Attorney Gregory Yadley Named Chair of Tampa Bay Convention and Visitor's Bureau's Board of Directors
Shumaker, Loop & Kendrick is pleased to announce that Gregory C. Yadley, Partner in the Tampa Office, has been installed as the Chair of the Tampa Bay Convention and Visitor’s Bureau’s Board of Directors.

Mr. Yadley is a member of the Florida Bar and District of Columbia Bar Associations. He is a member of the American Bar Association where he has had leadership roles in the Small Business and Federal Regulation of Securities Committees and is Chair of the Subcommittee on Small Business Issuers and Co-Chair of the Task Force on Private Placement Broker Deals. In addition, Mr. Yadley is an adjunct professor for the inaugural “Business Documents Drafting” course at the University of Florida Law School during the Fall Semester.

Chair of the Corporate Practice Group of Shumaker, Loop & Kendrick in Tampa, Mr. Yadley also serves as Chairman of the Hillsborough County Arts Council and as a member of the Board of Directors and Executive Committee of The Florida Orchestra. He has served as Chairman of the Hillsborough County Arts Council, the Greater Tampa Chamber of Commerce, Leadership Tampa Alumni, City of Tampa Public Art Committee, Tampa Bay Business Committee for the Arts, Inc., and the Dartmouth Club of Tampa Bay.

BNA Quotes MBJ Partner on the Impact of the U.S. Supreme Court’s Burlington Northern v. White Decision
Daily Labor Report extensively quoted MBJ partner Michael Clarkson regarding the implications of the United States Supreme Court’s recent decision in Burlington Northern & Santa Fe Railway Co. v. White, 126 S.Ct. 2405 (2006) regarding the standard for actionable retaliation under Title VII of the 1964 Civil Rights Act. In Burlington Northern the Court held that actionable retaliatory activity under Title VII must only be “materially adverse to a reasonable employee” and “harmful to the point that [it] could well dissuade a reasonable worker from making or supporting a charge of discrimination.” Under the Court’s analysis, workers bringing retaliation claims are entitled to greater protection than workers bringing substantive discrimination claims. This may make it more difficult for employers to obtain summary judgment on retaliation claims and places a greater emphasis on supervisor training, employee handbooks and internal complaint procedures.

MBHB earns $70 million settlement for Pfizer in Idarubicin litigation
Pfizer announced today that it has reached a comprehensive agreement with generic drug manufacturer Teva that resolves two separate lawsuits alleging patent infringement of Pfizer's cancer medication, Idamycin, and its antibiotic, Zithromax. As part of the settlement, Teva will pay up to $70 million to Pfizer, which includes an option in 2007 for Teva to sell its own generic version of epirubicin, another cancer medication, prior to the August 2007 patent expiry. In addition, Teva will not contest the validity of the patents.

The agreement will end litigation by Pfizer against Teva and Sicor, a company owned by Teva, over Sicor's sales of idarubicin (the active ingredient in Idamycin) and Teva's sale of azithromycin (the active ingredient in Zithromax). Under the agreement Sicor will be able to continue to market idarubicin, which it launched prior to patent expiry in September 2002, and Teva can continue to sell its generic version of Zithromax.

Kirby Chown, McCarthy Tétrault’s Ontario Regional Managing Partner, selected as one of Canada’s Top 100 Most Powerful Women
Kirby Chown, Ontario Regional Managing Partner for McCarthy Tétrault, is one of Canada’s Most Powerful Women: Top 100™ for 2006 in the "Professionals" category, as selected by the Women’s Executive Network. The WXN Top 100 Awards is a symbol of the success women have attained and represents a unique array of proven achievers from many walks of life. Ms. Chown joined McCarthy Tétrault upon being called to the Ontario bar in 1981 and practises civil litigation, including medical malpractice.

"Kirby’s contributions to McCarthy Tétrault and to the advancement of women lawyers—both in the firm and the profession at large—have been tremendous," said Iain Scott, Chair and CEO of McCarthy Tétrault. "She has given her time, her considerable energy and the whole of her expertise to countless women’s initiatives, both professionally and personally. We are very proud of her accomplishments and credit Women’s Executive Network for recognizing her significant talents."

"Nurturing the development of a professional career is a delicate thing," said Ms. Chown. "Women lawyers face particular challenges in advancing in their legal careers. I benefited immensely from mentoring by senior male colleagues at McCarthys. This inspired me to develop programmes that would offer such assistance more broadly to women at my firm and in the profession."

Ms. Chown chairs McCarthy Tétrault’s Diversity Task Force and also chairs The Women’s Committee, which focuses on women’s issues across the firm. In 2004, she created the Women’s Initiatives Network (WIN) in the firm’s Toronto office to promote discussion of topics of professional or exclusive interest to women. The network has seven active subcommittees and holds regular meetings, as well as sponsoring business development and other events related to women. The network provides support to women lawyers on maternity leave and flex-time arrangements. It also initiated mentoring circles for women lawyers in 2005.

Ms. Chown was selected in 2005 by the Faculty of Law at the University of Toronto as one of 20 prominent women graduates from the Faculty to be honoured in a permanent installation at the school.

Cooley Attorney Kristine Pirnia Honored as Pro Bono Attorney of the Year by Capital Area Immigrants’ Rights Coalition
Kristine Pirnia, an associate in Cooley Godward Kronish LLP’s Washington DC office, was honored by the Capital Area Immigrants’ Rights (CAIR) Coalition as the organization’s Pro Bono Attorney of the Year.

"Kristine's representation of our most difficult cases has been fearless and extraordinary; she is very good and thorough. Her enthusiasm has encouraged several other Cooley attorneys from her office to take on our pro bono cases as well," said Elizabeth H. McGrail, Detention Project Director, CAIR Coalition.

Part of the International Trade practice group, Ms. Pirnia advises U.S. and foreign companies on complying with the U.S. laws and regulations that govern the cross-border movement of goods, software, technology and services. Her practice also encompasses compliance with the Foreign Corrupt Practices Act.

Ms. Pirnia has been a legal advocate for the use of Pro Bono in the area of immigration and human rights for some time. In addition to being a member of the Firm’s Washington, DC office Pro Bono Committee, she has been an adjunct professor of law at George Washington University Law School where she has taught a course on international human rights for the past two years. Ms. Pirnia earned a BA from the University of Texas (Austin) and a JD from the Georgetown University Law Center.
