Shawn T. Wooden Named Partner
Day, Berry & Howard LLP, a leading full-service law firm with offices in New York, Boston, Connecticut and Washington D.C., announced today that it has elevated Shawn T. Wooden to the position of partner effective January 1, 2007. Wooden joins the firm's current eight partners based in the New York office and he spends a substantial amount of time in the firm's Connecticut offices.

Wooden originally started with Day, Berry & Howard as a summer associate while still in law school. After graduation, he was hired full-time and since has had a nine year tenure with the firm. He has been active in firm recruitment, was a summer associate coordinator and serves as a member of the firm's Diversity Committee.

"We are pleased to welcome Shawn to the partnership," said Jim Sicilian, chair of the executive committee for Day, Berry & Howard. "Day, Berry & Howard has had the opportunity to watch Shawn grow from summer associate to an accomplished attorney in his chosen practice area of investments and corporate securities law. As we look ahead to our future as Day Pitney LLP after our planned merger with Pitney Hardin LLP becomes effective on January 1, 2007, Shawn's position will be instrumental in further strengthening the combined offerings of the merged firm."

Wooden's practice focuses on investment, general corporate and securities law with an emphasis on institutional investments, formation and regulation of private equity and hedge funds, and investment advisory counseling. His clients have ranged from large institutional investors to individually sponsored hedge funds. Wooden has represented private equity funds and large companies in mergers and acquisitions, as well as entrepreneurs in early-stage ventures and closely held businesses seeking to grow. He has also served as special advisor for corporate transactions in the AFL-CIO's Office of Investment in Washington, D.C.

Wooden is a member of the National Association of Public Pension Attorneys and has been named one of the "Twenty-Five Investment Professionals to Watch" by Pensions and Investments Magazine. In 2004, he received the Connecticut Law Tribune's New Leaders of the Law "Community Contributions" Award. Wooden received his J.D. from New York University School of Law and his B.A from Trinity College. A native of Hartford, Connecticut, he currently lives in New York City with his wife and two sons.

Kroll Moderates Panel Discussion at BIA 2006 Energy Seminar
Heidi Kroll, a market and policy analyst at Gallagher, Callahan & Gartrell, P.C., recently moderated a panel at the NH Business and Industry Association’s 2006 New Hampshire Energy Seminar. Gallagher, Callahan & Gartrell was a sponsor and an exhibitor at the event.

The panel was comprised of representatives from ISO New England, GDS Associates, Constellation New Energy, PSNH, and Ocean National Bank, who shared practical advice on how businesses can save money, reduce or manage their energy use, improve their day-to-day operations, and enhance their environmental stewardship.

Kroll kicked off the discussion with these key statistics:

* Currently in N.H., over 600 businesses buy power from competitive electricity suppliers
* Since June of 2002, electric utilities have provided technical and financial assistance to approximately 4,400 energy efficiency projects undertaken by NH businesses.

Panelists discussed various programs and initiatives related to demand response, energy efficiency, and low-interest loans.

The BIA seminar — held on December 5th — focused on educating New Hampshire businesses about the many tools and options available to them to help manage their energy bills. Competitive supply options and renewable energy technologies and policies were also discussed. PUC Chairman Tom Getz, the lunchtime Keynote Speaker, spoke about the need for expanded efforts on conservation and energy efficiency in New Hampshire and called for a public/private partnership to move efforts forward on a statewide basis.

SCHIFF HARDIN LLP WELCOMES MICHAEL J. LOTUS AS COUNSEL IN THE CHICAGO OFFICE
Schiff Hardin LLP has added Michael J. Lotus as counsel in the Construction Group in the Chicago office. He joins our firm from the Winston & Strawn in Chicago, where he was a partner.

Mr. Lotus applies his extensive experience in a wide range of commercial cases to a broad array of construction disputes.

His pro bono work has included first chairing the defense of a criminal matter in a jury trial. He also has handled personal injury cases.

Mr. Lotus received his undergraduate degree (A.B., Economics, 1985) from the University of Chicago and his law degree (J.D., cum laude, 1993) from Indiana University Law School, where he was a member of the Indiana Law Journal. He was a judicial clerk for the Honorable Michael S. Kanne, U.S. Court of Appeals, Seventh Circuit (September 1993 - August 1994).

He is admitted to practice in Illinois, as well as before the U.S. District Court for the Northern District of Illinois and the U.S. Court of Appeals for the Seventh Circuit.

“Lawyers Eye Broad Impact From IPO Case”
Sullivan & Cromwell partner Ted Rogers was quoted in an article entitled, "Lawyers Eye Broad Impact From IPO Case," in which he notes that a recent Second Circuit decision in a high-profile securities class action is "likely to have a significant impact on employment litigation as well" because the court rejected the notion that had been adopted in some employment class actions that the employer's evidence in opposition to class certification should not be considered if it touches on the merits of the claims.

School district and office of education successfully defended in a $7 million negligence and intentional tort claim
McCormick Barstow attorney Jeffrey Olson successfully defended the San Joaquin County Office of Education, the Manteca Unified School District and one teacher in a negligence and intentional tort claim brought by a deaf high school student.

The student alleged that she was raped in the girls bathroom at school by her brother, who is also deaf and disabled. She was seeking $7 million in damages.

The trial, which lasted six weeks, took place in San Joaquin Superior Court in Stockton, CA. The jury deliberated for approximately four hours and returned a defense verdict.
