Appointment to Saint Lawrence Seaway Development Corporation advisory board
the U.S. Senate confirmed the appointment of President Bush's nominee Trip Dorkey to the five-member advisory board of Saint Lawrence Seaway Development Corporation (SLSDC).

SLSDC's advisory board advises the administrator on SLSDC policies affecting the operation and development of the St. Lawrence Seaway, and reviews SLSDC's policies concerning the design and construction of navigation facilities.

"I look forward to working with new Seaway administrator Terry Johnson and his staff on a number of key marine transportation issues, including the upcoming Great Lakes Seaway study that is expected to be ready for public release in 2007, marketing initiatives, and environmental challenges confronting this vital waterway," says Trip.

Trip brings to the board extensive experience in business litigation, and in state and city government service.

GableGotwals “Partners in Education” at the Hamilton School Job Fair
GableGotwals has a rich history of community involvement in the Tulsa area. Renée DeMoss, current Tulsa County Bar Association President (TCBA), is continuing the Gable tradition, as she was the major force in conceiving and organizing a job fair at Hamilton Middle School, which was held on December 8, 2006. Renée is part of a committee that has adopted Hamilton Middle School through a TCBA program entitled “Partners in Education.”

Hamilton Middle School is considered an “at risk” school, due to the demographics of the school’s student body. Even though the majority of the students graduate from Hamilton, most of them will drop out of high school by the 10th grade. So, the teachers have decided that the students should start career training as early as the sixth grade. Renée and other committee members organized a job fair for the sixth grade students that emphasized the various types of jobs that are available in the Law and Government. Meetings were held to give the students an opportunity to ask more specific questions, and a “mock trial” was also held.

The job fair was well attended and included representatives from the Sheriff’s Department, regional FBI office, the Tulsa Police, the TCBA, Honorable Carlos Chappell and his staff, and various other local and state officials. GableGotwals was the only law firm present to describe some of the various jobs available in a private law firm.

GableGotwals had a excellent turn out of employees who participated in this event. Selim Fiagome (Associate), Don Lovy (IT Manager), Shelly Hurst (Processing Clerk), Shelley Bradley (Recruiting Coordinator) and Camie Hayes (Legal Assistant) all came to explain to the students some of the jobs available in a private law firm. Cason Carter, of the Firm, also attended. Cason wore his hat as a Tulsa City Counsel representative and discussed how he serves Tulsa citizens by being on the counsel.

G. Ellis Gable, one of the Firm’s founders, would have been proud of the Gable employees who came out to support this important first step in trying to encourage kids of the many opportunities in law related employment. A plaque at the entrance to Hamilton shows that Mr. Gable served on the Board of Education in 1957 when Hamilton was built. We hope to return again next year as we continue the Gable tradition of community involvement. Special thanks to Renée DeMoss, as she attended to all the details from conception to completion.

Newly Posted Article -- "Working While Disabled - New Developments"
To be eligible for Social Security Disability Benefits, a disabled or blind person must be unable to engage in real work, or what Social Security calls “substantial gainful activity” (SGA). A person who is earning more than a certain monthly amount is ordinarily considered to be engaging in SGA. Effective January 1, 2007, the amount of monthly earnings considered as SGA is $900 for disabled persons and $1,500 for blind persons. (The figures for 2006 were $860 and $1,450, respectively.)

Social Security uses a concept of “countable earnings” in determining whether earnings in a particular case exceed this level. To determine countable earnings, you start with your gross earnings. This means your monthly pay before any deductions for taxes or fringe benefits. Then, you subtract the cost of certain impairment-related items and services that you need to work from your gross earnings. These are called “Impairment Related Work Expenses” or IRWE. Gross earnings minus IRWE equals countable income for purposes of determining whether Social Security will consider your income to be so high that it will no longer consider you to be “unable to engage in any substantial gainful activity.”

What qualifies as an IRWE that you can deduct from your gross earnings is a complex matter. Basically, the item or service must be something that relates to your disabling condition, and that you need in order to work. It does not matter if you also use these items and services for non-work activities.

Some examples may help. Personal care attendant services are deductible if they help you prepare for work, get to and from work, or take care of your needs after work, including bathing, dressing, cooking and eating. However, personal care attendant services on non-workdays, or helping you with non-work-related activities like shopping and homemaking, are not deductible. The cost of transportation to work that is required because of your disability rather than lack of public transportation. Residential modifications to the EXTERIOR of the house to permit access to the street or transportation, such as ramps and railings, are deductible. Residential modifications to the INTERIOR of the house, to help you in the house, such as enlarging doorframes or making a bathroom accessible, are not deductible.

In certain areas, the rules for qualifying an expense as IRWE are more liberal. For example, regularly prescribed medical treatment or therapy that is necessary to control your disabling condition, is deductible, even if control is not achieved, and even if the treatment would be necessary whether you were working or not. On the other hand, medical expenses and medications associated with minor, non-disabling problems you also may have, like allergy treatment or dental work, are not deductible.

Annette Idalski, Noted Employment Attorney, Joins Duane Morris in Atlanta
Duane Morris LLP is pleased to announce the arrival of Annette A. Idalski, formerly of Hunton & Williams, as a partner in its Atlanta office. Annette, the president of the Georgia Association for Women Lawyers, joins the firm's Employment and Immigration Practice Group.

Annette represents employers nationwide in litigation involving employment discrimination, workplace harassment, wage and hour compliance, restrictive covenants, and executive compensation agreements. She regularly conducts pre-litigation counseling and training, and counsels clients on their rights and obligations under the myriad federal, state and local employment laws, statutes and regulations.

In addition to her post with the Georgia Association For Women Lawyers, Annette was the recipient of the Association's Visionary Award in 2005. Annette was also selected by her peers as one of "Georgia's 2005 Legal Elite" as published in Georgia Trend magazine and was named an Employment Litigation Super Lawyer by Georgia Super Lawyers magazine®, 2007

Annette earned her J.D. from St. Mary's University School of Law in 1995 and her B.S. from Central Michigan University in 1991.

Duane Morris also announced that Annette will be joined today in its growing Employment and Immigration Practice Group by Celeste M. Wasielewski, a partner formerly of DLA Piper Rudnick Gray Cary, who will serve clients from the firm's Washington, D.C. office.

Thomas P. Christy Joins Garan Lucow Miller’s Troy Office
Garan Lucow Miller, P.C., with offices throughout Michigan, announces that Thomas P. Christy has joined the law firm as an associate in the Troy office.
Mr. Christy received his Juris Doctor degree in May 1996 from the University of Cincinnati College of Law where he was on Law Review. For the prior six years, he was an associate attorney with Bergesen and Clark in Troy. Mr. Christy was admitted to practice in Michigan in November 1996, and in Ohio in November 1997.
