Nashville Business Journal honors seven Stites & Harbison attorneys as Best of the Bar
Stites & Harbison announced today that seven of the attorneys in the Nashville, Tenn., office have been named by the Nashville Business Journal as Best of the Bar for 2007.

The National Business Journal started publishing Best of the Bar in 2003. The award recognizes excellence in the legal community. The winners were nominated by their peers and selected from among 1,000 nominations. This year's honorees for Best of the Bar were profiled in the August 17, 2007, edition of the Nashville Business Journal.

Smith Anderson Lawyers Merrill Mason, Benji Jones, Andrew Fisher and Heyward Armstrong Coach UNC Entrepreneurial Business Students
At the invitation of the Center for Entrepreneurial Studies at the University of North Carolina's Kenan-Flagler Business School, Smith Anderson business lawyers Merrill Mason , Benji Jones, Andrew Fisher and Heyward Armstrong participated as coaches to provide program business students with advice on legal issues facing start-up companies.

The program, held on Saturday, August 18, 2007 in Chapel Hill, North Carolina, involved meeting with students who have ideas for five start-up companies to provide coaching and advice on real world issues they may face to launch their businesses. Issues include form of entity, liability, contractual matters, Intellectual Property concerns, joint venture agreements and other related matters. Students provided their coaches with a presentation on each business model and the coaches offered tangible, specific counsel on next steps and issues management.

Mr. Mason, Ms. Jones, Mr. Fisher and Mr. Armstrong all practice corporate and securities law with experience in venture capital, securities, mergers and acquisitions, intellectual property and general corporate matters. Mr. Mason and Mr. Fisher specifically focus their practice on life sciences and emerging and entrepreneurial companies.

S. Kato Crews And Eric V. Hall Elected Partners With Rothgerber Johnson & Lyons LLP
Rothgerber Johnson & Lyons LLP is pleased to announce S. Kato Crews and Eric V. Hall have been named partners with the firm. Their new titles become official on January 1, 2008. Both attorneys practice out of the Colorado Springs office.

They were named at the firm’s annual partner retreat held August 17–20, 2007, in Vail, CO. The firm will have a record 46 partners. We congratulate both of them for the manner in which they have distinguished themselves in the courtroom and the community.

Mr. Crews's practice focuses on labor and employment law, construction and mechanic's lien law, and general litigation. He joined RJ&L in 2001 after serving as an attorney with the U.S. National Labor Relations Board. Mr. Crews serves on the Board of Directors for the Pikes Peak Urban League, and is Vice-Chair of the Employment Law and Litigation General Committee of the Tort Trial & Insurance Practice Section of the American Bar Association. He is also a member of the Steering Committee for the 2008 Colorado Bar Association Leadership Training.

Mr. Crews graduated from the University of Arizona College of Law, and received his Bachelor of Arts in Public Relations/Journalism and Mass Communications from the University of Northern Colorado, where he received the Future Black Leader and Achiever Award.

Eric Hall represents religious institutions and schools in all legal matters. He also represents clients involved in employment and other litigation. Prior to joining RJ&L, Mr. Hall was a teacher in Minneapolis and Texas. After law school, Mr. Hall served as a law clerk at the Tenth Circuit Court of Appeals for the Honorable David M. Ebel.

Mr. Hall graduated Summa Cum Laude from University of Notre Dame Law School, where he received the Dean Joseph O'Meara Award for outstanding academic achievement. He received a Master of Arts from St. John's College and his Bachelor of Arts Magna Cum Laude from College of William and Mary.

Riker Danzig Summer Associates Participate in Anti-Defamation League Research Program
Summer Associates from Morristown-based law firm Riker Danzig Scherer Hyland & Perretti LLP participated in the Anti-Defamation League’s (ADL) “Summer Associate Research Program,” in which the summer associates completed pro bono legal research projects on cutting edge civil rights issues. The topics researched arose from factual scenarios that the ADL’s national and thirty regional offices encountered over the last year, including whether restrictions can be placed on public school teachers who wear religious garb while in the school environment, and what legal issues are implicated in religious speeches by students at school graduation ceremonies.

“ADL’s Summer Associate Program affords tomorrow’s lawyers an opportunity to explore today’s pressing civil rights questions,” said Etzion Neuer, ADL Director, New Jersey Region. “Thanks to their work, we are able to make more informed decisions on the policy and legal issues that ADL addresses on a regular basis and the students were able to learn about the importance of pro bono service. This is a model of the cooperation between the professional and non-profit sectors that ADL is working to achieve.”

Riker Danzig attorneys, organized by partner Lance Kalik, supervised seven summer associates in researching topics that included discrimination, free speech, immigration, and religious freedom. "We were delighted to work with the ADL on this wonderful program,” said Mr. Kalik. “It not only gave us an opportunity to contribute to ADL's efforts to protect the civil rights of all citizens, but it also allowed us to train our summer associates using real life and cutting-edge issues that confront the ADL on a daily basis. We hope to continue to be part of this program in the future."

The Anti-Defamation League, founded in 1913, is the world’s leading organization fighting anti-Semitism through programs and services that counteract hatred, prejudice and bigotry. At a reception on October 25th in honor of New Jersey Supreme Court Chief Justice James Zazzali, the ADL will recognize Riker Danzig and its other Summer Associate Research Program Partners.

Anti-Spam Case Dismissed: Kleffman v. Vonage, 2007 WL 1518650
On behalf of client Vonage Holdings Corp., Perkins Coie obtained complete dismissal of a purported class action anti-spam case filed against Vonage in California. The plaintiff, a recent law school graduate represented by Hagens Berman Sobol Shapiro LLP, sought damages and injunctive relief from Vonage in California state court on the theory that email advertisements for Vonage services sent from more than one domain name violated California's anti-spam law, Cal. Bus. & Prof. Code Section 17529.5, and Consumer Legal Remedies Act.

Vonage removed the case to the Central District of California and moved to dismiss. The Court (Judge Feess) agreed with Vonage, holding that the complaint failed to state a claim under California's 17529.5 anti-spam law; the federal CAN-SPAM Act preempted the plaintiff's 17529.5 claim; and the plaintiff lacked standing to sue under California's Consumers Legal Remedies Act because he neither sought nor acquired Vonage broadband telephone services.

The Court dismissed the case in its entirety with prejudice and expressly without leave to amend. Nonetheless, the plaintiff subsequently filed a motion to amend the complaint to restate his 17529.5 California anti-spam claim and to replace his Consumer Legal Remedies Act claim with a claim under California Business and Professions Code Section 17200. The Court denied the plaintiff's motion, pointing again to the claims' preemption and failure to state a claim.

Morris, Manning & Martin Partner to Speak on Alternative Compensation Plans
The right benefits and compensation are key to attracting and retaining employees, especially for technology companies. Morris, Manning & Martin Partner Bruce Wynn will speak on the importance of alternative compensation plans at an upcoming Technology Association of Georgia (TAG) event.

The TAG Tax & Finance society will host the program, titled Using Alternative Compensation Plans to Attract and Retain Key Personnel. The breakfast event will be held Tuesday, August 28 from 7:30 a.m. to 9:00 a.m.

“Salary is just one part of a competitive compensation package,” Wynn says. “CEOs should also consider matching 401 (k) plans, deferred compensation plans, stock option and/or stock purchase plans. But there’s a lot that company leaders should know about planning, diversifying investments, and keeping up with changing laws and regulations,” he adds. Wynn has more than 20 years experience with employee benefits and executive compensation, and has counseled both small businesses and Fortune 500 companies on their benefit plans. He has extensive experience with tax-qualified retirement plans, employee
welfare benefit plans and nonqualified deferred compensation arrangements, as well as equity compensation arrangements such as stock option plans and restricted stock arrangements. Wynn has also been a frequent speaker on tax, benefits, executive compensation and ERISA-related topics.

In addition to Wynn, Patrick Ungashick of White Horse Advisors and Kevin Cruse of HR Cruse & Associates, LLC will also serve on the panel, which John Carpentier of Tarpley & Underwood will moderate. The seminar will be held in the Hodges Connection Room on the third floor of the Centergy Building at 75 Fifth Street in Midtown.

Senator Robert Havern Joins ML Strategies Expanding Government Relations Practice
After 30 years in public service as both a Democratic State Senator and Representative, Senator Robert Havern is joining ML Strategies, the consulting affiliate of Mintz Levin Cohn Ferris Glovsky and Popeo, P.C, as the President of its Massachusetts Government Relations Practice.

Senator Havern, who currently serves as the Assistant Majority Whip in the Massachusetts State Senate, notified Governor Patrick, Senate President Murray and House Speaker DiMasi of his plans to join ML Strategies last week. He plans to join the firm on September 4.

"Senator Havern has been a valued member of our leadership team, and he will be missed," said Senate President Therese Murray. "As Assistant Majority Whip in the Senate and a long-time chairman of the Transportation Committee, Senator Havern was a dedicated legislator who always had the best interests of the Commonwealth and his district at heart. He played a key role in the creation of the Rose Fitzgerald Kennedy Greenway through the City of Boston, and he was an outspoken and passionate supporter of gay marriage. Senator Havern was an asset to state government, and I'm sure he will continue to do great things as he takes on this new challenge in his life. I wish him the best of luck."

A tireless public servant, Senator Havern began his political career in his hometown of Arlington, Massachusetts serving as a Selectman from 1978 to 1986. In 1987 he was elected to the Massachusetts House of Representatives, serving on the Taxation Committee and as Vice-Chairman of the Committee on Bills in Third Reading. Senator Havern was elected in 1991 to represent the Fourth Middlesex district which includes parts of Woburn and Lexington and the towns of Arlington, Billerica, and Burlington. In addition to serving as Assistant Majority Whip, Senator Havern previously held the title of Senate Chairman of the Joint Committee on Transportation which has the oversight of state's major transportation agencies including the Mass. Highway Department, the Mass Turnpike Authority, the Mass Port Authority and the MBTA, among others.

In his role as President of the Massachusetts Government Relations practice, Senator Havern will work with ML Strategies' professionals in helping clients in a variety of industries including health care, real estate development and financial services, to develop effective strategies for interacting with city and state offices, key Members of the Legislature and Executive Branch and other constituencies that could affect a client?s business needs.
