Lynne Anne Anderson - Women Lawyers Association Recasts Itself and Its Mission
Lynne Anne Anderson, a Member of the Firm and Co-Chair of the Sills Cummis Epstein & Gross Women’s Group, was mentioned in the November 27, 2006 New Jersey Law Journal article titled “Women Lawyers Association Recasts Itself and Its Mission.” The article discusses the revitalization of the Women Lawyers Association and its new board. Ms. Anderson serves as the Group’s Co-Director of Public Policy.

Rumberger, Kirk & Caldwell Partner Suzanne A. Singer Wins Case For International House Of Pancakes
Suzanne A. Singer, a partner with Rumberger, Kirk & Caldwell in Miami, recently won a defense verdict in Federal Court in and for the Southern District of Florida, for FMS Management Systems, Inc. (FMS), owner and operator of IHOP restaurants throughout the State of Florida.

FMS was sued by three African-American women who brought forth a public accommodation discrimination complaint. The plaintiffs filed a claim stating that they were denied service on the basis of their race when an IHOP server, after initially being pleasant and professional, stated, “I can’t wait on those types of people.” They further argued that similarly situated patrons outside the protected class were, in fact, given service.

In trial, Singer contended that the plaintiffs were victims of poor service, not racial discrimination. Singer further pointed out that FMS’ conducted a prompt investigation which revealed that the server become frustrated and flustered when asked too many questions and was unable to handle the pressure of a busy lunch hour rush. On the date of the incident, the server was removed from the floor and sent home. Thereafter, she was suspended pending an investigation and fired several days later. Also, Singer provided the court with the restaurant’s diversity training videotape, as well as a copy of the employee handbook, which highlighted FMS’s zero-tolerance policy for any and all forms of discrimination.

The jury of eight men and women agreed with Singer’s arguments and ruled in favor of the defendant.

Rumberger, Kirk & Caldwell Partner Greg Palmer Wins Case For American Airlines
Greg Palmer – a partner with Rumberger, Kirk & Caldwell in Miami – recently won a defense verdict for American Airlines, Inc. in the Southern District Court of Florida.

Two American Airlines patrons – a husband and wife – brought suit against the company for an incident that took place on January 5, 2001. On that date, the plaintiffs boarded an aircraft on a flight from Miami to Cali, Columbia. A flight attendant served a cup of coffee to the husband who spilled it on his hands and in his lap, severely burning his abdomen and groin area. Immediately following the incident, the plaintiff told a different flight attendant that it was an accident and asked him to secure a doctor to examine his injuries upon arrival in Cali. The flight attendant agreed, but warned the plaintiff that the airline would not be responsible for any medical expenses. The plaintiff and his wife later filed suit against American Airlines to recoup medical expenses – and other damages, such as pain and suffering – as a result of the accident.

The lawsuit was brought under the Warsaw Convention, which is a complex framework governing incidents that occur on international flights. The Warsaw Convention holds air carriers strictly liable to up to roughly $140,000 in such cases. However, if the carrier proves that it used all “necessary measures” to avoid the damage in question, the plaintiff cannot recover over this amount.

Palmer argued that under the Warsaw Convention, if the damage caused to a passenger is a result of his own negligence, the airline may be exonerated from liability. He contended that in addition to spilling coffee on himself, the plaintiff admitted his own fault in the accident. Further, Palmer pointed out that the “necessary measures” standard means that the airline needed only to take reasonable precautions in relation to the risk – and the airline did act in a reasonable manner to prevent the accident.

The magistrate agreed with Palmer’s contentions and delivered a defense verdict. The United States District Court for the Southern District of Florida adopted the holding and published the opinion.

Ross, Dixon & Bell has been awarded the 2006 Business Volunteers for the Arts Award by the San Diego Performing Arts League. The award, which will be presented December 4, 2006, honors the pro bono work of attorneys Dan Cross and Eve Brown on behalf of the San Diego Civic Youth Ballet, the Mojalet Dance Collective, and other arts organizations. RDB helps these and other non-profit organizations to establish and maintain their non-profit status, draft and review organization bylaws, and provides other assistance as needed.

Firm's D.C. Office Moves to International Square
"Robins, Kaplan, Miller & Ciresi L.L.P. is pleased to announce their relocation to International Square at 1875 Eye St, NW, Suite 300," said Keith Styles, managing partner of the Washington, D.C. office. Designed by the architectural firm BBG-BBGM in Washington, the new office covers over 41,000 square feet on two floors, significantly increasing its previous office space.

Jeanne M. Proko joins the Media office of Rawle & Henderson
Rawle & Henderson LLP is pleased to announce that Jeanne M. Proko has joined the Firm’s Media, Pennsylvania office. She will focus her practice on the defense of product liability, premises liability, toxic tort and pharmaceutical litigation.

Jeanne was previously the Managing Attorney and General Liability Practice Group Leader for the Philadelphia office of a small national law firm.

Jeanne earned her B.A. degree from Cabrini College, cum laude. She earned her J.D. degree from Villanova University School of Law where she was on Law Review. She is admitted to practice in states of Pennsylvania, New Jersey and the District of Columbia.

Washington Blade Highlights Nixon Peabody’s HRC Rating and GLBT Affinity Group
Washington, DC. The Washington Blade’s November 3, 2006, edition cites Nixon Peabody’s DC office in a recent article, entitled “Head of the Class,” that discusses the annual Human Rights Campaign (HRC) Foundation’s Corporate Equality Index, which focuses on gay, lesbian, bisexual, and transgender (GLBT) equality in corporate America.

Randy Kelly, an Affordable Housing associate and co-chair of Nixon Peabody’s GLBT Affinity Group, references some of the firm’s diversity efforts and describes the importance of having solid inclusive workplace polices. Kelly says, “Professionals spend so much time in the professional environment, one must enjoy that environment and feel welcome.” The goal at Nixon Peabody is to become an innovative leader in diversity by assuring that it is realized throughout the entire range of the firm’s activities.
