Weil Gotshal Partner Appears on CNBC to Discuss Supreme Court’s Review of Obviousness Doctrine
Continuing its trend of increased scrutiny into patent cases, the US Supreme Court will hear arguments concerning the patent doctrine of “obviousness,” which was established by the Court in 1851. In a November 28 interview on the CNBC program “Squawk Box,” Weil, Gotshal & Manges partner Edward Reines opined that the US Supreme Court is not the proper forum for dealing with the issue. Instead, Mr. Reines stated that he felt the problem lies with the Patent and Trademark Office, which permits too many bad patents to issue. According to Mr. Reines, allowing the nation’s highest court to renovate the legal standard could cast into doubt the millions of patents that have already been issued and could hurt the technology and pharmaceutical sectors.

O'MELVENY & MYERS REPRESENTS ORIENT OVERSEAS (INTERNATIONAL) LIMITED IN US$2.35 BILLION SALE OF TERMINALS DIVISION
O'Melveny & Myers is advising Orient Overseas (International) Limited ("OOIL") - HKEx: 316 - in the US$2.35 billion sale of its Terminals Division to Ontario Teachers' Pension Plan Board ("OTPP").

The transaction represents a very substantial disposal for OOIL, and is subject to OOIL shareholders and regulatory approvals. The consideration was determined through an open bidding process. UBS acted as the sole financial adviser to OOIL on the transaction.

The O'Melveny & Myers' team included partners William Rosoff (NY), Todd Triller (NY), Ted Kassinger (DC) and Larry Yee (HK), and associates Tim Gray (NY), Seth Grossman (NY), Matthew Salloway (NY), Akiko Hishikawa (NY) and Maria Corsaro (NY).

Michael Moser Receives Chambers Lifetime Achievement Award
O'Melveny partner Michael Moser was presented with a Lifetime Achievement award at the Chambers Global Awards -- the most prestigious event in the UK legal calendar -- on November 16 in London.

Chambers writes:
China expert Michael Moser has carved out a name as one of the world's leading arbitration specialists. The fluent Mandarin speaker was first posted to Hong Kong in 1980 and then Beijing in 1983, and has since achieved renown in top international legal circles for his deep understanding of the region. This recognition led to him becoming the first foreign national to be appointed as an arbitrator in China.

As China opened its doors to the global market, Mr. Moser has been at the forefront of the country's legal changes.

He is on the panel of China's top arbitration body (CIETAC) and is Vice-Chairman of the Hong Kong International Arbitration Centre. He is also co-chair of the China Arbitration Forum and is a member of a number of the world's leading international arbitration institutions. He is Editor of the prestigious Journal of International Arbitration.

After graduating from Harvard Law School, Mr. Moser advised on mergers and acquisitions, foreign direct investment, technology licensing, and corporate restructuring, advising on many of China's landmark commercial transactions, before specialising in arbitration.

Peers praise his excellent arbitration abilities and his sensitivity to complex cultural differences. These skills will place him in a leading position as China's influence on the global economy increases.

Davis Wright Tremaine LLP and Cole, Raywid & Braverman LLP to merge

Davis Wright Tremaine has been actively pursuing opportunities to enhance the services it offers clients. The merger more than doubles the size of Davis Wright Tremaine’s Washington, D.C. office and significantly increases the firm’s East Coast presence to 90 attorneys. The combined firms will now include 455 attorneys.

Once the merger becomes effective, Cole, Raywid & Braverman will adopt the Davis Wright Tremaine name and the offices will consolidate after a transition period. The combined D.C. office will be overseen by co-partners-in-charge, Richard L. Cys, who currently is partner-in-charge of Davis Wright Tremaine’s D.C. office, and Steven Horvitz, current managing partner of Cole, Raywid & Braverman.

Covington Advises SIS SegaInterSettle AG on Electronic Settlement Facility for US Companies Trading on AIM
Covington & Burling LLP client, SIS SegaInterSettle AG, the Swiss clearing and settlement agency, is now offering to the London market a settlement service specifically designed to permit trades in shares of US companies on AIM to be settled electronically. This service went live last week. Covington advised SIS on the development of this facility.

The practice in the London market up until now was to require trades in shares of US companies on AIM for at least a year after their IPOs to be settled with paper certificates. This requirement was imposed in order to assure compliance with SEC Regulation S and thereby avoid SEC registration. However, this practice complicated the process for the back offices of London brokerage houses and had a negative impact on the liquidity of these “Reg. S shares.”

Covington worked with SIS to solve this “physical delivery” problem by utilizing certain technological capabilities of the SIS computer settlement system in a manner that would permit compliance with Regulation S through electronic communications.

Eidelberg, received the Outstanding Achievement Award from the National Society of Professional Insurance Investigators (NSPII) for playing, “a significant part in the Society’s growth and success in combating insurance fraud”. Mr. Eidelberg is a current member of the NSPII and formerly served as president of the organization’s Ohio chapter.
