Four Jones Day Partners Named to BTI Client Service All Star List
Jones Day partners Mary Beth Deemer (Pittsburgh), Paul (Mickey) Pohl (Pittsburgh), David Porter (Cleveland), and Phil Proger (DC) were named among the BTI Client Service All-Stars for 2006, which honors individual attorneys providing outstanding client service. This is the second year Mary Beth Deemer made the list earning her "MVP" status in the report. BTI surveyed more than 250 corporate counsel at Fortune 1000 and other large companies. The lawyers that make this list have been singled out - by name and completely unprompted - as delivering the absolute best client service.

Jones Day Wins Appellate Victory In Case Seeking To Reform Alaska Foster Care System
Jones Day lawyers won an interlocutory appeal before the Alaska Supreme Court in State of Alaska et al v. Native Village of Curyung, et al., Ak. S.Ct. No. S-11355. Jones Day is co-counsel with Alaska Legal Services Corporation. The suit is brought on behalf of four Alaskan Indian tribes to remedy alleged systematic violations by the State of Alaska in its treatment of native children in state custody. The Tribes allege that when tribal children are placed in State custody, it is very common for the State to send the children far from home and from relatives, to place them in emergency shelters rather than home-like settings, and to repeatedly move them from placement to placement. The State's alleged conduct is tremendously harmful to the children and their communities, and violates rights granted by a number of statutes, including the Adoption Assistance and Child Welfare Act and the Indian Child Welfare Act. After the defendants moved to dismiss on numerous grounds, Jones Day led the effort to oppose the motions. Ted Bilich of Jones Day's Washington Office argued the motions, both before the trial court and the Alaska Supreme Court. Assisting him on briefing were Peter Wang of the Shanghai Office, and Jonathan Berman and Chris Farrell in Washington.

The Defendants' motion raised a series of complex procedural arguments, challenging the plaintiffs' standing to bring suit under 42 U.S.C. section 1983, asserting that certain defendants were shielded by sovereign immunity, and arguing that the substantive laws in question could not be enforced by their intended beneficiaries. The trial court largely denied the motions to dismiss. The Alaska Supreme Court granted an interlocutory review on the State's petition. In a published opinion (No. 6083, December 15, 2006), the Alaska Supreme Court affirmed virtually all of the disputed issues, allowing the case to proceed.

Jones Day Secures Appellate Victory For Georgia Tech Facilities
In Holder Construction Group, LLC v. Georgia Tech Facilities, Inc., A06A13806 (Ga. Ct. App. Oct. 3, 2006), the Court of Appeals of Georgia unanimously upheld the trial court's decision granting partial summary judgment to Georgia Tech Facilities, Inc. in a case involving the construction of a student housing complex on the Georgia Tech campus. The general contractor for the project, Holder Construction Group, brought suit against Georgia Tech Facilities seeking $5.7 million in damages and other relief relating to various issues that arose during the project, including construction delays allegedly caused by an escalation in steel prices and a claimed unavailability of steel. Both Holder and Georgia Tech Facilities moved for summary judgment on these steel-related issues as well as a number of Holder's change order and allowance requests. The trial court granted Georgia Tech Facilities' motion and denied Holder's. Holder appealed.

Before the Court of Appeals, Jones Day argued on behalf of its client, Georgia Tech Facilities, that the construction contract's force majeure clause placed the risk of the unavailability of materials squarely on the general contractor and precluded any claim relating to steel availability. The Court of Appeals agreed, concluding that "under the contract, Holder bore the risk of the late delivery of steel . . . ." The Court went on to hold that because "Holder was not entitled to an extension of time due to problems with the late delivery of steel, it follows that the trial court did not err in granting summary judgment to [Georgia Tech Facilities] on Holder's claim for acceleration costs."

On December 8, 2006, the Court of Appeals denied Holder's motion seeking reconsideration of the Court's October 3, 2006 decision.

Texas Appleseed Recognizes Jones Day For Pro Bono Hurricane Relief Work
Texas Appleseed presented Jones Day with a Special Recognition Award last month for its pro bono hurricane relief work in 2006. Michael Gibson and Melissa Hagan of the firm's Houston Office accepted the award at the Austin ceremony, where Houston Mayor Bill White praised the firm for devoting a large number of hours to ensure that evacuees from Hurricane Katrina would have access to housing and basic utilities.

Appleseed is a national organization and one of the largest pro bono networks in the U.S. In September 2006 Appleseed named Jones Day "Pro Bono Champion of the Year" for its long-standing commitment to providing pro bono services

Jones Day Named Highly Recommended Firm in PLC's Life Sciences Handbook
For the third year in a row, Jones Day has been named a "Highly Recommended Firm" in the Life Sciences Handbook published by the The Practical Law Company (PLC) for the 2006/2007 year, and two prominent lawyers have also been recognized as leaders in the industry. Dr. Laura Coruzzi , Chair of the Jones Day Life Sciences Practice, was given top honors of Leading Lawyer in the Intellectual Property category.Sophie Hagège , Partner in the Paris Office, has been named a Highly Recommended Lawyer in the Corporate and Commercial category.

Chambers Global Names 56 from Jones Day as "World's Leading Lawyers"
Chambers Global has listed 56 Jones Day attorneys for its 2007 annual directory of "The World's Leading Lawyers," up seven from the 2006 list. Lawyers are ranked on a scale of 1-6 ("1" being the best). The qualities on which rankings are assessed include technical legal ability, professional conduct, client service, commercial awareness/astuteness, diligence, commitment, and other qualities most valued by the client. Highlights from the 2007 rankings include:

* Jones Day lawyers and/or practices were named in 14 markets around the world.
* For the U.S. region, Jones Day scored a "1" ranking in the Competition/Antitrust category.
* For the Europe region, and for the second year in a row, the Paris Office had all practices (14) listed.
* In Belgium, the Firm received a "1" ranking in the TMT category (Technology-Media-Telecommunications).
* In Singapore, the Firm received a "1" ranking for its Dispute Resolution practice.
* In all, six Jones Day lawyers received a "1" ranking, and 17 received a "2" ranking individually.
* Jones Day's Bernard Amory again received a "*" ranking, indicating "exceptional recommendations in (his) field."
