Dorsey & Whitney Names Two New Partners in Seattle
Global law firm Dorsey & Whitney LLP today announced that it has named two new partners in the firm’s Seattle office, effective January 1, 2007.

The newly elected Seattle partners:

Brian W. Grimm, 32, Trial, assists clients in resolving business disputes through negotiation, arbitration and litigation. Grimm earned his J.D. degree from the University of Michigan Law School.

Christopher L. Doerksen, 32, Corporate, helps clients with corporate financings, SEC compliance, and mergers and acquisitions, with a focus on international transactions. Doerksen earned his J.D. degree from Stanford Law School.

“During many years of hard work and continual growth in their respective areas of law, Brian and Chris have devoted themselves to our clients’ success,” said Bryce L. Global law firm Dorsey & Whitney LLP today announced that it has named two new partners in the firm’s Denver office, effective January 1, 2007.

The newly elected Denver partners:

Gregory P. Durbin, 38, Patent, works with clients in all aspects of patent law, including strategic patent counseling, preparing and filing patent applications, and enforcing patent rights through litigation and licensing. Durbin earned his J.D. degree from the Franklin Pierce Law Center, and a Bachelor of Science in Electrical Engineering from the University of Michigan.

S. Craig Hemenway, 35, Patent, counsels clients to identify, protect and manage intellectual property assets, enforce and license intellectual property, and prepare and prosecute patent applications. Hemenway earned his J.D. degree from the University of Georgia School of Law, and his Bachelor of Science in Electrical Engineering from Rensselaer Polytechnic Institute.

Labor Attorney Mark Neuberger Quoted on Labor Unions and the Newly-Elected Congress
Attorney Mark J. Neuberger was quoted in the November 17, 2006, issue of the South Florida Business Journal in an article titled "Unions expect help from Congress on organizing." Neuberger is a shareholder with Buchanan Ingersoll & Rooney PC, and heads the firm's South Florida Labor and Employment Law Group.

The article discusses the recent shift of power in Congress to Democrats, and how labor unions hope to benefit from that shift. Unions plan to push legislation that would, among other things, make it easier to organize workers. The AFL-CIO is promoting a bill that would force employers to recognize a union if a majority of workers signed cards favoring representation.

Neuberger noted that Florida is one of the least unionized states in the nation, with about 7 percent of the private sector workforce in unions. However, he pointed to recent organizing activities by the Service Employee International Union as examples of activity.

"Since the private sector in South Florida has a low rate of unionization, I think private-sector employers need to realize that this [legislation] would bring renewed emphasis on organizing by unions," Neuberger told the Business Journal. He added that the current win rate in union organizing campaigns is about 50 percent, with unions holding the view that management has advantages. However, if the legislation were signed into law, managers would be in the position of having to recognize a union once a majority of workers signed the cards, he said.

Bankruptcy Attorney William Schorling Quoted on US Airways' Bid to Acquire Delta Air Lines
Attorney William H. Schorling was quoted in the November 19, 2006, issue of the Pittsburgh Tribune-Review in an article titled "US Airways turns to Delta's creditors." Schorling is a shareholder in Buchanan Ingersoll & Rooney's Philadelphia and Pittsburgh offices, where he serves on the Executive Committee of the Bankruptcy & Creditors' Rights Group.

The article discusses US Airways' unsolicited offer to acquire Delta Air Lines for $8.6 billion, as well as Delta's resistance to that offer. In 2005, Delta filed a Chapter 11 petition to reorganize in federal court. US Airways is appealing to the bankrupt carrier's creditors, hoping to pressure Delta's management to reconsider its offer.

Commenting on the possibility of an acquisition, Schorling told the Tribune-Review, "Whether creditors will want this bid will depend on them believing it has a substantial likelihood of going forward. Otherwise, they might just think it's just a competitor trying to destabilize Delta.

Francis Inducted into American Board of Trial Advocates
Houston partner Paul Francis was recently inducted into the Houston Chapter of the American Board of Trial Advocates, a prestigious national association of trial attorneys and judges which focuses on the preservation of the right to trial by jury.

Membership is by invitation and peer election only to attorneys who have at least 12 years of active experience as trial lawyers and who have tried a minimum of 10 first chair jury trials through a verdict and earned significant other qualifying points as second chair or in jury trials that did not go to verdict.

Francis was also recently a panelist on "The Knife Cuts Both Ways: Expert Challenges in Commercial Litigation Including Ethical Considerations" at a Texas Association of Defense Counsel sponsored seminar, "Current Law Governing the Use of Experts in Personal Injury and Commercial Litigation." The program discussed practical aspects of moving to disqualify and defending expert witnesses in commercial lawsuits.

Lynn Burleson receives President's Award
Tharrington Smith family law attorney, Lynn P. Burleson, was recently honored by the American Academy of Matrimonial Lawyers at their annual meeting in Chicago, Illinois, with a special President's Award for his work in developing the AAML Model Family Law Arbitration Act and for his "...efforts in forwarding the goals of the Academy." He was also appointed by the North Carolina Chapter to serve a one-year term as Chapter Delegate to the national Board of Governors.

Donaldson to speak at Fraud Awareness Symposium
Plunkett & Cooney, P.C. attorney Lawrence R. Donaldson will be among the featured speakers at the Michigan Association of CPA’s (MACPA) Fraud Awareness Symposium on Nov. 30 at the Hilton Detroit/Troy Hotel located in Troy.

A senior shareholder in the firm’s Mt. Clemens office, Donaldson will focus his remarks on accountant liability stemming from situations when a client’s employee commits fraud. He will provide a profile of fraud related claims, including the types of businesses typically involved, common errors on the part of accountants and steps accountants can take to avoid liability.

“This is a particularly interesting area of my practice, because there are so many things accountants can do from a preventative perspective to mitigate or even avoid liability,” said Donaldson, who has more than 25 years of experience dealing with fraud related malpractice claims. “In today’s litigious society, accountants need to practice defensively to make sure they are insulated from liability.”

Co-sponsored by Plunkett & Cooney and Cendrowski Corporate Advisors, the Fraud Awareness Symposium begins with registration at 7:30 a.m. A series of panel discussions will provide attendees with an overview of significant fraud cases and trends, describe investigative priorities and resources and explore fraud deterrence implementation.

The Fraud Awareness Symposium will feature local and national fraud deterrence experts from the corporate, legal, accounting and government sectors. U.S. Congressman Joe Knollenberg will conclude the half-day presentation with a corporate governance and legislative update.
