Jill Jackson and Alice Stubbs Newly Certified Family Law Specialists
The Board of Legal Specialization was established by the North Carolina State Bar to create a method by which qualified North Carolina lawyers might become certified as specialists in designated areas of the law. The legal certification program in North Carolina is one of only 18 state legal certification programs in the United States.

The legal specialization program identifies to the public those lawyers who have demonstrated special knowledge, skill, and proficiency in a specific field. To be certified as a specialist, a lawyer must meet the following requirements:

1. Be an active member in good standing with the North Carolina State Bar for at least five years.
2. Devote at least 25% of his or her practice to the specialty during the past five years (substantial involvement).
3. Attend continuing legal education (CLE) seminars in the specialty.
4. Be favorably evaluated by other lawyers and judges (peer review).
5. Pass a written examination in the specialty practice area.

Ms. Stubbs and Ms. Jackson join the ranks of three other family lawyers at Tharrington Smith who are Board-certified family law specialists: Carlyn G. Poole, Jaye Meyer, and Lynn P. Burleson.

MCDONALD HOPKINS’ WEST PALM BEACH OFFICE MOVES TO NEW LOCATION
The West Palm Beach, Fla., office of McDonald Hopkins Co., PA, a Cleveland-based, full-service business law firm, has moved to a new, larger office location in the Flagler Center Tower on South Flagler Drive. Since its establishment in 2004, the West Palm Beach office has undergone substantial growth, both laterally and organically. Over the past two years, the office has doubled in size, now consisting of nine attorneys and a 10- member administrative staff. Increasing from 6,552 square feet in the previous office location to 11,000 square feet in the Flagler Center Tower, the new office will accommodate all of the current attorneys, paralegals and administrative staff, while providing room for continued growth and expansion.

“This new location allows us to take the next steps in growing McDonald Hopkins’ presence in the greater Palm Beach market,” said John Metzger, Managing Shareholder of the West Palm Beach office. “Since we now occupy the entire third floor of the Flagler Center Tower, we have the space to strengthen our office by bringing in additional attorneys to help us provide expanded legal business services to our clients, in addition to our current Commercial Real Estate and Litigation practices.”

The West Palm Beach office is the third McDonald Hopkins office undergoing expansion and renovation. In October, the headquarters in Cleveland unveiled its newly expanded and renovated office, and in early 2007 the Detroit, Mich., office will be moving into a larger space as well. McDonald Hopkins President Joseph J. LoPresti views these expansions as an opportunity to provide enhanced services to the firm’s clients.

“These expansions represent our ongoing commitment to serving middle-market and Fortune 500 clients,” LoPresti said. “We’re very proud of what we’ve accomplished these past few years, and as we expand our offices, we are now better positioned to bring additional value to all our clients and facilitate further growth.

Three McCarthy Tétrault Partners in Top 40 Lawyers Under 40
McCarthy Tétrault is proud to have three of its lawyers in Lexpert magazine’s Top 40 Lawyers Under 40. They were selected from 85 finalists and announced last night at a dinner and awards ceremony in Toronto that honoured the rising stars in the Canadian legal profession. The results are based on lawyers’ rankings in the Canadian Legal Lexpert Directory, combined with survey responses by thousands of practitioners and in-house counsel.

The three Top 40 Lawyers Under 40 from McCarthy Tétrault LLP are:

Philippe H. Bélanger, a partner in our Bankruptcy and Restructuring Group in Montréal, whose practice focuses on bankruptcy, insolvency, commercial litigation and banking law. He was admitted to the Québec bar in 1989.

Stephen Furlan, a partner in our Financial Services Group in Toronto, whose practice focuses on secured lending and project finance. He was called to the Ontario bar in 1994.

W. Ian Palm, a Business Law partner in Toronto and co-leader of the firm’s Private Equity Group. He is also a member of the firm’s Technology Group. His practice focuses on private equity, corporate finance, mergers and acquisitions, and technology-related commercial matters. Ian was called to the Ontario bar in 1995.

Business Law Group partner Thomas Isaac (Vancouver and Calgary) is a nationally recognized authority in the area of aboriginal law, advising clients across Canada on aboriginal law matters and related environmental assessment, government regulations and constitutional issues. Charles Morgan is a partner in the Business Law Group in Montreal and a member of the firm’s Technology Group. In his corporate/commercial practice, he focuses on tech M&A, outsourcing, licensing, e-commerce, data protection and telecommunications.

David Herr Elected President-Elect of the Academy of Court-Appointed Masters
The law firm of Maslon Edelman Borman & Brand, LLP, is pleased to announce the recent election of David Herr as President-Elect of the Academy of Court-Appointed Masters.

The Academy is a national organization of lawyers who have been appointed Special Master by courts to assist in resolution of complex litigation. Herr has served in that role in a number of complex class action cases, including matters in the antitrust, consumer, and insurance areas, and dealing with management of discovery, class notice and settlement procedures, and ruling in trial
exhibits and testimony.

David Herr currently heads Maslon’s Appellate Practice Team. A highly regarded appellate lawyer and complex case litigator, Mr. Herr is frequently sought out to provide practical and sophisticated advice on how to resolve difficult, multi-party disputes in trial courts and arbitral forums, as well as in the appellate courts. David is past President of the American Academy of Appellate Lawyers, and regularly argues cases in the Minnesota and federal appellate courts. He annotates the Federal Judicial Center’s Manual for Complex Litigation published and distributed nationally by Thomson West.

Wyrick Robbins Attorneys reach $1.18M Settlement in Mold Exposure Suit
Wyrick Robbins attorneys, Benjamin N. Thompson, Grady L. Shields and Lee M. Whitman reached a $1.18 Million Settlement in a suit brought against a contractor for negligent construction and personal injuries caused by exposure to toxic mold.

The plaintiff owned a car dealership in Moore County. Following renovations by a contractor, the dealership suffered numerous leaks which led to the growth of mold in the exterior walls, under the carpet, in the drywall, and around the windows of the plaintiff’s office. Once the plaintiff had begun working in the newly renovated building, he began to suffer from severe allergy symptoms, coughing, breathing difficulties, and headaches. The plaintiff attempted to get the contractor to fix the leaks, but repeated visits and repairs by the builder did not solve the problem. The mold was not discovered until three years after the construction was completed when, at a doctor’s suggestion, the plaintiff requested that the contractor drill a hole in the wall and check for mold. By that time, the plaintiff’s health had deteriorated. He was eventually diagnosed with hypersensitivity pneumonitis, chronic asthma, mild cognitive impairment, and neurological deficits. He suffered further problems due to the long-term use of steroids to mitigate his breathing difficulties. The case was settled for $180,000 in repairs and new construction at the car dealership and $1,000,000 cash.

Stephen P. Epstein chaired a New York State Bar Association Continuing Legal Education Seminar at the Hyatt Regency Wind Watch in Hauppauge, New York. The topic of the seminar was Forming & Advising Businesses. Firm partners Igor "Bud" Bilewich and Robert J. Londin also spoke at the seminar.

National Workplace Law Firm Opens Newport Beach Office Employment Class Action Concerns Prompt Orange County Business
In response to a burgeoning local economy and a sharp increase in the number of clients, Orange County is the newest office for national workplace law powerhouse Jackson Lewis, LLP. The new location is the firm's 27 th office and is located at 5000 Birch Street, Suite 4800, in Newport Beach.

Jackson Lewis, which represents management exclusively, will provide Orange County businesses with solutions to any and all developments in California employment law. Of specific interest to local businesses will be insight and analysis on California wage and hour compliance, as well as immigration, harassment, discrimination and ERISA issues.

The new office will be staffed by five attorneys from the firm's Los Angeles office. Frank Liberatore, a management side employment litigator with 20 years of experience, will be the managing partner of the new office. Liberatore has defended companies facing wrongful termination, breach of contract, discrimination and harassment cases. He will be joined by Jackson Lewis partner Jonathan Siegel, a traditional labor lawyer with expertise in California wage and hour issues.

"We are excited about the opportunity to bring our very special style of practice to the Orange County market," said Patrick L. Vaccaro, the firm's Managing Partner. "And we are especially pleased to have someone of Frank's talent and integrity to help lead us. We expect great things from Frank and our Orange County team."

"Since 2000, the amount of work for our Orange County clients has increased significantly," said Liberatore. "A number of Jackson Lewis clients have headquarters in the County or have significant operations here. The need for us to expand is evident.
