In addition, our firm has been nominated for the 2006 Business of the Year, sponsored by the Dayton Business Journal, in the category of Community Supporter of the Year, and is one of the finalists for that award, to be announced next month.
Our firm has been a sponsor of the Business of the Year program for a number of years. The nomination of our firm for this award was based on the many community activities in which the firm's employees participate, and the extensive pro bono publico work performed by the firm's attorneys, especially in providing representation to those persons who are indigent or disadvantaged. That pro bono work includes our innovative partnership with the Public Defender's Office whereby our junior attorneys participate in representing indigent defendants while our firm continues to pay their salary; acceptance of criminal appointments; participation in the Dayton Bar Association's Volunteer Lawyer's Program; handling cases involving Civil Protective Stalking Orders in Common Pleas Court; and other efforts. The billable value of this time is hundreds of thousands of dollars. Our firm does the pro bono work that other law firms claim to do.

Jeff Ireland and Laura Sanom made a presentation at the Ohio State Bar Associations' 40th Annual Institute Symposium.
Jeff's and Laura's presentation was titled "Section 1 of the Sherman Act -- Roles for Playing with Suppliers and Customers: Laws Governing Beneficial Relationships," and addressed antitrust issues arising from vertical arrangements.

Jeff Cox will be presenting two CLE webcasts in December for NBI
On December 8, he will be teaching as part of a one-hour webcast titled "Reputable Practice: Ethics for Litigation Attorneys." On December 11, he will be teaching for one hour on ethics issues as part of a webcast titled "Ethical Issues and Substance Abuse in Ohio.

Cohen & Grigsby Attorney Selected as a 2006 Pennsylvania Rising Star
W. Scott Hardy is a Director in Cohen & Grigsby’s Labor and Employment and Employment Litigation Groups. He has counseled and defended clients in a broad array of industries including healthcare institutions, public and private colleges and universities, financial institutions, professional services firms, manufacturing firms, retail companies, transportation and materials management companies, public authorities and commissions, and local municipalities. Mr. Hardy co-chairs the Firm's Recruiting and Associate Development Committee. Mr. Hardy earned his B.A. in Economics and Political Science (magna cum laude) from Allegheny College in 1993 and his J.D. from Notre Dame Law School in 1996. He is admitted to the bars of Pennsylvania, the U.S. Supreme Court, the U.S. Court of Appeals for the Third Circuit, and the U.S. District Court for the Western District of Pennsylvania. He is a member of the Pennsylvania, Allegheny County, and Federal Bar Associations and the American Healthcare Lawyers Association. Mr. Hardy serves as President of the American Inns of Court, W. Edward Sell Chapter ( Pittsburgh) and as Vice Chair of the Board of Directors for the Good Samaritan Hospice of Pittsburgh and is a member of the Membership Standards Committee of the Greater Pittsburgh Council of the Boy Scouts of America. He resides in Pittsburgh, Pennsylvania.

Rising Stars are chosen by their peers as being among the top up-and-coming lawyers (40 years old or younger, or in practice 10 years or less) in the state, and only 2.5 percent of Pennsylvania attorneys receive this honor each year. The selection process includes peer nominations and independent research on candidates.

JPMorgan Chase Held Answerable for Claims Against Parent Company Topping $34 Million
The New York State Supreme Court has sustained claims in excess of $34 million against JPMorgan Chase Bank, N.A. (JPMC Bank) and its parent company JPMorgan Chase & Co. (JPMC Co.) brought by AY Bank Ltd. (AY Bank), an English chartered bank formerly operated to encourage trade with the former Socialist Federal Republic of Yugoslavia.

AY Bank’s assets had been frozen beginning in 1992 by a series of presidential executive orders issued by Presidents George H.W. Bush and William J. Clinton, in part because of an affiliation with former Serbian President Slobodan Milosovic. Its assets were unblocked in May 2003 by President George W. Bush after Serbia, Montenegro, Yugoslavia, Bosnia, and Herzegovina had been returned to democracy.

At the time its accounts were unfrozen, AY Bank had in excess of $34 million on deposit at JPMC Bank, but its demands for a return of its funds were refused. Justice Herman Cahn’s decision, which denied the defendants’ motion to dismiss, found that both JPMC Bank and its parent, JPMC Co., can be sued to recover those funds. That conclusion was based, in part, on claims that the parent represents to the public that its “Chase” banks are a brand operated by the parent, and they share management, business locations and assets.

AY Bank was represented by Dreier LLP partner Jeffrey A. Mitchell, and associate Don Abraham.

“The court is sending an important message to the banking industry with this decision,” stated Mr. Mitchell. “Parent companies may be held accountable for the actions of their subsidiary banking entities. Those in the banking industry are now on notice.” He added, “Every depositor’s worst nightmare is that it will not be able to withdraw its funds. Here, AY Bank was unfairly forced into liquidation because it could not get its money.”

AY Bank is an English bank founded in 1980 for the purpose of encouraging exports from, and investment in, Yugoslavia and the former Yugoslav republics.

A Marathon County jury returned a verdict in favor of the firm’s client, Ford Motor Company, represented by Anthony M. Pinto.
The plaintiff was traveling southbound on Route 51 in central Wisconsin in his 1997 Ford F-150, at which time he was allegedly exposed to an unreasonably dangerous level of carbon monoxide. The plaintiff alleged that the excess carbon monoxide was the result of two defects in the design of the vehicle, the inappropriate programming of the powertrain control module and the inappropriate routing of the exhaust system. The plaintiff claimed that the carbon monoxide exposure resulted in severe physical and cognitive deficits. The defense argued that the vehicle’s design was appropriate and that the medical evidence did not support the plaintiff’s claim that his injuries were the result of carbon monoxide exposure. The jury returned a defense verdict in favor of Ford Motor Company in less than two hours.

Elizabeth A. Favaro has joined the firm as an associate in our litigation department.
She concentrates her practice in the areas of Contract Disputes, Commercial Transactions, Real Property Disputes, and Employment Law.

During law school, Liza served as an Assistant Editor of the Thomas M. Cooley Law Review. She was named Winner & Best Advocate in Cooley’s First-Year and Intra-School Moot Court Competitions and she participated in the 2005 National Appellate Advocacy Competition in New Orleans, LA. She was awarded the Raymond Burr Award for receiving top honors in criminal law. She also served as a judicial intern to the Honorable Maura D. Corrigan for the Michigan Supreme Court.

Before attending law school, Liza was an Emmy Award-winning television journalist, covering crime, politics, and the legal system.

Liza is a member of the State Bar of Michigan and the Oakland County Bar Association (OCBA).
