13 JW attorneys named "Best Lawyers" in San Antonio

Morrison & Foerster LLP Named 2007 Working Mother and Flex-Time Lawyers ‘Best Law Firm for Women’
Working Mother magazine, the authoritative source for career mothers, and Flex-Time Lawyers LLC, a national consulting firm advising attorneys and legal employers on work-life balance and the retention and advancement of women, have named Morrison & Foerster LLP a 2007 Working Mother & Flex-Time Lawyers Best Law Firm for Women. A new initiative from the leading advocates for work-life balance and women-friendly policies, Best Law Firms for Women honors 50 winning firms for their commitment to the retention and advancement of female talent.

Munsch Hardt Kopf & Harr, P.C. Adds Litigation Associate in Dallas Office
Texas-based Munsch Hardt Kopf & Harr, P.C. (Munsch Hardt), a commercial law firm with offices in Dallas, Houston and Austin, is pleased to announce that William J. Moore has joined the firm’s Dallas office as an associate in the Litigation/Dispute Resolution practice group.

Transfer of Students to Another School District Thwarted
Mark Knoth and Anthony Heckemeyer successfully prevented an attempt to transfer more than 100 students from one school district to another in one of the largest school property transfer cases ever decided in the State of Michigan. The defeated property transfer request represented over 14% of the SEV of the affected school district, and a successful transfer would have had a crippling effect on the school district’s finances. The defeat of the property transfer request by Messrs. Knoth and Heckemeyer came on the heels of their successful defeat of the same property owners’ attempt to obtain a court injunction to prevent the sale of over $70 million in school bonds.

Dan Grove Qualifies for the Kentucky Court Roster of Mediators
Dan Grove, has recently completed the Kentucky Court system’s required course in general mediation and has announced that he is available to mediate disputes locally. Mr. Grove plans to specialize in commercial disputes, family law matters and damage actions at both his Lexington Office and in Maysville.

Jackson Kelly’s Lexington Office, now boasts of three capable mediators and is currently remodeling its Lexington office to accommodate a new mediation center. The practice includes construction and employment disputes, damage and personal injury as well as family law and commercial matters.

To qualify for the Kentucky Court Roster of Mediators, Mr. Grove completed forty hours of training and fifteen hours of mediations. Mr. Grove is one of only two local lawyers who are listed on the Roster.

Mediation is an informal process in which a neutral third party, called a mediator, facilitates the resolution of a dispute. The process is designed to help parties reach their own agreement without the intervention of an outside decision maker. Arbitration on the other hand gives decision-making authority to the arbitrator. Both of these types of alternate dispute resolution are being used more frequently in Kentucky because of crowded court dockets, the rising expense of litigation and the flexibility of result allowed by each.

While practicing in Washington, D.C., before returning to Maysville, Mr. Grove was involved as a trial lawyer in several high profile cases including the Pan Am 103 plane crash in Scotland, the “Abscam” and “Iran-Contra” affairs and a highly publicized law suit concerning the estate of billionaire Jack Kent Cooke, the former owner of the Washington Redskins and Elmendorf Farms.

While in Washington, D.C. Mr. Grove acted as a lawyer, arbitrator or mediator in numerous disputes resolved by both methods. He is of the opinion that “these methods are often the least expensive and most flexible methods of dealing with many disputes”.

Mr. Grove was a dean’s list graduate of The University of Virginia Law School and later Georgetown Law Center where he received a Masters of Law degree as a participant in the E. Barnett Prettyman Fellowship Program where he earned a certificate of proficiency as an advocate in both criminal and civil cases.

After graduation from the University of Virginia, he was the motions law clerk for Chief Judge Clement F. Haynsworth, Jr. of the United States Court of Appears for the Fourth Circuit.

Mr. Grove has been a Fellow of the American College of Trial Lawyers since 1997. He has taught trial advocacy to students at both Georgetown and University of Virginia law schools and to lawyers at the National Institute for Trial Advocacy. He is a graduate of St. Patrick’s High School.

Fitzpatrick Files Successful Daubert Motions in Trademark Infringement Case for Client Condé Nast
Partners Ed Vassallo and Bob Fischer and associate Ralph Dengler filed successful Daubert motions in a trademark infringement case for client Condé Nast.

Judge Keenan recently granted the motions, excluding the testimony of all of plaintiff Kargo's expert witnesses.

Judge Keenan held that the survey conducted by Prof. Jacoby was so flawed that the risk of prejudice far outweighed any probative value. Major flaws included the survey's failure to simulate the real world circumstances, its use of stimuli that did not fairly characterize the products/services at issue, and its use of leading methodology and questions.

Judge Keenan also excluded testimony from the Interbrand damages experts because, without any admissible evidence of confusion, the damages testimony was irrelevant and inadmissible.
