Gingold Appointed to Health Care Board
Governor Christine Gregoire named Jeff Gingold as a citizen appointment to a newly formed Health Insurance Partnership Board. Gingold's term is effective July 16, 2007, ending July 15, 2010.

The Board will work with the Washington Health Care Authority to implement the state's new Health Insurance Partnership, which will work to increase access to affordable health insurance. The board of directors will develop and approve policies to enroll subscribers, design health plans in the pool, and set premium and contribution levels.

Phillips Lytle LLP Grows Rochester Office Two new attorneys added to practice
Phillips Lytle LLP, one of the region’s largest full service law firms, continues to grow its Rochester office with the addition of Breanne S. Skivington and Richard T. Tucker as Associates with the firm.

Ms. Skivington focuses her practice on commercial and residential real estate, commercial lending and bankruptcy matters. A member of the American, New York State and Monroe County Bar Associations, she received her J.D. from Albany Law School of Union University and her B.A. from The Pennsylvania State University. Ms. Skivington is also active in The Pennsylvania State University Alumni Association, Rochester Chapter. She resides in Spencerport.

Mr. Tucker focuses his practice in litigation matters including, business torts, construction, insurance coverage and premises liability. He received his J.D., magna cum laude, from University at Buffalo Law School – The State University of New York and his B.S., summa cum laude, from Niagara University. Mr. Tucker resides in Honeoye.

Hoeffner and Devlin Explain Independent Examiner Role
Timothy E. Hoeffner, Partner, Vice Chair of the Litigation Department and Co-Chair of the Corporate Governance Practice Group, and Cathleen M. Devlin, a Partner in the Litigation Department and member of the Firm's Corporate Governance Practice Group, are quoted extensively in this front-page news article in The Legal Intelligencer about independent examiners and their value in facilitating internal investigations in anticipation of or in the wake of SEC investigations, both in the subprime lending arena and otherwise across corporate America.

Mr. Hoeffner and Ms. Devlin served as counsel to the independent examiner of Time Warner Inc. in an SEC-mandated investigation of accounting for advertising revenues, which resulted in the restatement of nearly $600 million in revenues by the company dating back to 2000.

Holland & Hart Attorneys Named Leaders In Mining
Holland & Hart LLP attorneys Robert Basset, Robert Connery, Jack Palma, and Paul Schlauch were named leading attorneys in mining by The International Who's Who of Business Lawyers.

The attorneys selected for this honor were nominated by their peers as the world's leading practitioners in mining law. Only 56 mining attorneys worldwide are included in this year's publication.

Bassett is an attorney in Holland & Hart's Denver Tech Center office. The publication states that he is "internationally renowned for the quality of his work." He is a Committee Chairman for the Rocky Mountain Mineral Law Foundation and is an adjunct professor at the University of Denver teaching international mining law.

Connery is an attorney in the Denver office who has practiced environmental law for 41 years. His practice includes environmental planning, permitting, and compliance work on major industrial and mining projects as well as environmental litigation. He was also recognized by the publication for his work with environmental issues.

Palma, a partner in the firm's Cheyenne office, has more than 25 years experience in natural resource and environmental law, including extensive work in federal and state public land law, NEPA, environmental regulatory compliance and permitting, oil and gas, minerals, and water.

Schlauch is a partner in the Denver Tech Center office and has more than 30 years experience in legal issues relating to the mining industry. Who's Who has named him "Mining Lawyer of the Year" for three consecutive years, having won the award every year since its inception. Who's Who Editor in chief Callum Campbell says, "Paul Schlauch's continuing success demonstrates a consistent and unparalleled level of performance and service to clients. We have no hesitation in declaring him the leading lawyer for mining expertise."

Foley Expands Intellectual Property Litigation Practice With Addition of John T. Gutkoski
Foley & Lardner LLP announced today that John T. Gutkoski has joined its Boston office as a partner and a member of the Intellectual Property Department and the IP Litigation Practice.

“John's addition is the next step in the firm's strategic plan to strengthen and grow our IP Litigation Practice, both in the Northeast and nationally,” said Sharon R. Barner, chair of the firm's Intellectual Property Department. “His depth of experience in patent infringement cases will be a great resource to the firm's technology clients throughout the country.”

Gutkoski joins the firm after spending four years at Day Pitney LLP, formerly Day, Berry & Howard LLP, where he focused his practice in patent litigation. He has represented companies in national and international patent infringement and technology disputes involving lasers and optics, pharmaceuticals, electronic circuits, sound waves, semiconductor design and manufacturing, telecommunications and mechanical engineering.

Gutkoski's intellectual property trial practice has included several first impression issues. In particular, he obtained the first decision supporting the validity and enforceability of “shrink-wrap,” “click-on,” and “web-wrap” licenses, contracts and warranties for protecting software and electronic data. In the patent arena, his notable trials have included a Section 337 investigation involving seven photolithography patents on which his clients prevailed on all asserted claims.

Prior to joining Day Pitney, Gutkoski practiced patent litigation at Hale and Dorr LLP. He also served as a Special Assistant District Attorney for the Commonwealth of Massachusetts, Middlesex County, during which he tried a dozen criminal matters.

Foley's patent litigation practice is consistently recognized as a top 10 practice by intellectual property trade publications, including IP Law & Business, IP Law360 and Managing Intellectual Property.

Quarles & Brady Attorney Jane Appleby Appointed To State Bar's Committee On Professional Ethics
Quarles & Brady LLP today announced that Jane Appleby has been appointed to a three-year term on the State Bar of Wisconsin Committee on Professional Ethics. As a member of the committee, Appleby will be involved with helping to formulate and recommend methods for maintaining high ethical standards in the practice of law. In additon, the committee also issues formal opinions to guide the ethical conduct of Wisconsin lawyers.

Jack Gerstein, Chuck Hadden, Ed Mullen, Bob Heggestad, and Jonathan Cohen received recognition as attorneys for the defendants in Congoleum v. ACE American Insurance, et al. in a “Big Suits” profile appearing in the August 2007 issue of American Lawyer. Finding on behalf of the defendants in this case, the New Jersey state court judge absolved Congoleum’s insurers for any coverage liability for the purported $500 million in liability asserted against them under the agreement. This victory signals the beginning of the end for collusive prepackaged asbestos bankruptcies
