Harry Sandick, Former SDNY Deputy Chief Appellate Attorney, Joins Jenner & Block
Harry Sandick has joined Jenner & Block as a Partner in the Firm’s Litigation Department. Mr. Sandick will be based in the Firm’s New York office, where he will concentrate on complex civil and criminal litigation, including internal corporate investigations, white-collar criminal matters, SEC enforcement work and appeals. Most recently, Mr. Sandick served as Deputy Chief Appellate Attorney in the United States Attorney’s Office for the Southern District of New York. In addition, Mr. Sandick represented the United States Government as lead counsel in investigations, prosecutions and 12 trials involving a variety of white-collar crimes. He also served as Acting Chief of the Violent Crimes Unit.

During his five and one-half years as a federal prosecutor, Mr. Sandick was promoted from Assistant United States Attorney in the Southern District of New York’s Criminal Division to Deputy Chief Appellate Attorney. Among other things, he supervised the Criminal Division’s practice before the Court of Appeals in more than 80 appeals involving securities fraud, tax fraud, business crimes, obstruction of justice, RICO, homicide, international drug trafficking, extortion, robbery and terrorism. Mr. Sandick also argued 19 appeals before the Court of Appeals. In addition, Mr. Sandick was responsible for advising prosecutors in all units in the Criminal Division on complicated legal issues in grand jury investigations, trials and post-conviction sentencing hearings.

Mr. Sandick served as clerk to the Honorable Richard J. Cardamone, United States Court of Appeals for the Second Circuit, after obtaining his law degree from Harvard Law School, cum laude in 1995, where he was Editor-in-Chief of the Harvard Human Rights Journal and Research Director for the Harvard Legal Aid Bureau. Mr. Sandick also attended the University of Pennsylvania, where he was a Benjamin Franklin Scholar, and graduated magna cum laude with Distinction in History in 1992.

“Harry will fit right in to Jenner & Block’s demonstrated commitment to legal excellence at both the trial and appellate levels. He is a superb addition to the team of white collar litigators here in New York,” said Andrew Weissmann, a partner in the Firm’s New York office and the former Director of the Enron Task Force of the United States Department of Justice.

Jenner & Block Helps Spamhaus Appeal Possible Shutdown Ruling
Jenner & Block last week appealed a federal court ruling that threatens to shut down the volunteer organization Spamhaus, a UK-based non-profit that runs a commercial spam-blocking service.

In September, the U.S. District Court for the Northern District of Illinois issued a default judgment against Spamhaus and ordered the company to post a website notice saying that E360, a marketing company that was on Spamhaus’ list of companies sending spam email, was not a “spammer” and to pay E360 $11.7 million in damages. Spamhaus did not defend itself in the case initially because it had argued that the court lacked jurisdiction over a British entity.

Meanwhile, the plaintiff asked the court to order the Internet Corporation for Assigned Names and Numbers (ICANN) to withdraw Spamhaus’ domain name, thus shutting down its website. ICANN, however, released a statement stating it could not comply because it only has the authority to decide which domain names to hand out, and how, but does not have the power to suspend an organization from the net.

On October 19, the District Court denied E360’s request to order ICANN to withdraw Spamhaus’ domain name.

Spamhaus is comprised of volunteers who report spam messages and share the data with Internet service providers. According to the nonprofit, they are responsible for blocking more than 50 billion messages per day and its lists are used by several major Internet security companies.

Jaeckle Fleischmann Attorneys To Present At 53rd Annual Institute On Taxation
Jaeckle Fleischmann & Mugel, LLP, a law firm with offices in Buffalo, Amherst and Rochester, New York, and Phoenix, Arizona, announces that attorneys Paul A. Battaglia, Gayle L. Eagan, Raymond P. Ms. Eagan is a partner in the Firm's Estates & Trusts practice group. She concentrates her practice on estate planning, trusts and estate administration and litigation, surrogate's court practice, elder law, guardianship proceedings and adoptions. Ms. Eagan practices from the Firm's Buffalo office.

Mr. Reichert is a partner in the Firm's Tax and Economic & Land Development practice groups and has devoted substantially his entire career to the practice of tax law, including federal and New York income tax, New York sales and use tax, and other miscellaneous taxes. In addition to general transactional tax planning, his practice includes structuring real estate joint ventures, low income housing and historic tax credit partnerships, and economic development planning. Mr. Reichert practices from the Firm's Buffalo office.

Ms. Tzetzo practices in the Firm's Tax and Estates & Trusts practice groups. She has extensive experience in tax and business matters including corporation and partnership formation, mergers and acquisitions, debt and equity financing, as well as contract matters, including preparation and negotiation of transactional documents. She counsels individuals and closely-held businesses in the areas of estate planning, succession planning, and charitable remainder and life insurance trusts. Ms. Tzetzo practices from the Firm's Buffalo office.

Paul A. Battaglia To Present At Sales And Use Tax Program

Fortune 250 Survey: Baker Botts No. 1 in IP; No. 4 in Corporate Transactions; No. 5 Overall
Corporate Counsel magazine's annual survey of Fortune 250 general counsel, "Who Represents America's Biggest Companies", placed Baker Botts No. 1 in Intellectual Property with seven mentions, No. 4 in Corporate Transactions with seven mentions, and No. 5 Overall with 20 mentions.

Last year the firm was tied for fourth in IP with five mentions, did not make the Corporate Transaction list and was tied for 10th Overall with 19 mentions.

For the past five years, Corporate Counsel has conducted this survey, asking general counsel to list their "primary" outside law firm. This year, 93 companies provided information on their top outside counsel for corporate transactions, litigation, labor and employment, and intellectual property. Baker Botts was mentioned four times in the litigation field and twice in the labor and employment section in the 2006 survey.

"Placing first in the nation in Intellectual Property and among the Top 5 in Corporate Transactions and in the Overall category this year is a reflection of how we continue to strengthen our client service," said Managing Partner Walt Smith. "Most importantly, our 'overall' numbers come from across all categories, not from just one or two survey areas.

Bernard W. McCarthy Honored For Stewardship of Pro Bono Program at Chadbourne & Parke LLP
Bernard W. McCarthy, recently retired as Pro Bono Partner at Chadbourne & Parke LLP, was the honoree on October 19 at ""Raising the Bar,"" an event to benefit the Legal Services Center at The Door, New York City’s premier youth development agency. Held at Rockefeller Center, the reception recognized Mr. McCarthy for his many years of service at the helm of Chadbourne's Pro Bono program, and for his outstanding contributions to The Door and the vital legal services it provides to New York City's youth.

As part of the benefit, Mr. McCarthy was presented with an engraved work from the Steuben glass collection by keynote speaker Professor John D. Feerick, former dean of Fordham University School of Law, and founder and director of the Feerick Center for Social Justice and Dispute Resolution at Fordham University School of Law. Phoebe A. Wilkinson, the current Chair of Chadbourne's Pro Bono Committee, and Charles K. O'Neill, Chadbourne's Managing Partner, also accepted a plaque from Christa Stewart, Director of The Door's Legal Services Center, presented to Chadbourne in recognition of the Firm's support of the pro bono legal services provided at The Door.

Mr. O'Neill said, ""Our Pro Bono program has made extraordinary strides under Bernie's management over the past 10 years, for which we cannot thank him enough.""

Mr. McCarthy served as Pro Bono Partner of Chadbourne from February 1999 to June 2006. He was one of the nation's first law firm partners entirely devoted to the management of a law firm pro bono program. He became Chair of the Firm's Pro Bono Committee in July 1996, having served on the committee since the late 1970s. As Chair of the Pro Bono Committee, he presided over its expansion to Chadbourne's overseas offices, welcoming new members from London, Warsaw, Moscow, Kyiv and St. Petersburg. Mr. McCarthy continues as Pro Bono Counsel for Chadbourne.

An experienced litigator, Mr. McCarthy concentrated his practice for many years in the employment law area. In recent years, he also actively assisted young lawyers in trying pro bono cases. Mr. McCarthy is a trained mediator on the panels of the Commercial Division - New York State Supreme Court and Volunteer Lawyers for the Arts. He is also a Fellow of the New York Bar Foundation.

Mr. McCarthy has been an active participant and panelist at the Pro Bono Institute's Annual Law Firm Seminar in Washington, D.C. He is one of the founders of the New York Law Firm Pro Bono Coordinators Group, and has been a featured speaker at law firm operations seminars on pro bono as a means of achieving firm goals of recruitment, integration, mentoring, training, retention, good public relations and business development. In early 2006, Mr. McCarthy was honored by Fordham Law School in an exhibit highlighting Fordham lawyers who have spent their careers involved in pro bono/public service work.

Chadbourne's relationship with The Door began in 1998, when it first offered associates the opportunity to participate in externships at The Door's Legal Services Center on eight- to 12- week full time extern assignments. In 2005, the Firm expanded its commitment to The Door by inaugurating the Chadbourne & Parke Fellowship. This unique program offers outstanding law school graduates the opportunity to spend a year working entirely on pro bono matters at The Door's Legal Services Center, as well as the opportunity to return to Chadbourne at the conclusion of the Fellowship. Ghita Schwarz is now serving as the first Chadbourne & Parke Door Fellow. Prior to receiving the Chadbourne & Parke Door Fellowship, Ms. Schwarz was a senior attorney with Queens Legal Services, working on its education rights project.

The Door serves young people, aged 12-21 years, primarily from low-income and at-risk communities. The Door's Legal Services Center was established in 1992 to address the lack of free civil legal services for youth in New York City. It provides a broad range of legal counsel and advocacy services in many areas, including family law, the rights of youth in foster care, immigration, and access to public benefits.
