Pitney Hardin’s Employer’s Law Blog Listed as Resource on U.S. Department of Labor Web Site
Pitney Hardin is pleased to announced that the Employer’s Law Blog has recently been listed as a resource on the U.S. Department of Labor’s web site. It is one of only five blogs nationwide to be listed on the site within the Wirtz Labor Law Library’s “Law Tips Archive.”

OF&P Attorney to Conduct IPIX Bankruptcy Liquidation Sale of Intellectual Property and Tangible Assets
Odin, Feldman & Pittleman attorney Don King will oversee the bankruptcy liquidation sale of intellectual property, office equipment and furnishings for IPIX Corporation.

Reston, Va. headquartered IPIX earned an international reputation for the quality of its high-resolution digital 360° video cameras and immersive still photography business. The company filed a voluntary petition for relief under Chapter 7 of the U.S. Bankruptcy Code on July 31, and was granted the right to resume limited operations on Sept. 27 to generate revenue from sources including ipixstore.com.

World-wide interest in the bankruptcy filing and an earlier advertisement for the solicitation of bids for assets in October resulted in two high bidders who, unless other interested parties intervene, will grab and own the proverbial brass rings this December.

Two additional auctions are scheduled for Dec. 12 and 20 to determine the winning bidders for IPIX tangible assets plus the provisional patents for IPIX’s Gigapixel camera technology. Both will be held at the U.S. Bankruptcy Court for the Eastern District of Virginia at 200 Washington Street in Alexandria. According to King, the Chapter 7 trustee for the matter, motions to approve the sales to the highest bidders will be made immediately after the auctions’ conclusions.

The Dec. 12 auction, slated for 10 a.m., will focus on the sale of IPIX equipment and furniture. Those assets will be sold in bulk. The Dec. 20 auction will focus on the Gigapixel provisional patents and is scheduled for 10:30 a.m. The company’s Gigapixel camera technology was developed in conjunction with the Defense Advance Research Projects Agency (DARPA), a Pentagon-funded agency that specializes in developing new technologies for military applications. This technology has undergone some testing and was in the process of being enhanced with night-vision capabilities when IPIX filed bankruptcy.

Prior to the bankruptcy filing, IPIX had $30 million in contract opportunities with the Defense Department for this Gigapixel technology.

According to King, "Even though the technology is in the developmental stage, it has a vast number of potential applications. It’s also supported by a provisional patent due to expire mid-February of next year. The potential for the buyer that develops and patents this technology is staggering.”

When asked about the sale of more than 30 more patents owned by IPIX, including its core 360° software technology, King said he expects to announce the auction date of those assets “very soon”, with a potential sale date as early as mid-January 2007. The 360° software technology supports the widely-used IPIX Still and Video businesses.

According to Stephen Karbelk, sales agent for the trustee and the auction process, “There are still many more assets to be sold, including the OMNIview™ dewarping technology and an entire inventory of cameras and lenses located in Winston-Salem, NC.”

King is a principal with Odin, Feldman & Pittleman where he heads the Bankruptcy & Creditors’ Rights practice group. King's practice primarily involves representation of debtors, creditors and committees in Chapter 11 reorganizations, but he also represents other types of debtors and creditors, particularly businesses and institutional lenders, in all phases of the bankruptcy process including workouts. Since 1991, he has served as a Chapter 7 trustee in bankruptcy for the Eastern District of Virginia.

Paul Schlauch Named World's Leading Mining Lawyer for the Second Consecutive Year
Paul J Schlauch of Holland & Hart LLP has been named the leading mining lawyer in the world at the 2006 Who’s Who Legal Awards. This award follows similar recognition in the inaugural awards last year.

Following on from the success of the 2005 awards, Who’s Who Legal has used the thousands of nominations received from clients and private practice professionals in the course of an ongoing research process to identify the pre-eminent lawyer and firm in each of the 27 practice areas covered in The International Who’s Who of Business Lawyers 2006, published in March.

Fenwick & West LLP Receives Award for Professional Vendor of the Year
On behalf of Fenwick & West LLP, partner Vic Schachter, member of the firm's Litigation Group and Chair of its Employment Practices Group, accepted the Professional Vendor of the Year award from technology client Synopsys, Inc. Synopsys presented the award on November 16th at its annual off-site retreat for the Office of the General Counsel. Schachter, who was instrumental in achieving a significant litigation victory for Synopsys this past year, was the ideal recipient to accept the award for the firm.

The award, the first of its kind at Synopsys, was created by General Counsel Brian Cabrera to recognize outside vendors for achieving the highest standards of professional quality and client care.

"Given Fenwick & West's service level commitment and its outstanding execution, it's no surprise that the firm is our honoree this year," said Cabrera.

The award was given in recognition of the strong collaborative relationship between Fenwick and Synopsys throughout the years — a relationship that hit an "all time high" this past year when Synopsys prevailed in litigation involving a 17-day jury trial.
