana Closes US$500 Million Offering of Debt Securities
Our client EnCana Corporation closed a US$500 million offering of debt securities pursuant to a takedown of its universal shelf registration statement that was filed and declared effective by the SEC in September 2006. The securities issued in connection with this offering consisted of 6.625 percent unsecured and unsubordinated notes due August 15, 2037, to be delivered by the joint book-running managers, Banc of America Securities LLC and Merrill Lynch & Co., and the rest of the underwriter syndicate. EnCana is a TSX and NYSE-listed company that is one of North America's leading natural gas producers, is among the largest holders of natural gas and oil resource lands onshore North America and is a technical and cost leader in the in-situ recovery of oilsands bitumen. EnCana plans to use the net proceeds of this offering to repay a portion of its bank and commercial paper indebtedness. The Paul, Weiss team included corporate partner Andrew Foley, associates Brett Nadritch, Emilio Mena and Peter Wright and summer associate Alexandra Cambouris. Tax advice was provided by partner David Mayo and environmental law advice was provided by counsel Bill O'Brien.

Corporate Partner Joins Dorsey & Whitney Minneapolis
The law firm of Dorsey & Whitney LLP announced today that Jeffrey Saunders has joined the firm's Minneapolis office as a partner in the Corporate group. Saunders will focus on corporate finance, mergers and acquisitions, and health care law, with a particular emphasis on emerging companies. He is widely recognized in Minnesota’s innovation and venture capital community, and is a frequent speaker on the lecture circuit.

Saunders, previously a partner with Fulbright & Jaworski L.L.P., has extensive experience across the spectrum of the health care supply chain, from medical device and pharmaceutical manufacturers, to health care technology and service providers. In collaboration with Dorsey partner Mark Kinney, he helped pioneer the development of consumer-driven products and services, such as health reimbursement accounts and health savings accounts, in the health care benefits area.

Saunders has also been extensively involved in the information technology industry, representing a wide variety of software, hardware and telecommunications companies on matters like private and public equity offerings, mergers and acquisitions, joint ventures, technology development and licensing agreements, corporate governance and regulatory compliance.

Sutherland Lands Top Litigator Rachel Giesber Clingman for Growing Houston Office
Sutherland Asbill & Brennan LLP announced today the addition of a top litigation partner for its expanding Houston office. Effective immediately, Rachel Giesber Clingman, formerly of Fulbright & Jaworski LLP, joins Sutherland’s Litigation Practice. She will serve as Co-Partner-in-Charge of the Houston office and will head a national business litigation group, which includes energy and environmental litigation.

Ms. Clingman is an experienced trial lawyer, who has handled numerous jury trials and appeals across the country. She has received nationwide recognition for her client work in complex commercial litigation, including BTI Consulting Group’s prestigious 2007 Client Service Award.

Ms. Clingman is recognized as one of the five top Women in Energy by EnergyLaw360. She previously served as President of the Women’s Energy Network in Houston and on the Advisory Board of the 2005 and 2006 World Oil Women’s Global Leadership Conference in Energy and Technology. In addition to energy and commercial litigation, her first-chair trial experience includes aviation claims, shareholder disputes, and international litigation arising from alleged acts of terrorism in the Middle East.
