Dickstein Shapiro LLP’s Intellectual Property Team Thwarts Infringement Claim Regarding Surgical Sutures
Dickstein Shapiro LLP is pleased to announce a significant victory in a four-year patent infringement battle that resulted in a favorable verdict for the firm’s client Arthrex, Inc. The case, DePuy Mitek, Inc. v. Arthrex, Inc., began in 2003 when Arthrex was accused of patent infringement regarding the development of its FiberWire® surgical sutures. Due to its incredible strength, this new suture revolutionized arthroscopic surgery procedures, providing new opportunities for advancement within the medical field, specifically in sports medicine.

“We are thrilled with the result,” said Charles Saber, lead attorney from Dickstein Shapiro, and partner in the firm’s Intellectual Property Practice. “I am extremely proud of the dedication and hard work of the entire Dickstein team from the day the case began right through the day the jury reached its verdict. Our success was a direct result of that dedication and ingenuity, which allowed us to develop and present to the jury the evidence that proved that Arthrex did not infringe on the patent.”

As a result of this victory, Dickstein Shapiro protected its client from a potential loss of hundreds of millions of dollars—money that now can be used for important research and product development. Lead attorney Charles Saber was assisted by Dickstein Shapiro attorneys Salvatore Tamburo, and Rebecca Barbisch.
