Fulbright Attorneys Assist With Young Immigrant’s Thanksgiving Wish
A young Honduran immigrant’s Thanksgiving became more symbolic last week when Fulbright & Jaworski L.L.P. attorneys secured his status as a legal resident - allowing him to apply for a Green Card.

On Nov. 16, an immigration judge granted a motion to change Jose Antonio Membreno-Perez’s status to that of a legal resident.

Earlier this year, as Jose’s 18th birthday approached, a team of Fulbright attorneys filed a request for Jose to be granted Special Immigrant Juvenile Status because both of his parents had passed away and if he were returned to Honduras, he would have been left homeless.

“Jose is a mild-mannered, soft-spoken 18-year-old, who lost both of his parents by the time he was 16,” said former Fulbright senior associate Kelli Chism Jones, who assisted with Jose’s case. “Following his mother’s death, Jose resorted to living with friends for a short period, but ultimately ended up on the streets.”

When Jose learned he had been granted status as a legal resident, he looked to his legal team and asked if one day he “could go see New York?”

“Jose wants only what we as Americans already have,” Jones said. “This process has taught Jose respect for following the legal avenues in pursuit of a better life. And it reminds me personally of how thankful I am to be an American.”

In the summer of 2005, Jose and his sister decided to head to the United States. The pair traveled by train and foot until they got to Mexico City, where Jose’s sister decided to stay. Jose pressed on, eventually making it across the Rio Grande.

However, it wasn’t long before Jose was taken into custody. He spent a number of months in a detention center for illegal immigrants. Then, earlier this year, he was released to the custody of a Houston relative.

“Jose now attends a local Houston high school and is working to earn his diploma,” said Fulbright associate Audrey Cumming, who also assisted with Jose’s case. “He is a true example of how the legal assistance young immigrant and refugee children receive can completely alter the course of their lives.”

Fulbright attorneys learned of Jose’s case as part of a pro bono initiative the firm launched last year. The effort assists immigrant and refugee children who enter the U.S. alone and then attempt to negotiate the immigration courts without representation.

Some of these children have fled because of religious or social persecution, war, or because they are the victims of crime or abuse. They often have no legal representation in their immigrant proceedings here.

“We’ve worked hard at Fulbright to make significant in-roads to provide representation and other legal assistance to deserving unaccompanied immigrant and refugee children,” said Fulbright partner John Sullivan, who leads the firm’s effort to assist immigrant and refugee children.

As a result, this Thanksgiving for Jose symbolizes the start of a new life. Attorneys at Fulbright plan to assist Jose in applying for his Green Card in the coming weeks.

“Jose can now begin to plan his future, become more independent and no longer worry about how he would survive if returned to the streets of Honduras,” Cumming said. “What Jose’s gone through touches us all, especially at a time of year when we think about the things for which we are thankful. We’re thankful we were able to help Jose achieve his new status as a legal resident.

Fulbright Warns: Beware of the True Cost of Cheap Knock-offs
From aluminum foil to shampoo, a team of Fulbright & Jaworski L.L.P. attorneys led by Partner Mark Mutterperl have helped U.S. companies protect their trademarked wares from counterfeiters looking to make a quick buck off illegal knock-offs.

Everything from make-up to auto parts to pharmaceuticals have been counterfeit. And that knock-off designer handbag or watch – just like other counterfeit products – could be linked to organized crime and terrorism, explains Mutterperl, who says counterfeiting is a growing problem worldwide.

As the holiday shopping season gets under way, Mutterperl warns consumers should be vigilant about what they buy.

Mutterperl, a former senior attorney with the U.S. Department of Justice, leads a team of Fulbright lawyers known for their tenacious representation of some of America’s largest companies. Mutterperl is nearly midway through his two-year term as the chairman of the International Trademark Association’s North America Subcommittee for Anti-Counterfeiting & Enforcement.

“Counterfeiting threatens consumer safety,” Mutterperl said. “Among the most dangerous forms of counterfeiting are counterfeit drugs, including AIDS medications and birth control pills. Counterfeit products cost businesses billions of dollars each year – often resulting in an additional cost to consumers for the real thing. It’s in everyone’s best interest to protect trademarked products.”

Companies wishing to successfully protect trademarks have long turned to Fulbright when it comes to trademark matters – especially the enforcement of trademark rights against trademark infringement, dilution and counterfeiting.

Attorneys at Fulbright have experience handling investigations and litigation involving counterfeits of two of the world’s best-selling shampoos, highly-regarded skin care products and one of the leading brands of aluminum foil.
