Kenyon & Kenyon Announces Release of the Book, Business & Legal Primer for Game Development
Kenyon & Kenyon, LLP is pleased to announce the publication of a treatise on video game law, featuring Kenyon & Kenyon attorneys as authors and co-editors. The book, Business & Legal Primer for Game Development, is published by leading game industry publisher, Charles River Media, a division of Thomson

Business & Legal Primer for Game Development covers a large variety of topics related to game development, including business structure, contracts, employment law, taxation, marketing, litigation and intellectual property, and the book also features contributions from game companies, including Sony Online Entertainment, BioWare and NCSoft.

Kenyon & Kenyon attorney S. Gregory Boyd co-edited the book with experienced game developer and consultant Brian Green. Kenyon & Kenyon partners John Flock and Gary S. Morris contributed with two chapters. Mr. Flock’s chapter discusses litigation in the game industry and draws on his experience in this area to outline an organized overview and strategy for game companies faced with the prospect of litigation. Mr. Morris’s chapter focuses on the complexity of licensing in the game industry, including licensing in game development contracts. Gregory Boyd, in addition to being co-editor, contributed two chapters to the text which provide a general overview of intellectual property in the game industry and a sample game development contract walk-through.

The book is hardbound with more than 475 pages and contains 17 chapters with 28 contributors, including industry veterans Ralph Baer, Richard Bartle, Dave Ahl, Eric Zimmerman and Jessica Mulligan. By providing practical advice blended with business considerations and a legal overview, Business & Legal Primer for Game Development will be a valuable reference for those in game development. The book is available at Amazon.com and other major book distributors.

Kenyon & Kenyon’s interactive entertainment practice represents some of the most prominent publishers, console manufacturers and game developers in the industry. Their practice includes counseling, litigation, intellectual property registrations and transactional work across a variety of platforms including PCs, mobile and console games.

John Flock is Chair of Kenyon & Kenyon’s Asian Practice Group and an experienced trial lawyer with nine years of service as an Assistant District Attorney in New York City. In addition to his trial work, Mr. Flock has argued appellate cases, advised attorneys on trial tactics and given demonstrations of trial techniques. He has a strong scientific and technical background with particular expertise and hands-on experience in computer technology, including design and implementation of mainframe and personal computer programs, supervision of a computer programming staff and service as court-appointed receiver for a software company. Mr. Flock is a frequent writer and speaker on intellectual property issues. He is a regular contributor to the Computer Law Association Bulletin and former Associate Editor of that publication.

Gary S. Morris has over 20 years of experience in the field of information technology, including computer and network security, cryptography and telecommunications. His legal expertise encompasses both intellectual property law and European competition law. He has been retained by the European Commission as an expert on digital rights management patents and advised major consumer electronics manufacturers, software companies, information services companies and media businesses on a wide range of patent, copyright and trademark issues. Mr. Morris has helped negotiate and draft patent, copyright and trademark licenses, computer game development contracts, End User License Agreements, Privacy Policies and terms of use agreements. He has also counseled clients with regard to open source software and other technology-related copyright issues.

Dr. S. Gregory Boyd is an associate in the New York office of Kenyon & Kenyon. Since joining the firm, Dr. Boyd has worked with intellectual property transactions, litigations and counseling. His work includes both development contracts and litigation on behalf of MMOs. He was an author and editor for the International Game Developer Association's first industry guide to intellectual property. Dr. Boyd has published articles in Game Developer Magazine and sits on the Advisory Board for Mobygames. He will be speaking at the State of Play Conference in Singapore and at the Game Developers Conference held March 5-9 at the Moscone Convention Center in San Francisco.

Thirty-Three Thelen Reid Brown Raysman & Steiner Attorneys Selected as "Best Lawyers in America"
Thelen Reid Brown Raysman & Steiner LLP showcased its increased depth when 33 partners were selected as "The Best Lawyers in America" in October. The firm also stood out as having the most lawyers in the country selected in the areas of Construction and Information Technology. Other practice groups from which attorneys were selected include: Energy; Tax, Trusts and Estates; Structured Finance; Employee Benefits; Antitrust; Commercial Litigation; and Project Finance.

Twelve attorneys from the firm's Construction group were selected as "Best Lawyers," the most for any firm. The Construction practice also ranked #1 in California and New York. The firm also had the highest number of attorneys selected in Information Technology. That group was also tops in New York, as was the number of Energy lawyers. Attorneys named "Best Lawyers" came from five of the firm's eight offices.

"To me, the numbers are indicative of the depth of the new firm and its diverse strengths," said firm Co-Chair Stephen V. O'Neal. "This is why we did the merger."

Thelen Reid Brown Raysman & Steiner was created through the merger of Thelen Reid & Priest and Brown Raysman Millstein Felder & Steiner.

Thelen Reid and Brown Raysman Now One Firm
Thelen Reid & Priest LLP, a national leader in construction, energy, and project finance law, and Brown Raysman Millstein Felder & Steiner LLP, a pioneer in technology law with one of the country's premier real estate finance practices, began operating as a single entity today under the new banner Thelen Reid Brown Raysman & Steiner LLP.

The decision to merge the two firms was announced October 30 and brings together Thelen Reid's unparalleled reputation in such traditional areas as construction, energy, and litigation with Brown Raysman's nationally recognized practices in technology, outsourcing, intellectual property, e-commerce, media, and communications. The combined firm has 630 lawyers in eight offices.

The response to the merger announcement has been extremely positive, as the combined firm provides clients with access to a broad base of integrated services. This includes the combination of Thelen Reid's leading finance practices in the areas of energy, infrastructure, and project finance, together with Brown Raysman's real estate finance practice, which closed $25 billion in loans in the past several years for leading Wall Street financial institutions, money center banks, and hedge funds.

The combined firm ranks in the top 50 on the Am Law 100 and has a national footprint, with offices in major markets of the United States. According to The Lawyer (UK), the new firm would rank 66th in their 2006 Global 100 list. The firm has a total of eight offices—seven in the United States and one recently opened in Shanghai—and a well-balanced national platform with 255 attorneys in California and 373 lawyers on the East Coast, including 247 in New York.

The new firm is led by an Office of the Chair, with Thelen Reid's Stephen V. O'Neal and Brown Raysman's Julian S. Millstein as Co-Chairs and Thelen Reid's Thomas E. Hill as Managing Partner of Operations.

"This a historic day for both legacy firms, and the response from clients has been overwhelmingly positive," said Thelen Reid Chairman O'Neal. "We are at critical mass in all of our markets and now have one of the largest New York offices of any national firm."

Millstein, a Brown Raysman founding partner, said the creation of the new firm was an amazing opportunity for all involved. "It is such a perfect fit in terms of practice strengths, key markets and culture," Millstein said. Steve Cosentino was presented with the 2006 YLS President's Award for his outstanding contributions to the Young Lawyer's section of KCMBA and to the area community. The President's Award is given to individuals who go beyond their committee duties to help make the KCMBA YLS stronger and better.
