Robinson & Cole Land Use Lawyer Elected to Board of Rivers Alliance of Connecticut
Dwight H. Merriam of R&C's LandLaw Section has been elected to the board of directors of the Rivers Alliance of Connecticut. As described on their website, Rivers Alliance: "is the only statewide nonprofit dedicated to protecting and enhancing Connecticut's rivers, streams, and watersheds." The Alliance..."promote[s] and support[s] environmentally sound state policies, assist[s] the state's many watershed and river groups, and educate[s] the public about the importance of water conservation and aquatic habitats." The Alliance is a membership-based nonprofit corporation founded in 1992 with 600 members including 100 organizations.

Paul Hastings Wins Motion for Terminating Sanctions in High-Profile International Fraud Case
Paul, Hastings, Janofsky & Walker LLP (Paul Hastings), a leading international law firm, won a motion for terminating sanctions on behalf of New World TMT Limited against Jianping "Tony" Qu, the CEO and majority shareholder of PrediWave Corporation and other PrediWave-related companies. Qu, PrediWave Corporation and the other PrediWave-related companies were all named as defendants in the action and represented by Latham and Watkins LLP.

The victory signals the conclusion of more than two years of litigation where New World TMT, a division of the Chinese conglomerate New World Group, was attempting to recoup $670 million it paid in investments and purchases for a one way "Video On-Demand" cable system that the U.S.-based PrediWave never delivered on. The lawsuit also contended that Qu, PrediWave and other PrediWave related companies knowingly engaged in actions aimed to defraud New World out of its investment.

The motion for terminating sanctions was issued in response to Tony Qu's admission in a declaration filed with the Court that he provided untrue testimony in at least two depositions and his subsequent violation of a court order that he appear for a deposition and Mandatory Settlement Conference. The trial had been scheduled to begin on Nov. 21 in the Superior Court of the State of California in Santa Clara when Judge Jack Komar granted the motion.

A default hearing to set the amount of compensatory and punitive damages will be scheduled at a future date. Counsel for New World believes that the total compensatory and punitive damages awarded will exceed $2 billion. The Court has also set a hearing for December 4, 2006 to determine whether to grant New World's motion for terminating sanctions as to PrediWave and the other corporate defendants. The Court has stated that its "tentative" ruling is to grant the motion against all the corporate defendants.

The Paul Hastings team, led by Los Angeles partner Dennis Ellis, included partners Ronald Oster and John Porter, and associates Joshua Hamilton, Katherine Murray, Miguel Sanqui and Jacob Risner. Hong Kong Partner Mohan Datwani and Of Counsel Robert San Pé led the team in Hong Kong that handled critical discovery proceedings in China that forced Qu to recant his testimony.

O'MELVENY & MYERS REPRESENTS THE SPROUT GROUP IN THIRD LARGEST BIOTECH PRIVATE FINANCING
O'Melveny & Myers recently represented the Sprout Group, one of the country's oldest and largest sources of private equity capital for growing companies, in a $100 million Series C financing for clinical-stage pharmaceutical company Kalypsys.

Attorney General-elect McCollum Announces Transition Team Leadership, Members
Attorney General-elect Bill McCollum today named the members of the team that will assist him in his transition into the office of the Attorney General. The transition members will review the current operations of the Attorney General's office including its budget, structure and personnel in order to advise Attorney General-elect McCollum as he transitions into office.

"I want to express my appreciation to the people who will be assisting me in this transition process," said Attorney General-elect McCollum. "I look forward to working with the talented members of this team.”

Attorney General-elect McCollum has selected Terry Griffin to serve as the chair of the transition. Bobby Brantley, Joe Negron and Bob Allen will serve as Vice Chairmen, while Bill Stewart will act as McCollum’s staff director. In addition to the leaders of the team, McCollum also named the following individuals who will serve under the team’s leadership in the transition process: Jorge Arrizurieta, Thomas Ball, Vince Champion, Al Condon, Charlotte Danciu, Leo de la Pena, Donald Eslinger, Tom Grady, Chris Hart, Robert Heekin, Jr., Mery Lopez, James Mann, Simone Marstiller, Joseph Mason, Nolan McLeod, Carlos Muniz, Thomas Nash, Thomas Spencer, Glenda Thornton, Jake Varn, Karen Unger, Levi Williams and Norm Wolfinger.

Attorney General-elect McCollum has also set up a website designed to keep the public informed about the current transition and to provide Floridians with the opportunity to submit ideas and suggestions to the transition team.

Twenty-Two Buchanan Ingersoll & Rooney Attorneys Selected as Pennsylvania Rising Stars
Twenty-two Buchanan Ingersoll & Rooney attorneys were named as 2006 Pennsylvania Rising Stars by Philadelphia Magazine, published by Law & Politics, a division of Key Professional Media, Inc.

Baker & McKenzie Ranked in Top 5 for Client Service in Annual Survey of Fortune 1000 Companies
Baker & McKenzie ranked fifth in The BTI Client Service 30, a ranking of 30 law firms recognized for delivering superior client service. The Client Service 30 is created by BTI Consulting Group as part of its annual Survey of Client Service Performance for Law Firms. This is the highest position for the Firm since the annual survey of Fortune 1000 companies began in 2001.

In the survey, Baker & McKenzie was recognized as "the best of the best" for its “consistent superiority in International Capabilities as well as Breadth of Services, Bringing Together National Resources and Providing Value for the Dollar.” In addition, Baker & McKenzie was honored as a BTI Client Service Alumni -- one of only 10 law firms listed three times in The BTI Client Service 30 since the survey began.

To determine the results of the survey, BTI conducted more than 250 independent, individual interviews with corporate counsel at Fortune 1000 companies and large organizations. Survey participants were asked to rate law firms on 17 critical performance categories.

In addition to this ranking, Baker & McKenzie has been recognized a power law firm in maintaining client relationships for two consecutive years in BTI’s “Power Rankings: The Client Relationship Scorecard for Law Firms.” Boston-based BTI is the leading provider of strategic market research to law firms and professional service organizations.
