Kennedy Covington Continues Advocating for Strategic Economic Development
Kennedy Covington, one of the largest law firms in the Carolinas, continues to demonstrate that it is a forceful advocate for strategic economic development and is committed to providing important pro bono legal services to local communities.

Recently, the firm represented the town of Green Level in a zoning dispute with Alamance County. In July, the N.C. Court of Appeals ruled in favor of the town, giving it jurisdiction over the more than 100 property owners who live in the four square miles surrounding its limits .

"This ruling will help the town plan for its future economic development," says Eric Braun, the lead Kennedy Covington attorney on the matter. Braun's team also included Kennedy Covington attorney Ann Anderson and paralegal Terri Tolley.

The Court of Appeals decision reversed an earlier Alamance County Superior Court decision which allowed the country to keep jurisdiction over the area.

"The Court ruled that towns and counties must have legitimate reasons for zoning ordinances," explains Braun. "Stopping a town from taking action is not a valid reason. Zoning is not a carte-blanche authority."

Kennedy Covington provided its services during the appeal process pro bono. Alamance County has until August 21 to ask for a discretionary review of the ruling from the State Supreme Court. Green Level, located on NC Highway 49 and five minutes from Interstate 40/Interstate 85, has a population of 2,320.

In a previous landmark case, Kennedy Covington provided successful pro bono representation to Washington and Beaufort counties in federal court when they challenged the legality of the U.S. Navy decision to construct an Outlying Landing Field (OLF) within their borders. In February 2005, U.S. District Court Judge Terrence Boyle permanently enjoined the Navy from taking any further activity associated with the project without first complying with its obligations under the National Environmental Policy Act.

The firm also works on behalf of local economic development issues in other ways. For example, its attorneys spent hundreds of volunteer hours to support Amendment One, passed by North Carolina voters in November 2004. Their work included both lobbying in the General Assembly to get the measure on the ballot, as well as efforts for its ultimate approval by voters. Amendment One amends the state constitution to allow cities, towns and counties to issue a new form of debt known as Project Development Financing. This is an important funding tool for such projects as urban redevelopment, industrial relocation and affordable housing.

Firm Represents VMware Board in Company's $957 Million Carve-Out IPO
The Palo Alto office of Simpson Thacher represented the independent board of VMware, a leading virtualization software company, in connection with its recent $957 million carve-out IPO. Virtualization software greatly enhances an enterprise's utilization of its IT resources by, among other things, permitting applications designed for specific operating systems to run on a wide range of servers, regardless of their operating system. In its role, Simpson Thacher has provided advice with respect to corporate governance, employee benefits, intellectual property, tax and securities matters. The initial public offering results in VMware, formerly a wholly owned subsidiary of EMC Corporation, becoming a public company with two classes of shares outstanding. Class A shares, which were sold in the offering, have one vote per share, while the Class B shares retained by EMC, have ten votes per share.

The Palo Alto team includes partners Bill Hinman, Jim Kreissman and Jeff Ostrow, Senior Counsel, Richard Grimm, and associates, Rebecca Boyden, Katherine Moir, Ivan Rothman, and Victoria Stewart.

DLA Piper Recognized as a “2007 Best Law Firm for Women” by Working Mother Magazine and Flex-Time Lawyers
DLA Piper today announced that Working Mother magazine and Flex-Time Lawyers have selected the firm for their first-ever list of Best Law Firms for Women. The firms were recognized for “breaking new ground and helping to create a more balanced environment and culture for the next generation of women lawyers.”

“DLA Piper has been focusing on creating a culture that supports women as they pursue their legal careers,” said Francis B. Burch, joint chief executive officer of DLA Piper. “This important recognition underscores DLA Piper’s commitment to redefining standards of success and creating a workplace environment that encourages the retention and promotion of women.”

The 2007 Best Law Firms for Women list was developed in a partnership between Working Mother magazine and Flex-Time Lawyers LLC in an effort to recognize and celebrate the achievements of law firms that successfully retain and promote outstanding legal talent. The winning firms were distinguished for excellence in six areas of importance: workplace profile, benefits and compensation, parental leave, child care, flexibility, and retention and advancement of women.

Kramer Levin Named One Of The Nation’s Best Law Firms For Women By Working Mother And Flex Time Lawyers
Working Mother magazine and Flex-Time Lawyers LLC have named Kramer Levin Naftalis & Frankel LLP one of the top 50 law firms for women in the nation, and one of ten firms based in New York City. The honor recognizes programs the firm has undertaken to help women strike a better work/life balance while maintaining the same opportunities to rise to partnership. Such programs have included flexible schedules and many women’s initiatives that incorporate networking, education and leadership components.
