Kenneth Kaufman Gives Copyright Presentation
D.C. intellectual property and technology partner Kenneth Kaufman gave a presentation on “Copyright: The Year in Review” at a plenary session of the 2006 AIPLA (American Intellectual Property Law Association) Annual Meeting on October 21 in Washington, D.C. Mr. Kaufman's presentation focused on a review and analysis of recent case law and public policy developments in the copyright area, including those involving fair use, file-sharing, copyright infringement, damages and compulsory licenses.

Attorneys Urged to Woo Public Opinion for Clients: Lawyer Cleared Defendants Convicted in Media: Article Profiling Lin Wood
The high-profile cases of L. Lin Wood are a who's who list of individuals who rose to prominence after they were wrongly accused in the media.
The job of Mr. Wood, an attorney for 29 years, was to win their innocence after they had been convicted in the court of public opinion.
John and the late Patsy Ramsey, who Mr. Wood said were the most convicted individuals in recent history, Richard Jewell, and former U.S. Rep. Gary Condit are among those on the 54-year-old attorney's list of high-profile clients.
""It is important in today's media era for a lawyer to effectively advocate for a client in the court of public opinion,"" the Atlanta-based lawyer said yesterday prior to speaking to about 75 attorneys and judges at the Inverness Club in West Toledo.

North Carolina Academy of Trial Lawyers Mountain Magic Seminar Patricia A. Bronte
Jenner & Block Partner Patricia A. Bronte will speak at a North Carolina Academy of Trial Lawyers’ seminar entitled “Representing Guantanamo Prisoners: Navigating the Devil’s Triangle,” to be held October 21, 2006 at the Grove Park Inn in Asheville, North Carolina.

Ms. Bronte will discuss the factual background and legal issues that have arisen as a result of the United States’ indefinite detention of hundreds of prisoners at the Guantanamo Bay Naval Base in Cuba. She will also address the conditions under which prisoners are being held, the status of the cases challenging their detention and her experience as an attorney for several of the detainees, among other things.

EFAW PROMOTED TO LIEUTENANT COLONEL
Wheeler Trigg Kennedy attorney Andrew Efaw has been promoted to Lieutenant Colonel in the United States Army Reserve's Judge Advocate General's (JAG) Corps and has been appointed as the Regional Defense Counsel for the Central States Region. A graduate of West Point and the University of Pennsylvania Law School, Mr. Efaw served one year in Iraq as a Special Defense Counsel in 2004-2005. At WTK, Mr. Efaw practices in the areas of commercial, franchise, and product liability litigation, primarily for Fortune 100 automotive, pharmaceutical, and medical device corporations. Mr. Efaw was one of the principal WTK attorneys who recently represented pro bono a nonpartisan group of concerned Colorado citizens challenging the Colorado Secretary of State's certification of electronic voting machines.

Section 4 of Canada's Security and Information Act was impermissibly overbroad, says Stuart Svonkin in The Globe and Mail
In a landmark ruling yesterday, Judge Lynn Ratushny of the Ontario Superior Court struck down section 4 of Canada's Security and Information Act, which is part of the Anti-Terrorism Act, passed after the September 11 terror attacks.

The Court determined that the so-called anti-leakage provisions in the Act are unacceptably broad, vague and open to abuse by authorities who could use the law to chill diligent journalism. In this instance, the court found that the RCMP had tried to use the provision to pressure an Ottawa journalist into revealing who had leaked her material related to the Maher Arar affair. Under the Act, offenders faced a prison sentence of up to 14 years for providing, receiving or retaining secret information.

Stuart Svonkin, who intervened in the case on behalf of the Canadian Civil Liberties Association, commented on the decision and the constitutional infirmities of the anti-leakage provisions: "If somebody slides a brown paper envelope under your door, you are liable even if you didn't ask for it and didn't do anything with it."

The RCMP relied on section 4 of the Act in 2004 to seize documents from the home and office of Ottawa Citizen reporter Juliet O'Neill after she wrote an article in the newspaper that caused the RCMP to suspect that she had received leaked material. Judge Ratushny ordered that the documents be returned.

Judge Ratushny said that while she could hardly blame the RCMP for using provisions that were available, the warrants amounted to an abuse of process that resulted in an undermining of the integrity of the judicial process. She held that the legislation fails to define in any way the scope of the information that is protected as “secret” and/or “official,” and that it uses the most extreme form of government control to criminalize the conduct of those who communicate and receive government information that falls within its unlimited scope.

Judge Ratushny refused a Crown request to suspend the effect of her ruling for a year, saying that the standard secrecy provisions that civil servants are required to follow ought to be sufficient to protect government information.

RCMP and Justice Department officials did not say yesterday whether they will appeal the ruling.
