Britney Spears’ Public Behavior Impacts Custody Case?
Dylan Mitchell, matrimonial attorney in Blank Rome’s New York office, was called upon by FoxNews.com to comment on entertainer Britney Spears’ public partying, preceding her anticipated divorce from Kevin Federline and custody case for their two children. Ms. Spears was recently photographed leaving a dance club without undergarments. “Her behavior is potentially creating an issue that shouldn’t otherwise exist,” said Mr. Mitchell. “She could give Mr. Federline some leverage. If she continues like that, he could turn around and say, she’s never home and other people are parenting the children.”

However, if Mr. Federline uses this opportunity to claim that Ms. Spears is an unfit parent and the courts perceive that his motives are primarily financial, that tactic might not work. “Some people use custody as a way to a better financial settlement,” said Mr. Mitchell. “The courts abhor such behavior.”

Mr. Mitchell’s recommendation is that Ms. Spears “mind her Ps and Qs. Everybody’s watching—not only the news media and the paparazzi, but the judge. Now is not the time to party. Now is the time to be Super Mom. If she were my client, that’s what I’d tell her to do.”

Weil Gotshal Partner Discusses Erbitux Patent Battle
The landmark patent case over the breakthrough cancer drug Erbitux pitted Yeda Research & Development Co. against Imclone Systems Inc. in a battle for patent rights to the drug. In an article profiling Weil, Gotshal & Manges partner Nicholas Groombridge, the attorney who successfully represented Yeda in the matter, Mr. Groombridge provides first-hand insight into the case. According to Mr. Groombridge, “the case had a uniquely compelling human interest story . . . this was a much more personal type of case.” Mr. Groombridge adds that the trial court’s decision, granting complete ownership rights to Yeda, was particularly satisfying because his clients “had given their lives over to research [and] deserved to be acknowledged for what they’d done.” Although Imclone filed a declaratory judgment seeking invalidity of the patent, Mr. Groombridge believes that the matter will be resolved without any further court room battles.

Paul Hastings Advises Bear Stearns In $265 Million Financing For Philadelphia Park Casino
Paul, Hastings, Janofsky & Walker LLP (Paul Hastings), a leading international law firm, represented Bear, Stearns & Co., Inc. in a $265 million financing in connection with the opening of a slot machine casino to be located at Philadelphia Park Racetrack in Bensalem, Pennsylvania. On September 27, 2006, the Philadelphia Park Racetrack was awarded a slots license by the Pennsylvania Gaming Control Board allowing it to operate a slot machine casino at the racetrack. The casino is scheduled to open in December 2006. The Paul Hastings team was led by partners William Schwitter, Michael Chernick and Katherine Lipton and associates Rick Denhup, Elan Daniels, Jesse Hiney and Lee Reeves.

Paul Hastings Advises Arrangers on Indonesia's Biggest Debt Sale
Paul, Hastings, Janofsky & Walker (Paul Hastings), a leading international law firm, represented UBS and Jakarta-based securities firm Danareksa, the lead arrangers on PT Perusahaan Listrik Negara's (PLN's) US$1 billion Reg-S/144A international high yield bond offering. The offering was structured into two tranches, US$450 million five-year bonds and a US$550 million 10-year bonds priced at a yield of 7.4% and 7.9% respectively.

This deal marks Indonesia's largest international corporate debt sale and is one of the largest corporate high yield issuances in Asia to date.

PLN, Indonesia's 100% state owned electricity company, is raising money to finance its capital expenditure plans to reduce Indonesia's energy production costs by switching from oil fired electricity generation to coal fired.

Commenting on the deal, Joe Sevack, Corporate partner at Paul Hastings focusing on sophisticated equity and debt capital markets transactions, said, "This is a landmark transaction for PLN as an international issuer, and will provide a strong basis for its future financings."

Fulbright Partner Appointed Honorary Lecturer at University of Dundee
Arif Ali, partner in Fulbright’s international arbitration and ADR practice group, has been appointed Honorary Lecturer in the Centre for Energy, Petroleum & Mineral Law & Policy (CEPMLP) at the University of Dundee in Scotland. He will serve in the position until May 31, 2009.

Ali, a partner in Fulbright’s Washington office, is also an Adjunct Professor of Law at Georgetown University, where he teaches international commercial and investment arbitration.

Ali’s international dispute resolution experience and client representation spans continents and cultures, national political establishments and inter-governmental organizations, private companies and state-owned enterprises, sovereign governments and private individuals. He has represented parties from more than 30 countries on five continents in international commercial and investment arbitrations involving thermal, nuclear and hydro power plants, oil and gas pipeline construction and concession-related matters, patents and trademarks, and information technology.

He has also represented parties before inter-governmental tribunals, including the United States-Iran Claims Tribunal and the United Nations Compensation Commission. As a result of his role in the representation of the State of Bahrain in its territorial and maritime border dispute with the State of Qatar before the International Court of Justice, in 2001, Arif was decorated by the King of Bahrain with the Order of Bahrain (II).

A 1990 graduate from the New York University School of Law, where he was awarded the Vanderbilt Medal and was a research assistant to Professor Andreas F.Lowenfeld, a member of the Annual Review of American Law, and president of the International Law Students Association.

He received his bachelor’s degree in political science from Columbia University, graduating summa cum laude. While attending Columbia University, Arif was elected to the Phi Beta Kappa Honors Society. Arif speaks seven languages, including French, Portuguese, Spanish, Hindi, Urdu and Bengali.

The CEPMLP is one of the world's leading, and Europe's largest, institutions in its field. It offers postgraduate programs and also hosts a series of interdisciplinary seminars every year on various aspects of the national and international oil, gas, water, mining and energy industries. The Centre also conducts research activities and is currently advising the Economic and Social Research Council (ESRC) on future research priorities focusing on the security of international oil and gas supplies and on the capacity of UK research institutes to undertake that research.

Mary Streitz on Keweenaw Bay Indian Community Victory Over Michigan Tax Commission
Dorsey partner and tax litigator Mary Streitz described to Indian Country Today the significance of the Keweenaw Bay Indian Community's legal victory over the Michigan State Tax Commission. The U.S. Supreme Court denied the State of Michigan petition for review of a U.S. Sixth Circuit Court of Appeals decision that denied the state the right to collect property taxes assessed on reservation property.

Streitz said that the verdict was simply about upholding the 1854 treaty with the Chippewa at La Pointe, which created the L'Anse Reservation of the Keweenaw Bay Indian Community. She also said that as a result of the decision the local surrounding communities will lose approximately $200,000 of casino revenue the tribe had previously agreed to contribute.
