Damon Hart Named One of 15 Up & Coming Lawyers in Massachusetts
Holland & Knight LLP is pleased to announce that Damon Hart, a partner in the firm's Boston office, has been chosen as one of 15 "Up & Coming Lawyers" for 2007 from Massachusetts Lawyers Weekly. According to the publication, this award is given to lawyers in Massachusetts who have been members of the Bar for 10 years or less, but who have already distinguished themselves in the legal profession.

Hart practices in the area of commercial litigation, with particular focus in technology, intellectual property, and labor and employment matters. In addition to his litigation work, he also provides business advice to clients on contract, real estate and development matters. Hart counsels a number of non-profits in their unique business and organizational challenges. In particular, he has represented a number of churches and other religious organizations gaining significant experience in constitutional issues and intra-denominational disputes.

Hart has been recognized by numerous organizations for his leadership, community service and legal accomplishments. He received Boston Magazine's "Super Lawyer Rising Star" award for both 2006 and 2007, and was named one of Boston''s Ten Outstanding Young Leaders by the Boston Jaycees in 2005. He currently serves on the Boston Bar Association's Council and is the president-elect of the Massachusetts Black Lawyer's Association. Hart received his bachelor's degree in political science from The College of Holy Cross, and earned his law degree from Boston College Law School.

Godwin Pappas Announces Public Law Addition
Godwin Pappas Ronquillo, LLP is pleased to announce the addition of Senior Attorney Paul H. Cross. He will practice in the Public Law Section.

Mr. Cross was an in-house attorney with Bell Atlantic-TriCon Leasing Corporation before joining the Firm of Maloney Bean Horn & Hull, P.C. and most recently practiced on his own. He is admitted to practice before all federal and state courts in Texas and Oklahoma as well as the Fifth Circuit Court of Appeals. Paul specializes in commercial litigation with an emphasis on leasing and financing disputes.

Paul received a J.D. from University of Tulsa in 1985, a Master's in Urban Planning from University of Illinois at Urbana-Champaign in 1981 and an B.A.from Illinois College in 1979.

University of Maine School of Law Announces Vincent L. McKusick Fellowship Fund With Initial Endowment from Pierce Atwood LLP
The University of Maine School of Law has created a new endowment fund in honor of Vincent L. McKusick, former Chief Justice of the Maine Supreme Judicial Court, with an initial pledge of $100,000 from Pierce Atwood LLP.

The Vincent L. McKusick Fellowship Fund is designed to provide tuition and other support to incoming law students from socio-economically disadvantaged backgrounds, with the intent of increasing the diversity of the student body at the Maine Law School and within the legal community in Maine. The goal is to award the first McKusick Fellowship in 2009, after further fundraising efforts increase the endowment to a $250,000 threshold. The Fund will be held by the University of Maine School of Law Foundation, which will assist in securing additional support and growing the endowment significantly larger in the coming years.

“We sincerely thank Pierce Atwood for such a generous gift and value this commitment to diversity,” says Peter Pitegoff, dean of the University of Maine School of Law. “We are especially pleased to honor Chief Justice McKusick, who has inspired so many people in Maine and nationally with his dedication to the legal profession and to social justice.”

In 1952, Mr. McKusick began his career at Pierce Atwood LLP after graduating from Bates College and Harvard Law School and serving as a law clerk to Second Circuit Chief Judge Learned Hand and then to U.S. Supreme Court Justice Felix Frankfurter. From 1943 – 1946, he served in the U.S. Army, participating for fourteen months in the Manhattan Project in Los Alamos, New Mexico.

In 1977, Maine Governor Longley appointed Mr. McKusick Chief Justice, the first such appointment directly from the bar since the appointment of Chief Justice Prentiss Mellon in 1820. Following his retirement from the bench in 1992, he rejoined Pierce Atwood LLP, where he continues serving today as Of Counsel. In that time, Chief McKusick has received three special master appointments from the U.S. Supreme Court, handling original jurisdiction cases between states.

During his fourteen-and-one-half years on Maine’s high court, Chief McKusick brought significant improvements in the structure and operation of all courts, many involving volunteer efforts from within the community, such as Maine’s Mediation Program and its Court Appointed Special Advocate (CASA) Program.

“This is a great honor for a great man. Chief McKusick has been a mentor to so many people in the legal profession and now that legacy will continue as students who have historically been disadvantaged in education and the workplace will have a chance to develop a career in the law,” says Bruce Coggeshall, managing partner, Pierce Atwood LLP.

Students who have attended secondary or post-secondary school in Maine will be given preference for the fellowships. The program will reach out to members of Maine’s new immigrant communities and members of Maine’s Native American communities. Fellowship awards will include a part-time paid internship at Pierce Atwood during the recipients’ second academic year at the Law School.

In a June ‘07 article authored by Chief McKusick for The Journal of Appellate Practice and Process, entitled “A Firm Foundation for Life After the Bench,” the Chief describes his great satisfaction in hosting regular lunch meetings with new associates and summer clerks at Pierce Atwood LLP. “It’s obvious that the Chief has a love of the law and the legal profession that he hopes to instill in the newest generation of lawyers. We trust that this fellowship allows him to do just that,” states Pitegoff.

Chief McKusick grew up in Parkman near Dover-Foxcroft, and now resides with his wife Nancy in Cape Elizabeth.

Foley Hoag’s Intellectual Property Group Secures Patent Win for KVH Industries
Foley Hoag LLP recently secured a key patent win for longtime client KVH Industries (Nasdaq: KVHI), a Rhode Island-based provider of in-motion satellite television and communication systems, in addition to navigation and guidance products.

A jury in the U.S. District Court in Minnesota returned a verdict in favor of KVH Industries that KVH was not liable for infringing King Controls' U.S. Patent 6,864,846 involving satellite switching technology because the asserted claim of the patent was invalid over prior art presented by KVH at trial.

The win clears the way for KVH to continue sales of its leading TracVision® line of in-motion satellite television products used around the world on boats, automobiles, recreational vehicles, trucks and buses.

Leading the Foley Hoag trial team in support of KVH were partners Brandon White and Michael Dowd, accompanied by associates Jeremy Younkin and Brian Carroll.

The Bond Buyer Ranks Alston & Bird Third Among Bond Counsel
The Bond Buyer reported that Alston & Bird become the third-ranked bond counsel this year, up more than 10 places from last year. The firm had 13 issues worth $2.14 billion compared to four deals worth $675.8 million last year. The public finance newspaper reported, “the firm was bond counsel on Southeast Alabama Gas's $949.9 million transaction, a $592 million new and refunding deal from Georgia, and a $425 million deal by Gwinnett County School District, among others.”

Thomas & Betts Corporation to Acquire Lamson & Sessions Co.
Davis Polk & Wardwell is advising Thomas & Betts Corporation on its acquisition of The Lamson & Sessions Co. Headquartered in Memphis, Tennessee, Thomas & Betts is a leading manufacturer of electrical components used in construction, industrial and utility markets. Lamson & Sessions is a leading producer of thermoplastic enclosures, fittings, conduit and pipe, and wiring devices for the electrical, telecommunications, consumer, power and waste water markets.

According to the terms of the acquisition agreement, Thomas & Betts will acquire Lamson & Sessions in an all-cash transaction valued at $27.00 per share or approximately $450 million. Subject to the satisfaction of customary closing conditions and the approval of Lamson & Sessions’ shareholders, the transaction is expected to close in late 2007.

The Davis Polk corporate team includes partners Paul R. Kingsley and Michael Davis and associates Scott D. Mitnick and Kevin J. Brogan, all of the New York office. Partner Arthur J. Burke of the Menlo Park office and associate Stephen M. Pepper of the New York office are providing antitrust advice. Counsel Betty Moy Huber and associates Heather Daly and Brianne M. O’Melveny Represents WuXi PharmaTech in $212M IPO
O'Melveny represented WuXi PharmaTech (Cayman) Inc. ("WuXi PharmaTech"), the leading China-based pharmaceutical and biotechnology research and development outsourcing company, in its US$212 million initial public offering on the New York Stock Exchange. Trading began on August 9 under the symbol "WX". The offering consisted of 15,167,326 American Depositary Shares ("ADSs") priced at $14 per ADS, of which 11,978,347 ADSs were offered by WuXi PharmaTech and 3,188,979 ADSs were offered by selling shareholders.

Credit Suisse Securities (USA) LLC and J.P. Morgan Securities Inc. acted as joint book-running managers and Jefferies & Company, Inc. acted as a co-manager for the offering.

The O'Melveny team included partners Kurt Berney; counsels Portia Ku and Jim Hildebrandt; associate Maggie Li; and legal consultant Jiahua Wu. Partner Robert Plesnarski advised on SEC regulatory related matters. Associate Weishi Li provided intellectual property-related advice.
