Robinson & Cole LandLaw Attorney Presented to REBA Environmental and Commercial Real Estate Finance Committee
R&C LandLaw attorney Christopher Foster was a guest speaker at the Real Estate Bar Association (REBA)'s Environmental and Commerical Real Estate Finance Committee meeting on November 28, 2006. His topic, "Overlooked Risks from Contaminated Buildings – Preparing for Reuse in Real Estate Transactions," discussed how the biotechnology and technology industries raise unique issues in environmental due diligence in real estate transactions and management of real property. This program addressed risk managment issues of owners, sellers, buyers, lessors, lessees, lenders, and environmental counselors in their real estate transactions.

Paul Hastings Advises on First Chinese Property REIT in Singapore
Paul, Hastings, Janofsky & Walker (Paul Hastings), a leading international law firm, has represented CapitaLand Limited and CapitaRetail China Trust Management Limited (CRCTML) on the S$250 million (approximately US$162.6 million) initial public offering of the CapitaRetail China Trust real estate investment trust (CRCT REIT).

The landmark CRCT REIT is the first REIT to list in Singapore with a porfolio made up solely of PRC-based assets and it is also one of the first foreign investors to invest in PRC real estate in compliance with the new property ownership rules promulgated by the PRC government in July 2006. CapitaLand Limited is the sponsor of the CRCT REIT and ultimate owner of the initial portfolio of properties to be acquired by the CRCT REIT, and CRCTML is the manager of the REIT.

Vivian Lam, a partner in Paul Hastings' Hong Kong office who led the team commented, "Paul Hastings has been delighted to work with CapitaLand and CRCTML on the launch of the first Singapore-listed PRC property REIT. This deal further underscores the depth of Paul Hastings' expertise in Asian REITs and, in particular, in structuring PRC-based REITs for international listings having advised GZI on its REIT in Hong Kong.

Moore, Vega Author ABA Comments on EC Draft Notice on Immunity in Cartel Cases
O'Melveny counsels Belinda Vega and Karin Moore were part of a small team that drafted the comments of the ABA's Section of Antitrust Law and Section of International Law on the European Commission's draft Notice on Immunity From Fines and Reduction of Fines in Cartel Cases.

The comments suggest that the Commission's steps to create a one-stop shop for leniency applicants might slow the application process by increasing the number of formalities companies involved in multinational cartels must go through, and urges caution in adopting a listing of mandatory information required to meet the immunity threshold.

Vega focused on the requirement of an applicant not to disclose the fact or the content of its leniency application until the Commission has issued a Statement of Objections, and the conflict this could create with disclosure obligations under the U.S. securities laws.

Moore wrote on the Commission's efforts to limit access to oral statements, and the use of the transcript of an oral statement as evidence in the Statement of Objections. The use of the corporate statement as evidence in a Commission statement or decision potentially exposes that information to use in U.S. private litigation, not to mention potential private litigation in Europe.

Energy Partner Scott Schwind Joins Fulbright’s Houston Office
Bringing international energy and infrastructure projects experience that adds depth to Fulbright’s expanding global energy projects team, Scott Schwind has joined the international law firm of Fulbright & Jaworski L.L.P. as an energy partner in Houston.

Schwind’s international energy and infrastructure projects work and ability to speak four languages serves to further enhance Fulbright’s ongoing work in Latin America, Europe, the Middle East and Africa. Schwind, who is fluent in Spanish, Portuguese and French, joins Fulbright from the Houston office of Baker & McKenzie. He previously worked as a foreign associate with Trench, Rossi e Watanabe Advogados, the Baker & McKenzie affiliate in São Paulo, Brazil.

While Schwind’s transactional practice focuses on counseling multinational clients on major energy and infrastructure transactions, he has advised on major projects for the construction of oil and gas pipelines, the construction and installation of offshore drilling facilities, and the development of power generation plants and liquefied natural gas (LNG) terminals.

Nine Fulbright Practices and 12 Lawyers among Chambers Global’s Best for 2007
The 2007 Chambers Global Directory, which goes beyond the scope of the two other Chambers publications, Chambers USA and Chambers UK, ranks nine Fulbright practice areas and 12 individual Fulbright lawyers among the leaders worldwide. The directory is compiled through more than 6,500 interviews conducted by a team of 30 full-time researchers over a 12-month period. The interviews span 170 countries.

Foley Named to BTI Client Service 30 List
Foley & Lardner LLP announced today that it was named to the BTI Client Service 30 list, which recognizes law firms named for their exceptional client service by corporate counsel at Fortune 1000 corporations. Foley is ranked sixth on the list, and is one of only five firms named to the list in five of the last six years.

The list is developed by The BTI Consulting Group, a Boston-based market research and management consulting firm, which features the BTI Client Service 30 in The Survey of Client Service Performance for Law Firms: The BTI Client Service A-Team 2007.

BTI developed the survey to recognize law firms that have differentiated themselves from the competition through client service. To compile the list, BTI conducted individual interviews with more than 250 corporate counsel at Fortune 1000 companies. The clients assessed their outside firms according to 17 different criteria including legal skills, problem-solving, anticipating client needs, delivering value and understanding the client's business. The firms that received the top scores across the board comprise the BTI Client Service 30.

Foley has formalized a client service initiative that dedicates many resources across the firm, including attorneys, executive management, accounting, technology and marketing, to developing processes and tools to increase the firm's ability to bring more value to its clients. Central to the initiative is the identification and development of client service best practices for attorney and professional staff teams drawing upon their experience in diverse industries and geographical areas. The initiative has involved development and evaluation efforts by a group of Foley attorneys and clients. Best practices developed to date include:

* Real time budget and schedule dashboard reporting tools for client matters handled by the firm
* A formal and effective client satisfaction surveying process
* Dedicated client teams
* A full range of technical applications, provided through FOLEY:ClientSuite, to support interaction with clients and their legal needs

Earlier this year, Foley was named to the BTI “Market Movers” list and received its top “Market Trailblazer” designation as one of four national law firms identified by corporate counsel for their unique ability to leverage client-focused strategies with bold approaches to the market. Cozen O'Connor Chicago Office Receives Pro Bono Award from Pro Bono Initiative
Cozen O'Connor’s Chicago office was named to the 2006 Pro Bono Initiative (PBI) Honor Roll for its substantial pro bono contributions in the Chicago area. Along with 29 Chicago law firms and 12 corporations, Cozen O'Connor was recognized at the Public Interest Law Initiative (PILI) Annual Awards Luncheon. This is the third time in four years that the Chicago office has been honored by the PILI and the PBI.

The PBI is a joint project of the PILI and the Chicago Bar Association that works with law firms, corporations, law students and legal aid and public interest law organizations. Its mission is to increase the availability of pro bono services in the Chicago area for underrepresented and low-income individuals who lack access to the justice system.
