John M. Kamins Receives the Leukemia & Lymphoma Society's Spiral of Life Award
John M. Kamins, partner with the law firm of Honigman Miller Schwartz and Cohn LLP in Detroit, received the Spiral of Life Award on November 4 from The Leukemia & Lymphoma Society at its 2006 Strategic Leadership Conference in Dallas, Texas. The Spiral of Life Award is the Society’s most prestigious volunteer award and recognizes an individual other than a well-known public figure who has contributed personal and special talents that have resulted in outstanding contributions with national impact for the Society’s program.

Kamins completed two terms as Chairman of the Society at the end of June and continues to serve on its Board of Directors. On the national level, he has served on the Society’s Board of Directors since 1996, on its Executive Committee and Strategic Planning Committee and in leadership roles in numerous other committees and task forces. He is a resident of Bloomfield Hills, Michigan.

The Society’s stated mission is to cure leukemia, lymphoma, Hodgkin’s Disease and myeloma, and to improve the quality of life of patients and their families. Since its founding in 1949, the Society has invested more than $483 million in research specifically targeting blood cancers.

Twelve Eckert Seamans Attorneys Named Pennsylvania Super Lawyers "Rising Stars
The national law firm Eckert Seamans Cherin and Mellott, LLC today announced that 12 of its attorneys have been named Pennsylvania Super Lawyers Rising Stars for 2006 by Philadelphia Magazine and Pennsylvania Super Lawyers Magazine. The attorneys were selected for the honor, which is determined through the independent research of Law & Politics Magazine. Attorneys on the list must be 40 years old or younger, or have practiced law for 10 years or less.

According to Law & Politics, the organization which publishes Pennsylvania Super Lawyers Magazine, 2.5 percent of Pennsylvania attorneys are honored as “Rising Stars.” The Rising Stars list is published each year in the December issue of Pennsylvania Super Lawyers-Rising Stars Edition .

“Eckert Seamans has taken a great deal of pride in attracting and developing some of the finest young attorneys and brightest legal minds in the field to lead our own firm in the years to come, and to serve as stewards for the legal profession throughout the Commonwealth of Pennsylvania,” said Tim Ryan, Eckert Seamans’ Chief Executive Officer.

In Pittsburgh, eight attorneys were named to the list: Jay T. Blount, Grant E. Coffield, Kathryn A. English, Wendy West Feinstein, Daniel B. McLane, Cornelius J. O’Brien, Daniel P. Orie and David A. Rockman.

In Philadelphia, three attorneys were selected: Ronald S. Gellert, Rachel Castillo Rosser and Dennis P. Ziemba. In Harrisburg, Scott R. Mehok was selected for the honor.

Don Elliott Discusses Argument in Landmark Supreme Court Case on Global Warming --- Televised on C-SPAN
On November 29, Washington partner E. Donald Elliott participated on a key panel entitled “Global Warming in the Supreme Court: Massachusetts v. EPA” at the Georgetown University Law Center. The panel discussion, which was broadcast live on C-SPAN, was conducted immediately after oral arguments were presented before the Supreme Court in Commonwealth of Massachusetts et al. v. EPA, a landmark case marking the first time the Supreme Court has agreed to hear a matter relating directly to global warming. In the case, Massachusetts and other petitioners are asking the Court to set aside an EPA decision not to regulate greenhouse gases under the Clean Air Act. The suit stems from EPA’s denial of a petition to regulate carbon dioxide emissions from automobiles. Mr. Elliott served on the panel with three other environmental law experts to discuss and analyze the events of the day. Mr. Elliott, a former EPA general counsel, predicted a narrow win for the EPA, saying that he thought that the Supreme Court would be unable to agree on a single opinion but 2-4 justices would hold there was no standing to bring the suit, and another 2-3 justices would rule in favor of EPA on a different ground, holding that EPA had not abused its discretion in declining to regulate emissions of carbon dioxide from motor vehicles at this time. However, he also stated that of all possible outcomes, “None of them are good from the standpoint of the Bush administration.” Quoting former Solicitor General Ken Starr, he said “there are victories and there are developments.” Whatever the outcome, the Supreme Court ruling is going to be a “development” for the Bush administration because it will focus more public and Congressional attention on the issue, he said. Alan Gover Joins White & Case's Restructuring and Insolvency Practice
Global law firm White & Case LLP announced today that Alan Shore Gover has joined the Firm as a partner in its leading Financial Restructuring and Insolvency practice. Gover, who will be resident in the Firm's New York office, joins a team of over 120 bankruptcy lawyers worldwide providing comprehensive services across the full spectrum of bankruptcy law.

"Alan's addition to our team is an important and exciting step in the continued expansion of our global restructuring practice," said global co-head of the restructuring practice Thomas E. Lauria. "He has built a reputation for providing cutting-edge advice in large and complex restructuring matters. Given the dramatic increase in demand we have experienced in recent years for these types of services, Alan is a perfect fit."

Mr. Gover has been a leading bankruptcy practitioner for nearly 30 years. In restructuring over $60 billion of debt and liabilities during his career, he has acquired a wealth of restructuring experience in a wide variety of industries, including retail, airline and transportation, real estate, energy, technology and defense. His varied career includes serving as lead M&A counsel for the buyer in the $4 billion precedent setting acquisition of the generating assets of New England Electric Systems; and as lead counsel for PG&E Corporation in the successful Chapter 11 reorganizations of its two primary subsidiaries - Pacific Gas & Electric, the largest restructuring in the history of the electric utility industry; and the National Energy Group, one of the country's largest independent power concerns.

Second-ever Russian Public Future Flow Securitisation of DPRs
White & Case acted for MDM Bank in its issue of €225 million of Series 2006-A Notes and $200 million of Series-B Notes ("the Notes"), due December 2011, in what qualifies as the country's second-ever public future flow securitisation of diversified payment rights (DPRs). DPRs are receivables arising out of correspondent bank payment orders. Established in 1993 and headquartered in Moscow, MDM Bank is the principal component of the MDM Financial Group, one of Russia's largest privately owned banking groups.

The Notes were issued by MDM DPR Finance Company S.A., a special purpose vehicle incorporated under Luxembourg law, which will use the gross proceeds from the issue to make a series of loans to MDM Bank for general corporate purposes.

Issued on November 20 2006, the Notes received a Baa3 investment grade rating by Moody's Investors Service. Moody's rates MDM Bank as Ba2/NP and the institution is rated BB- by Fitch. Interest will accrue on the offered Notes from their date of issuance at the rate of 2 percent per annum above Three-Month EURIBOR. The Notes have been admitted to the Irish Stock Exchange under Regulation S by Joint Lead Arrangers Dresdner Kleinwort and Merrill Lynch International.

"The MDM Bank issue is the latest in a series of sophisticated capital markets transactions illustrating the rapid development of financial systems in countries within the CIS. In Russia, investor demand, driven by a booming economy, continues to push back the boundaries of innovative structuring techniques," explained David Barwise, lead White & Case partner advising on the deal. "The combined use of sophisticated US, English and local legal expertise is one of the major factors enabling these deals to successfully come to market at an ever-increasing pace."

The White & Case team advising on the MDM Bank transaction was led by London-based partner David Barwise, working alongside associates Simon Morgan, Maeve McSherry and Tricia McDoom in London, and Olga Okouneva and Anna Ivanova in Moscow, along with partner Ulf Kreppel and associates Nicolas Wittek and Ivonne Herzog in Frankfurt. The Bank of New York acted as trustee on the transaction.

White & Case's network of capital markets lawyers in London, Moscow and Almaty has been involved in a number of major transactions in recent months. Earlier this year the Firm advised Credit Suisse and ABN Amro as lead managers on a $200 million Regulation S Eurobond issue by Russian IT and electronics business Sitronics, the first corporate Eurobond from Russia this year. More recently, White & Case advised JSC Alliance Bank on the first future flow securitisation of DPRs to be guaranteed by a multilateral development bank. This year the Firm has also represented Morgan Stanley as Sole Lead Manager in the first Kazakhstan Tenge denominated Eurobond to be issued on the international capital markets; advised JSC KazMunaiGas Exploration Production, a subsidiary of NC KazMunaiGas, the Kazakh state oil and gas company, on its IPO, which raised $2.03 billion; and acted for JSC Kazkommertsbank in its global $845 million offering of Global Depositary Receipts to institutional investors on the London Stock Exchange.
