Former Assistant United States Attorney Kenyanna M. Scott Joins Jenner & Block’s Chicago Office as a Partner
Kenyanna M. Scott has joined Jenner & Block’s Chicago office as a Partner in the Firm’s Litigation Department. After serving in the United States Attorney’s Office in Chicago for the past four years, Ms. Scott brings extensive experience as a federal criminal prosecutor and trial attorney to the Firm.

During her term as an Assistant United States Attorney, Ms. Scott tried 12 cases to verdict and argued nine cases before the U.S. Court of Appeals for the Seventh Circuit. She represented the United States in investigating, as well as prosecuting, violations of federal criminal law, including matters involving complex fraud, bank fraud, criminal tax, narcotics, immigration, firearms, child pornography, internet piracy and bank robbery.

Prior to her career as a federal prosecutor, Ms. Scott was a civil trial attorney at Chapman and Cutler in Chicago, where she represented financial institutions in commercial litigation, including matters involving consumer finance, mortgages and class actions. "It is rare for a trial attorney to have so much experience in complex civil as well as white collar crime trials, so we are greatly pleased about Kenyanna joining our litigation team and adding to its bench strength," said Anton R. Valukas, Chair of the Firm's White Collar Criminal Defense and Counseling Practice as well as a member of its Policy Committee.

Ms. Scott served as clerk to the Honorable Carol Jackson, U.S. District Court for the Eastern District of Missouri after obtaining her law degree from Northwestern University School of Law in 1999, where she was senior editor of the Northwestern University Law Review.

Ms. Scott is currently Vice President of the Black Women Lawyers’ Association of Greater Chicago, Inc., and an Executive Board Member of the Chicago Bar Association Alliance for Women.

New Amendments to the Federal Rules of Civil Procedure Relating to E-Discovery, Effective December 1, 2006
New amendments to the Federal Rules of Civil Procedure relating to the discovery of electronically stored information (ESI) went into effect today. The changes are designed to ensure that parties address early in litigation issues surrounding the disclosure, preservation, and production of ESI. The new rules permit the party seeking discovery to specify in the first instance the form in which ESI is produced, and they specifically recognize a party's right to seek to test or sample such data. The new rules also provide certain protections to the party from whom discovery is sought, such as the right to resist discovery on the grounds that ESI is inaccessible because of undue burden or cost. Finally, the rules encourage federal district court judges to address issues related to ESI in pretrial scheduling orders, and they also encourage the parties to address up front the problems that production of massive amounts of ESI pose for privilege reviews and inadvertent production.

Leading Tax Partner Joins Hogan & Hartson to Launch Moscow Tax Practice
Hogan & Hartson LLP has expanded its Moscow operations with the addition of prominent tax partner Ilya Rybalkin. Rybalkin, who has extensive experience advising on Russian and international tax issues in cross-border mergers and acquisitions; corporate restructurings, including pre-listing restructurings; financial projects; and private equity and real estate fund structuring; is initiating the firm’s Moscow tax practice.

Rybalkin’s practice focuses on international and domestic tax issues, with an emphasis on tax efficient cross-border financing structures. He advises major Russian companies on structuring their international operations, and he advises international companies on the planning and implementation of tax-driven investment structures in Russia. Rybalkin also advises clients in a wide range of industries, including oil & gas, downstream, automotive, real estate, and food.

Peter Pettibone, managing partner of the firm’s Moscow office, is enthused about the move. “Ilya is an excellent addition to Hogan & Hartson, both personally and professionally. Previously, he worked on some tax matters for our firm’s clients. There are synergies in better serving those clients, as well as reaching out to new ones.”

“By extending our tax capabilities to Moscow, Hogan & Hartson now is one of the few global law firms to offer integrated international legal and tax advice in multi-jurisdictional transactions,” said J. Warren Gorrell, Jr., chairman of Hogan & Hartson.

Rybalkin joins from the Moscow office of a Munich-based international law firm. With his German business background and German language capabilities, he looks forward to working closely with the firm’s Berlin and Munich offices.

Rybalkin has been recognized for his accomplishments as a tax lawyer by the European Legal 500.

Worth Magazine's Top 100 Attorneys
Again this year, Robert Vigoda and Jason Marshall were selected as two of Worth Magazine's Top 100 Attorneys in the country in the magazine's December 2006 edition. Worth compiled nominations from financial advisors, family office executives, accountants, consultants, academics and subscribers to produce the Top 100 Attorney listing. Mr. Vigoda and Mr. Marshall focus their practices on high net worth individuals in areas such as estate planning and administration. Mr. Vigoda was recognized specifically for his practice in trust & estates, philanthropy and business succession, while Mr. Marshall was recognized in the areas of trust & estates, tax and fiduciary advice.

Chadbourne Represented China National Petroleum Corporation in the Sale of an Interest in the Strategic Shymkent Refinery in Kazakhstan to KazMunaiGas
Chadbourne & Parke represented CNPC International Limited, a wholly-owned subsidiary of China National Petroleum Corporation, as the lead counsel in a further transaction that forms part of the US$1.3 billion sale of 33% of the shares of Petrokazakhstan, Inc. to JSC KazMunaiGas (KMG - the Kazakhstan state oil and gas company).

In this, most recent, part of the deal, CNPCI and KMG signed two agreements on November 16: a share purchase agreement under which CNPCI and KMG each agreed to acquire 50% of Valsera Holdings B.V. and a shareholders’ agreement for that company which is conditional on the sale closing. Valsera is the parent company of PetroKazakhstan Oil Products, the company that owns the Shymkent oil processing plant. The agreements also outline the principles on which the parties will jointly conduct the business of the Shymkent refinery.

The value of the refinery sale was not disclosed. The refinery is the most up-to-date processing plant in Kazakhstan, and produces nearly 5.5 million tons of oil products annually.

The deal was led for Chadbourne by London partner Charez Golvala, with assistance from Almaty office managing partner Kenneth Mack, Almaty associates Victor Mokrousov and Alexandra Neovius and London partner Claude Serfilippi.

In phase one of the deal, KMG acquired the 33% of the shares of Canada-based Petrokazakhstan, Inc. on July 5, 2006. CNPC, which is China's biggest oil producer, had acquired Petrokazakhstan in October 2005 for US$4.2 billion, in one of the largest overseas M&A deals by a Chinese company.

Claudia Schlosberg Receives HIMSS Award
Claudia Schlosberg, healthcare and health IT partner, has been chosen by the Healthcare Information and Management Systems Society (HIMSS) as the recipient of the November 2006 “Spirit of HIMSS” Award. This award honors contributions and volunteer efforts which allow HIMSS to advance and improve as a society and as an industry.

HIMSS president H. Stephen Lieber praised Ms. Schlosberg, saying she is “particularly recognized for [her] efforts with the Stark and Anti-kickback regulations.” He added that Ms. Schlosberg has “gone above and beyond by educating the HIMSS member community and taking a non-technical leadership role in helping us to understand the complexities and applications of the new regulations.”

The Healthcare Information and Management Systems Society is the healthcare industry’s membership organization exclusively focused on providing global leadership for the optimal use of healthcare information technology and management systems for the betterment of healthcare.

Ms. Schlosberg focuses on healthcare legislative and regulatory matters, helping providers, payers, vendors, and public entities comply with federal law and regulation, and affect policy changes to meet their objectives.
