Michael Mooney elected chairman of A Better City
Michael Mooney, managing partner of the firm, was elected chairman of A Better City (ABC) at the organization’s annual meeting on November 16. Michael’s tenure begins January 1, 2007.

ABC advances infrastructure investments and projects that are vital to sustaining and growing the Boston area's economy and ensuring that Boston remains one of the most dynamic and unique cities in the world. Comprised of leaders from business and major institutions, ABC is focused on solving problems and developing strategies that ensure the continuity and progress of significant transportation, land development, and public realm projects.

ABC is built on the foundation of over fifteen years of success as the Artery Business Committee, widely credited with achieving consensus and keeping Boston open for business during the Central Artery/Tunnel project, the largest and most complex urban infrastructure project ever undertaken in the United States.

Michael has been involved with ABC for over ten years and currently chairs the Membership Development Committee. He recently chaired the Strategic Planning Committee, whose efforts resulted in a broader focus for the organization.

Forty Nutter attorneys named 2006 Massachusetts Super Lawyers Boston magazine
Forty Nutter attorneys from practice areas throughout the firm have been named 2006 Massachusetts Super Lawyers in a joint publication of Law & Politics and Boston magazine. This honor was only awarded to five percent of 31,000 active lawyers in Massachusetts who have been in practice for more than 5 years. Super Lawyers are nominated by their peers and evaluated through the independent research efforts of Law & Politics.

Johnson & Johnson lists Nutter as their go-to IP counsel IP Law & Business
Johnson & Johnson named Nutter as their patent counsel in IP Law & Business, an American Lawyer Media publication. The November issue includes a section called “Who Protects IP America,” a listing of the law firms that represent Fortune 250 companies. The publication compiled this data from an annual survey, which asks in-house counsel in corporate America to name the firms they use for IP litigation and patent counsel.

Managing Partner David Kistenbroker Quoted in Chicago Lawyer Article on Corporate Fraud
Chicago Managing Partner David H. Kistenbroker was quoted in an article in the Chicago Lawyer about the new ways corporations and regulators are handling corporate fraud in light of cases such as Enron (Corporations; Government Scrutinize Fraud Issues, November 2006).

Two Holland & Hart Associates Named To Ritter's Transition Team
Holland & Hart is pleased to announce that Scott Martinez and Sarah Marks were appointed to Governor-elect Bill Ritter's Transition Team.

Mr. Martinez is an attorney in the firm's Litigation department. Appointed to the Executive Transition Team, he leads the Personnel and Administration Advisory Committee. He will work with the team to select the next leaders of the Colorado state government.

Ms. Marks is an attorney in the firm's Benefits Law Group. She has been appointed as a member of the Personnel and Administration Advisory Committee and will work in conjunction with the other 12 members of the committee to identify qualified candidates for cabinet and agency positions and to identify important policy issues, especially as they relate to human resources and benefits-related issues.

The Transition Team is divided into 18 advisory committees, including agriculture, corrections, economic development and international trade, education, energy management and conservation, health care policy and finance, human services, information technology, labor and employment, local affairs, military affairs, natural resources, personnel and administration, public health and environment, public safety, regulatory agencies, revenue, and transportation.

Before December 15, 2006, the committees will review more than 700 applications to present lists of qualified candidates for the positions Mr. Ritter will fill as he takes office. Each committee will also review the related department or agency to identify any structural or policy issues.

Court Finds Loan Servicer Exempt From State’s Debt Collection Practices Act
The firm’s commercial litigation practice area, along with co-counsel Preston Gates & Ellis, L.P., recently obtained a summary judgment in federal litigation involving the loan servicing practices of their client, Security National Servicing Corporation. The plaintiffs commenced suit in Washington state, alleging Security National was liable for over $5 million in damages because among other things, its introductory letter allegedly lacked certain information required by Washington’s counterpart to the Federal Fair Debt Collection Practice Act.

The district court disagreed, concluding as a preliminary matter that Security National was not a "debt collector" under the state’s law because it services loans only for affiliated entities and because its primary business is not debt collection, but rather, the servicing of loans.

Joseph N. Mole and Michael H. Pinkerton , who handled the lawsuit, are attorneys in the firm’s commercial litigation practice area. They are involved in lender liability and loan servicing litigation, as well as other types of commercial disputes, in Louisiana and around the country.

Fredrikson attorney Jeff Post was awarded the 2005-06 Elmer H. Wiblishauser Author's Award from the Minnesota State Bar Association Publications Committee. The award is given annually to the best work published in Bench & Bar. Jeff received the award as a co-author of the Bench & Bar article entitled "Limits of Urban Development? Kelo, Walser, and Condemnation in Minnesota." Click here to view this article.
