Firm Attorneys and Staff Pledge More than $114,000 to Kansas City United Way Campaign
The Kansas City and Corporate Woods offices of Stinson Morrison Hecker LLP recently made pledges and contributions totaling more than $114,000 for the local United Way Campaign. This surpassed the firm’s goal of $100,000 and in turn increased participation by 23% from last year.

“Our attorneys and staff have shown their generosity and community spirit by supporting the United Way, which serves an invaluable role in our community,” Mark Foster, Kansas City firm managing partner, said. “Giving back to the community is a key belief at the firm, and our attorneys and staff continually support our civic-minded initiatives.”

The firm kicked off its internal fundraising campaign with a breakfast that featured a presentation about the United Way and how it helps area agencies. To encourage pledges, the firm held a competition between floors and awarded a pizza party to the floor with the highest level of participation. The campaign ended with a Halloween lunch and costume contest, where gift certificates to area hotels, restaurants, retailers were awarded.

Stinson Morrison Hecker’s pledges contributed to the more than $38.5 million raised during the annual Kansas City United Way campaign. The money will help support nearly 150 health and human service nonprofit agencies that make up the safety net for the greater Kansas City area.

Stephani Hildebrandt Joins Financial Services Team
Financial services, corporate, and securities attorney Stephani M. Hildebrandt has joined Nelson Mullins Riley & Scarborough LLP in Washington, D.C., as an associate.

Ms. Hildebrandt practices in the areas of financial services, mergers and acquisitions, and corporate and securities law. She counsels clients on a wide range of corporate and securities matters, including public and private securities offerings, mergers and acquisitions, regulatory reporting compliance and corporate governance matters. She regularly practices before the U.S. Securities and Exchange Commission and the federal bank regulatory agencies, including the Office of Comptroller of the Currency, the Office of Thrift Supervision, and the Federal Deposit Insurance Corp.

Before joining Nelson Mullins, Ms. Hildebrandt worked in law firms in both Washington, D.C., and Boston.

Ms. Hildebrandt is a member of the Bars of the District of Columbia and the Commonwealth of Massachusetts. She also serves as president of the Suffolk University Alumni Association's Law School Metropolitan D.C. Chapter and is a member of the University of Wisconsin Alumni Association.

Milbank Secures Trial Victory for Tennenbaum Capital Partners LLC
In an adversary proceeding arising from the bankruptcy case of Radnor Holdings Corporation, the international law firm Milbank, Tweed, Hadley & McCloy LLP announced today that the firm won a trial on behalf of the defendant Tennenbaum Capital Partners, LLC.

Commenting on the decision Milbank of counsel Kenneth Ostrow noted, “This case highlights the difficulty of achieving the best possible outcome for all of the parties involved in a Chapter 11 bankruptcy proceeding. The divergent interests of the parties involved make a workout inherently complex. The outcome of this trial is a complete vindication for Tennenbaum Capital Partners, proving their actions were legal and made in good faith.”

Milbank represented Tennenbaum Capital Partners, LLC and one of its individual partners, José Feliciano (collectively “TCP”). The Milbank trial team was led by Los Angeles-based Of Counsel Kenneth Ostrow with Los Angeles associates Fred Neufeld and Derrick Talerico and Washington, DC associate Donna Mulvihill. The bankruptcy case itself was headed by Los Angeles-based partner Greg Bray, who provided strategic advice throughout the trial.

New Government Proposal for UK Carbon Emissions Trading Scheme
The Government's widely commented upon Energy Review, published in July 2006, put carbon emissions reductions at the heart of UK energy policy. This has been followed by a flurry of activity in the field of climate change policy and law - not least with the recent publication of the Stern Report on the Economics of Climate Change.

As part of this process, the Government this month launched a consultation exercise on measures to reduce carbon emissions in large non-energy intensive businesses and the public sector. One of the measures proposed in this consultation is the establishment of a new compulsory UK emissions trading scheme known as the Energy Performance Commitment ("EPC"). According to the Government, this would cover some 5,000 organisations in the UK (including large retailers, rail operators, hotel chains, multiplex cinemas, large-office based organisations, light industry and mobile phone operators) with electricity bills over £250,000 p.a.

The EPC would be an auction-based "cap-and-trade" programme in which participants would be required to purchase allowances corresponding to their anticipated emissions relating to energy use. Compliance would be achieved either by energy efficiency measures or purchasing allowances on the open market. The revenue raised by the auction would be recycled to participants in the scheme but this would not necessarily be equal to their initial contribution. The EPC would aim to avoid double-regulation, although it seems that some businesses are already covered by the EU's Emission Trading Scheme and climate change agreements might be caught by the EPC.

The timescale for implementing the EPC (if and when it becomes law) is unclear at this stage. Further details may be available following the close of the consultation phase at the end of January 2007.

King & Spalding's Rebecca Kaufman Elected Chair of Southeast BIO
Southeast BIO (SEBIO) has elected Rebecca J. Kaufman, an intellectual property counsel at King & Spalding in Atlanta, as its chair for 2006-2007.

"SEBIO is entering a phase of real growth as an organization, and I'm excited to oversee that as the incoming chair," Kaufman said. "SEBIO has always been about supporting the growth of the life sciences industry in the Southeast. With the launch of several new initiatives this year, SEBIO will heighten national recognition of the Southeast as a center for the life sciences industry."

Today, the Southeast is recognized as one of the fastest growing life sciences regions in the nation and home to more than 220 life sciences companies. A public/private partnership formed in 1999, SEBIO is committed to conducting activities that create regional leverage and facilitate the common interests and goals of constituents in the life sciences industry. SEBIO operates in Alabama, Florida, Georgia, North Carolina, South Carolina, Tennessee and Virginia.
