National Arbitration Forum Welcomes Linda M. Foster-Wells to Its National Panel of Neutrals
Keller Thoma partner Linda M. Foster-Wells joins the National Arbitration Forum's national panel of independent and neutral arbitrators and mediators. As a new member, Ms. Foster-Wells brings to the National Arbitration Forum (FORUM) extensive experience in alternative dispute resolution (ADR) and a vast understanding of the law areas of general litigation, employment and labor, and healthcare.

Ms. Foster-Wells earned her legal education from the University of Michigan Law School in 1985 and has remained active in the legal and ADR community. She is a member of the ADR sections of the State Bar of Michigan and the American Bar Association. She is certified and active in mediation, serving as a mediator for private parties in civil litigation and for the Wayne County Mediation Center. She is listed as a mediator for the Wayne, Oakland and Macomb County Circuit Courts and is additionally a Case Evaluator for Wayne County. She also participates in the Early Civil Intervention Program in Oakland County Circuit Court. "We are fortunate to have Linda Foster-Wells join our panel," said Curtis Brown, vice president of the National Arbitration Forum. "Her extensive experience and understanding of dispute resolution will greatly benefit parties with legal disputes who use our ADR services in Michigan."

Ms. Foster-Wells adds to the National Arbitration Forum's outstanding panel of over 1,500 neutrals. Panelists adhere to ethical and legal standards, follow stringent rules to ensure that parties' rights are protected, and uphold all ethical principles. Many neutrals have specialized experience in specific industries, enabling them to comprehend and evaluate details of even the most complex legal disputes.

TWENTY-TWO HOLME ROBERTS & OWEN ATTORNEYS LISTED AMONG UTAH’S LEGAL ELITE
Holme Roberts & Owen LLP (HRO) is pleased to announce that 22 of its attorneys have been selected by their peers to be included in Utah Business magazine’s fourth annual Utah Legal Elite issue in January 2007. The selection process began by inviting members of the Utah Bar to participate by submitting a ballot of Utah lawyers they hold in the highest regard – lawyers they have observed firsthand and would recommend to others. Nominators were allowed to cast only one ballot and could not vote for themselves. The list was pared down by number of votes, and a Blue Ribbon Panel of prominent lawyers in each specialty reviewed the list of attorneys.

Edgar Anaya of Haynes and Boone, LLP Named to International Fiscal Association Post
Haynes and Boone Mexico City attorney Edgar M. Anaya has been elected secretary of the General Counsel to the Mexican branch of the International Fiscal Association (IFA) for 2007 and 2008.

It is Mr. Anaya’s second consecutive election to the post. He has also been named reporter for Mexican tax issues to be discussed at the 2008 IFA General Congress in Brussels.

Formed in 1938, the International Fiscal Association (IFA) is a leading non-governmental, international organization dealing with tax matters. Headquartered in Rotterdam, the IFA is comprised of company tax personnel, tax advisers, university professors and government officials. The association provides a unique forum for discussing international tax questions. It now has about 10,000 members worldwide in more than 90 countries, of which 45 have national branches.

The IFA was created to study and advance international and comparative law regarding public finance and, specifically, international and comparative fiscal law and the financial and economic aspects of taxation.

Greenberg Traurig Adds to its Litigation Team: New Shareholder Enhances Firm's National White Collar Practice Capabilities
Greenberg Traurig LLP, the nation’s seventh-largest law firm, is pleased to welcome Jeff Ifrah as a new Shareholder in its litigation practice.

His clients include companies in a wide range of industries including defense, finance, healthcare, pharmaceutical, real estate and software.

Some of Jeff's recent matters include representing one of the nation's largest healthcare providers in a complex qui tam complaint alleging over $250 million of false Medicare claims, one of the nation's largest credit card issuers in a complex whistleblower proceeding filed under the Sarbanes-Oxley whistleblower provisions, and the former CEO of Homestore.com in an on-going complex criminal securities fraud case.

Top Lobbyist Stephen Sayle Joins Government Relations Practice at Dow Lohnes
Dow Lohnes PLLC welcomes Stephen Sayle as a senior counsel in its Government Relations group. Mr. Sayle will be based out of the firm’s Washington, DC office. His practice will focus primarily on matters coming before the House and Senate commerce and judiciary committees, in particular telecommunications, technology, automotive and energy issues.

The addition of Mr. Sayle to Dow Lohnes follows a number of recent high profile additions, including former Democratic Congressman Bob Carr, who served for 18 years as a Representative from Michigan and as Chair of the House Appropriations Subcommittee on Transportation, respected patent litigator Bruce Wieder and former Vice President and General Counsel of the American Council on Education, Sheldon Steinbach.

Mr. Sayle comes to Dow Lohnes from Dutko Worldwide, a government affairs strategy and management firm. He has over seventeen years of Capitol Hill experience, both inside and outside of government. Mr. Sayle began his congressional career with Congressman Mike Oxley (R-OH), Chairman of the House Financial Services Committee. He then served three years as Legislative Counsel for Congressman Joe Barton (R-TX), where he handled telecommunications and other Energy and Commerce Committee issues.

Mr. Sayle subsequently served as counsel for the House Energy and Commerce Subcommittee on Investigations chaired by Congressman Barton. During his three year tenure as counsel, he focused on energy, environment and other issues.

Mr. Sayle’s previous experience also includes working as Director of Government Affairs for ALLTEL Service Corp., a telecommunications firm providing local exchange and cellular service.

Favorable Supreme Court Decision Reached
The Ohio Supreme Court announced its long-awaited decision in the case of Dayton Supply & Tool Company v. Montgomery County Bd. of Revision (111 Ohio St. 3d 367, 2006-Ohio-5852). Coolidge Wall attorney Merle Wilberding argued the case to the Supreme Court in February on behalf of Dayton Supply.

Our client, through an officer of the corporation, appealed its property tax increase to the County Board of Revision. A prior Supreme Court decision had held that only a lawyer could file this type of appeal. The Ohio legislature had passed a law subsequent to that decision attempting to legislatively overturn the case, but the Supreme Court is the final arbiter regarding the practice of law in Ohio. Merle convinced the Court that the public should be permitted to perform the limited tasks necessary to file and present an appeal (although a lawyer is still required to examine witnesses, make legal arguments, etc.).

This issue has been the source of much unhappiness by businesses in Ohio. This favorable Supreme Court decision today will be hailed by many around the state.

Steve Barnett Hosts and Presents at an OSHA Seminar for New York & New Jersey Real Estate Developers and Managers Entitled "Resources for Creating & Improving Your Safety Culture"
Steve Barnett hosted and presented at an OSHA seminar for New York & New Jersey Real Estate Developers and Managers entitled "Resources for Creating & Improving Your Safety Culture.” The seminar took place between 12 p.m. and 5 p.m. on Tuesday, November 28, 2006 at the Conference Center at Montclair State University in Montclair, New Jersey.

This year’s seminar discussed worker safety and health in the construction and management of real property assets, for both industrial and residential properties. The seminar further discussed how OSHA rules apply when dealing with construction on a Brownfield or operation and maintenance of a high rise hotel, condominium or office tower.

Steve Barnett is Co-Chair of OSHA/New Jersey Communication Alliance and hosted the seminar along with Professor Robert Taylor, PhD of the Center for Environmental Management and Analysis at Montclair State University. The seminar provided expert opinions on how to make the most of technology and limited resources to provide effective safety and health programs for employees in real estate.
