Weil Gotshal Chairman Honored by the Inner City Scholarship Fund
Weil, Gotshal & Manges Chairman Stephen J. Dannhauser was honored by the Inner City Scholarship Fund at their 30th Annual Award Dinner. Mr. Dannhauser was cited for his exemplary work on behalf of the New York Police and Fire Widows' & Children's Benefit Fund, as well as for his long-standing commitment to maintain New York City's position as the global center of commerce, culture and innovation. The dinner was attended by Edward Cardinal Egan, major figures in New York's Catholic education community and prominent New York business, financial services and civic leaders.

The Inner City Scholarship Fund was created in 1971 and has assisted hundreds of thousands of children living in the poorest neighborhoods of New York City since its formation.

While at Kirkland & Ellis, he served in various management capacities including the firm management committee, chair of the compensation committee, co-chair of the finance committee, as well as other important management roles. Bill has led the legal representation of hundreds of large and complex private equity transactions including acquisitions of Boise Cascade and Jefferson Smurfit Group by Madison Dearborn Partners. During his career, Mr. Kirsch represented such private equity clients as Audax Group, Bank of America Global Equity Group, CIVC Partners, Madison Dearborn Partners, Olympus Partners, Providence Equity Partners, Sun Capital Partners, Thomas H. Lee Company, Willis Stein & Partners and others. While at Kirkland, Mr. Kirsch served as General Counsel of Madison Dearborn Partners from 1999 through 2004 and also served as a member of the advisory committee of Sun Capital. FDA Citizen Petitions: A New Means of Delaying Generic Entry?
O'Melveny counsel Darren Tucker recently published the article "FDA Citizen Petitions: A New Means of Delaying Generic Entry?" in the ABA's Antitrust Health Care Chronicle.

Citizen petitions are designed to alert the FDA to possible scientific and safety issues related to regulated products or agency procedures. Generic pharmaceutical companies have alleged that branded pharmaceutical companies have improperly used citizen petitions to block or delay entry of generic competitors by raising frivolous or untimely concerns about generic companies' Abbreviated New Drug Applications.

The article discusses the regulatory landscape concerning such petitions; the potential competitive implications of filing them; the Noerr issues posed in this context; FDA and FTC views on this issue; and proposed legislation to reform the process.

The article concludes that "despite the recent attention, there is little evidence that citizen petitions by branded manufacturers have injured competition" and that "private actions to challenge this practice are likely to face significant obstacles.

ABA-Commissioned Dorsey Study on Immigration Policy is Noted in ABA Immigration Report
In an article on the inconsistent application of immigration law by Department of Justice immigration judges, the ABA Journal notes the findings of a 2003 Dorsey study of procedural reforms to improve case management by the Board of Immigration ("BIA"), an administrative judicial body designed to review appeals of the immigration judge rulings.

The study, commissioned by the American Bar Association Commission on Immigration Policy, Practice and Pro Bono, concluded that while certain procedural reforms initiated by then Attorney General John Ashcroft had made a dent in the backlog of immigration appeals, the changes themselves were insufficient.
