Partner Jesse Ruiz Appointed to ComEd Board
ComEd announced today that its board of directors appointed Edward (Ted) J. Mooney, former Nalco chairman and chief executive officer, and Jesse H. Ruiz, a partner in the law firm of Garden Carton & Douglas, to the utility’s board of directors on Oct. 16, 2006. With the addition of Mooney and Ruiz, the ComEd board has eight directors including seven outside directors. Their election to the board further affirms ComEd as an independent entity, separate from its parent company, Exelon Corporation.

ComEd revamped its board in November 2005 in light of regulatory and political developments in Illinois that have put ComEd’s ability to recover its costs at risk. The addition of Mooney and Ruiz strengthens the utility’s management of potentially difficult financial and strategic issues in the future.

“I am extremely pleased with the addition of Ted and Jesse to our board,” said Frank M. Clark, ComEd chairman and chief executive officer. “Ted has held leadership positions at Nalco and Suez Lyonnaise for more than 25 years and will bring a fresh, independent perspective. We also will benefit from Jesse’s experience providing legal counsel to public and private companies and his distinguished record of public service in Illinois and within the Hispanic community.”

Mooney joined Nalco Chemical Company in 1969 as a corporate attorney and held numerous executive positions, including general manager, vice president, and president, before becoming chairman and chief executive officer in 1994. Nalco, headquartered in Naperville, is a leading provider of water treatment and process improvement services, chemicals and equipment for industrial and institutional applications.

Upon the acquisition of Nalco by Suez Lyonnaise des Eaux in 2000, Mooney was elected Délégué Général-North America of Suez Lyonnaise, a company that designs sustainable and innovative solutions for managing public utilities. Mooney retired from Suez Lyonnaise in 2001. He serves on the boards of Northern Trust Corporation, FMC Corporation, FMC Technologies, Inc., and Cabot Microelectronics Corporation. Mooney received a B.S. in chemical engineering and J.D. in law from the University of Texas. He also is a graduate of the M.I.T. Sloan Senior Executive Program.

Ruiz has concentrated his legal practice on mergers and acquisitions. He also assists public and private companies on corporate finance issues, consulting and other commercial agreements, reorganizations, corporate governance issues, and employment matters. Ruiz provides counsel to more than a dozen Illinois lawmakers who form the Illinois legislative Latino Caucus.

In 2004, Governor Rod Blagojevich appointed Ruiz chairman of the Illinois State Board of Education. The Board oversees a budget of more than $8.8 billion for the state’s public schools. Ruiz serves on numerous other councils and boards and has received several significant honors, including Crain’s Chicago Business “40 under 40 Rising Stars in Chicago Business” and the Cook County State’s Attorney’s Office “El Humanitario Award.” He received his J.D. from the University of Chicago Law School and a B.A. in economics and business administration from the University of Illinois.

Van Ness Feldman announces that John Clements joins the firm as Of Counsel in our Washington, DC office.
Van Ness Feldman, P.C. is pleased to announce that John H. Clements has joined the law firm’s Washington, DC office as Of Counsel. Mr. Clements previously served for 27 years at Federal Energy Regulatory Commission (FERC), most recently as Senior Attorney for Energy Projects. Mr. Clements brings particular expertise in the area of hydropower licensing and regulation to the firm’s robust and growing practice in this area. The firm represents municipal utilities, investor-owned utilities, and private developers with hydroelectric facilities of all sizes across the nation.

As a Director of FERC’s hydropower program office, advisor to Commission Chairs, and Senior Attorney, Mr. Clements was responsible for all aspects of hydroelectric project regulation, including processing of applications for licenses, license amendments and other authorizations, oversight of compliance, administration, and dam and project safety matters, and development of orders, rules and policy statements.

In addition, as an advisor to FERC Chairs Martin Allday, Martha Hesse, and Anthony Sousa, Mr. Clements provided legal and policy advice on wholesale electric utility rates and corporate regulation under the Federal Power Act, regulation of qualifying facilities under the Public Utility Regulatory Policies Act, and natural gas pipeline certificates. Mr. Clements received his LL.M. degree from the George Washington University, an LL.B. from the Faculty of Law at the University of Toronto, and a B.A. from the University of Michigan.

Klinedinst Los Angeles Welcomes Ross R. Scarberry, Esq.
KLINEDINST PC is pleased to announce that Ross R. Scarberry has joined the firm's Los Angeles office as a corporate attorney.

Mr. Scarberry has defended a wide array of business disputes, from employment and real estate to transportation and medical malpractice. He has handled cases in a variety of venues, including state, federal and appellate courts. He also has significant experience litigating construction defect, premises liability, and civil rights lawsuits.

Winstead Adds Intellectual Property Attorney in Houston Office
The intellectual property practice at Winstead Sechrest & Minick P.C. is adding Khannan Suntharam as a staff attorney in the Houston office. Suntharam’s practice covers all aspects of intellectual property law, including prosecution and litigation. On the prosecution side, his work has touched on integrated circuits, RFID systems, storage area networks, fiber channel networks, data transfer and file systems for computer networks, enhanced server capability, DVD players, wireless communications systems, power supplies and current generator circuits, phase detection circuits and automotive color-matching systems.

“We’re very pleased to have Khannan join us,” says Ross D. Margraves, Jr., managing shareholder of Winstead’s Houston office. “Intellectual property is an area of great importance to our clients, and his experience will enhance our impressive team of IP attorneys and patent agents.”

Suntharam has been involved in patent, copyright, trademark infringement, trade secret misappropriation and patent-related antitrust cases. His litigation work has involved technical fields such as chemical compounds, catalysts, electronic trading systems, optical configurations and computer control systems for telescopes, DVD compression techniques and cardioplegic solutions for heart treatment.

Suntharam’s work also includes the analysis of client IP portfolios to audit trademark and copyright assets, as well as the validity and infringement of patents in the fields of computer-controlled cooking devices and encrypted code symbols. Suntharam is registered to practice before the U.S. Patent and Trademark Office and he's a member of the Texas and California Bar. He received his J.D. from University of Houston Law Center, graduating Magna Cum Laude.

Kelly L. Pope joined the firm's litigation practice. She received her J.D. from the University of California at Los Angeles School of Law in 2004 and her B.A. from the University of Nebraska - Lincoln in 2001. Prior to joining Downey Brand, Pope was an associate with Sheppard, Mullin, Richter & Hampton LLP in Los Angeles.

FEDERAL COURT REJECTS FORMER EMPLOYEE’S ATTEMPT TO VACATE AN ARBITRATION AWARD
Firm partner Robert A. Sparer and Firm associate Jennifer M. Marrinan, in Vargas v. SEIU Local 32BJ and 2727 Realty LLC, persuaded a federal district court judge that the former superintendent of a residential building did not have standing to challenge the arbitration award that sustained his discharge, despite the fact that the union had permitted him and his private counsel to prosecute the grievance. In the former employee’s subsequent application to the Second Circuit, Mr. Sparer successfully argued that the appellate court should not stay the state Housing Court proceedings to evict the plaintiff.

Woodcock Washburn and Temple Law Announce John J. Mackiewicz Memorial Scholar
Zhenyu Yang, Ph.D., an evening student at Temple University’s Beasley School of Law, has received the fifth annual John J. Mackiewicz Memorial Scholarship in Intellectual Property. The scholarship was established by the intellectual property law firm Woodcock Washburn LLP in honor of John Mackiewicz, a 35-year veteran of the firm and nationally renowned intellectual property practitioner and trial lawyer who passed away in February 2001. The firm donated $50,000 towards the scholarship that is awarded since 2002 to a Temple Law student excelling in intellectual property law.

“Zhenyu Yang clearly demonstrates talent and passion for the intellectual property profession. She is a rising star who raises the bar for this scholarship, and we are extremely pleased that she is being recognized and honored in John Mackiewicz’s name,” said Dale Heist, a partner on the firm’s Policy Committee.

The law school selected Yang based on her outstanding academic performance in intellectual property courses, and her strong overall academic record. “We’re honored to award the scholarship and grateful to Woodcock Washburn for helping us keep John’s memory and commitment to the law alive in the legal community,” said Robert Reinstein, Dean of Temple Law. “I’m sure John would have been pleased with our choice, as Zhenyu will bring excellence to the practice of intellectual property.”

A resident of Collegeville, Pa., Yang attends law school at night while working as a registered patent agent at Johnson & Johnson, in the Corporate Law Department at Centocor, Inc. in Radnor. She previously was a staff scientist at PPD Discovery, Inc.

Yang received her B.S. degree from Beijing Normal University in 1992, in Beijing, China, and her Ph.D. in Molecular, Cellular and Developmental Biology from Ohio State University in 1999 in Columbus, Ohio.
