Tim McKeen Joins Steptoe & Johnson PLLC
Timothy M. McKeen has joined the Litigation Department of Steptoe & Johnson PLLC practicing in the firm’s Wheeling office as an associate. McKeen will focus his practice in the area of litigation. He graduated cum laude from Washington & Lee, where he was the winner of the Robert Grey Negotiation Competition in 2005 and 2006. McKeen received his undergraduate degree in political and economic philosophy from Wheeling Jesuit University in 2003 graduating summa cum laude and is also a 2000 graduate of Linsly School.

Senniger Powers and RSM McGladrey will co-host "Manufacturing and Innovation: Leading the Path to Success," a St. Louis Business Journal-sponsored seminar. The event will focus on the challenges and opportunities for the manufacturing industry in the year ahead. Speakers at the event will include Edward J. Hejlek, managing partner for Senniger Powers; Tom Murphy, Executive Vice President of Manufacturing, Wholesale & Distribution for RSM McGladrey; and Eric Ashleman, Chief Executive Officer of Schutt Sports Manufacturing.

Firm attorney speaks to Charleston Apartment Association
Attorney Frank Blanchard was the featured instructor at a day-long seminar conducted by the Charleston Apartment Association on November 14, 2006. Mr. Blanchard covered various legal aspects and responsibilities applicable to apartment managers. The class was sponsored by the National Apartment Association Education Institute (NAAEI) and was attended by local apartment managers from the tri-county area. The class is one of nine modules that participants will complete to receive the Certified Apartment Manager (CAM) designation.

Miller & Chevalier Secures Significant Tax Controversy Victory
Miller & Chevalier Chartered successfully represented Kohler Co. in a tax controversy dispute with the Internal Revenue Service (IRS). On November 21, the 7th Circuit Court of Appeals upheld a ruling made by a U.S. District Court last year, determining that the IRS owes Kohler a refund of $3.35 million for overpayment of tax on a Mexican transaction.

In the 1990s, Kohler purchased a $22.4 million Mexican government debt for $11.1 million. Mexico exchanged the debt for a credit in pesos valued at $19.5 million that Kohler could use only towards construction of a plant in the country.

The IRS charged Kohler capital gains tax on the difference between the $19.5 million credit and the $11.1 million purchase. Both the U.S. District Court and 7th Circuit Court of Appeals judges disagreed with the IRS, ruling that the government must refund Kohler the $3.35 million paid in 1994 and 1995 as well as interest accrued.

The trial team representing Kohler was led by Herbert Odell and Philip Karter, members in the firm's Philadelphia office. McDonald Hopkins Attorney Appointed to Board of Directors
We are proud to announce that James E. Stief, a shareholder in the Business Department of the law firm of McDonald Hopkins was recently appointed to serve on the Board of Directors of Deepwood Industries Inc. Located in Mentor, Ohio, Deepwood Industries is an independent nonprofit organization that services and supports business and industry with the help of individuals with disabilities who are enrolled at the Lake County Board of Mental Retardation and Developmental Disabilities.

Jim was elected Corresponding Secretary and will serve a three-year term, commencing November 2006.

13 new equity partners at McCarthy Tétrault
McCarthy Tétrault Chair and CEO Iain Scott today announced that the firm has promoted 13 of its lawyers to equity partner. The new equity partners represent a cross-section of the firm's practice groups. An additional 22 lawyers were made income partners.

Levenfeld Pearlstein Helps Plaintiffs Secure $15 Million Settlement in Environmental Class Action
Levenfeld Pearlstein LLC today announced that James D. Brusslan, head of its Environmental Law Service Group, has helped to secure a settlement of more than $15 million on behalf of more than 800 families in an environmental class action lawsuit. The lawsuit had been filed against 13 tenants of the Ellsworth Industrial Park in the Chicago suburb of Downers Grove, Ill., alleging that toxic chemicals generated by the defendants had seeped into the plaintiffs’ private drinking water wells. Judge John Darrah of the United States District Court for the Northern District of Illinois approved the settlement in November and the proceeds will be distributed to class members this month.

The lawsuit sought damages for loss of property value, aggravation and annoyance, costs for bottled water and medical monitoring. Under the settlement, class members with measured levels of contaminants in their water which exceed the EPA's maximum allowable contaminant levels will receive approximately $31,000 per household. Other class members with lower or no detectable levels will receive less. All exposed class members are also eligible for free medical testing.

For several years, many residents of the area near the industrial park had been drinking and bathing with groundwater from private wells that was contaminated with solvents, including trichloroethylene and perchloroethylene, which are known to cause cancer. In 2001 state Environmental Protection Agency (EPA) tests found that the levels of chemicals in the wells exceeded maximum federal safety standards, tracing the source of the pollution to the industrial park. Following the EPA’s findings, impacted residents were forced to purchase bottled water and use it for drinking and bathing their children. In addition, many had to shower with their windows open in order to avoid breathing toxic fumes.

In 2003, DuPage Country, where the impacted homes were located, worked with the U.S. and Illinois EPAs, the DuPage County Water Authority, the Village of Downers Grove, and the responsible companies, to convert the residents’ homes from well water to Lake Michigan water.

“We are pleased to have assisted the residents impacted by the Ellsworth Industrial Park contamination in obtaining a fair settlement to help offset the inconveniences and medical worries which they were forced to endure.
