The Federal Circuit’s Approach to Analyzing “Motivation to Combine.”
The Federal Circuit recently provided guidance about the potential sources that may be used to establish a “motivation to combine” prior art references. Specifically, in DyStar Textilfarben GmbH & Co. Deutschland KG v. C.H. Patrick Co., 464 F.3d 1356 (Fed. Cir. 2006), the Federal Circuit held that the motivation “need not be found in the references sought to be combined, but may be found in any number of sources, including common knowledge, the prior art as a whole, or the nature of the problem itself.” Id. at 1361.

Forum Shopping: Litigation in the Eastern District of Texas. 2006-12-01
Several factors may be attributed to the rapid rise in popularity of the Eastern District of Texas in recent years. Particularly, jurors selected from the counties enclosed within the jurisdictional borders of the Eastern District have historically favored plaintiffs when sitting in civil cases. As such, would-be plaintiffs shopping for a strategically favorable venue to try their cases often place the Eastern District of Texas at the top of their (short) lists. In addition, the Eastern District of Texas has developed a reputation as a venue with a rapid docket for civil cases and, in particular, rapid disposition of patent infringement cases. Whereas other venues in the United States may take in excess of three years to adjudicate a patent case, the Eastern District of Texas currently boasts an average time between about 12–15 months from filing of the petition to final disposition.

SW Adds to its Lansing Team
Secrest Wardle has hired a new Lansing attorney, Christian Odlum.

Mr. Odlum received his Juris Doctor degree from Thomas M. Cooley Law School in 1996. He received his bachelor of arts in Business/pre-law from Michigan State University in 1992. He was admitted to State Bar of Michigan in 1996.

Mr. Odlum has extensive trial experience with more than 20 jury trials that have gone to verdict. He previously served as an officer for the Ingham County Bar Association. He serves as a mediator in Ingham, Eaton, Clinton and Jackson Counties. He is admitted to practice in the Federal Courts of Michigan.

Mark E. Trademark Dilution Revision Act of 2006.
U.S. President George W. Bush signed into law the Trademark Dilution Revision Act of 2006 (“the Act”.) The Act amends the Trademark Act of 1946 with respect to dilution and is a response to the ruling of the Supreme Court in Moseley v. V Secret, 537 U.S. 418 (2003), as well as many splits in the federal circuits relating to the current dilution statute and the protection of famous marks in the United States.
