White & Case Builds Out Global Investment Funds Practice in London with New Partner Arrival
White & Case is adding to its existing London and global Investment Funds capabilities with the arrival of partner Matthew Judd. He will join the Firm's London Corporate group in early 2007, working within White & Case's growing Global Investment Funds practice. Judd's experience spans the establishment of and ongoing counsel to private equity funds, hedge funds, real estate funds and regulated funds, as well as capital protected and structured products.

"We've been active in investment funds work for some time, but Matthew's arrival is a significant step forward for us and our clients, providing additional resource in what is an extremely rapidly growing sector. In particular, Matthew will be a real asset for our private equity clients," commented partner Peter Finlay, co-head of White & Case's London Corporate team. "London has become an international hub for private equity and hedge funds, with billions of pounds under management, and Matthew's arrival reflects both the increased demand we're seeing from our clients in this area, as well as the growth opportunities we see for ourselves."

Aside from dedicated investment funds work, Judd will combine with White & Case's private equity, capital markets and structured finance teams. Increasingly, private equity, capital markets and financing transactions combine structured financing and private fund techniques.

White & Case's global Investment Funds practice was further strengthened in 2004 with the arrival of partner David Goldstein in New York, who now leads the practice. The 20-strong practice has recognised strengths in New York, Hong Kong, Tokyo and Frankfurt, and now London. The practice was named Best Asian Investment Funds Practice 2006 by AsianInvestor.

Thelen Reid Brown Raysman & Steiner LLP Client Secures Appellate Victory in Patent Infringement Case
Thelen Reid Brown Raysman & Steiner LLP announced today that its client Illinois Tool Works (ITW) recently obtained affirmance of a judgment rendered in January 2006 by the United States District Court for the District of Massachusetts after a three week, non-jury trial. The judgment and mandate of the Court of Appeals affirmed the District Court's order in its entirety.

The Court of Appeals judgment upholds the District Court decision rejecting the patentee's allegations that ITW's trays for storing and testing ball grid array integrated circuit chips infringed three claims of the plaintiff's patent, as well as allegations that ITW engaged in trade libel by publishing statements related to the validity of the patent.

In the trial decision, United States District Judge Richard G. Stearns ruled that the R.H. Murphy carrier tray patent was "invalid because two prior art trays [which had been designed and sold by ITW] rendered the patent obvious." Judge Stearns found that the "prior art, tweaked with minor and obvious modifications, anticipated all of the essential elements of the patent as the assignee (R.H. Murphy) defined them."

Judge Stearns further found that R.H. Murphy "failed to rebut the showing of obviousness based upon secondary factors, because the assignee did not present sufficient evidence of commercial success, satisfaction of a long-felt but unresolved need, the failure of others, or copying."

"I am very pleased with these victories for ITW at the trial and appellate levels," said Frederick Whitmer, a New York-based Thelen Reid Brown Raysman & Steiner partner, and lead trial and appellate counsel for ITW in the case. "ITW itself has a deep respect for patent rights and is widely recognized as a leader in innovation and patent protection."

In 2005, ITW had more than 17,000 unexpired patents and pending patent applications worldwide, including 3,200 U.S. patents and 1,200 pending U.S. applications. The company typically ranks in the top 100 of patent issuers in the U.S.

Eric Todd Elected to Kids In the Middle Board of Directors
Stinson Morrison Hecker LLP attorney Eric A. Todd was recently elected to the Kids In the Middle, Inc. board of directors. His two-year term begins in January.

Todd, a partner in St. Louis office of the firm, focuses his practice exclusively on employment and labor law matters. He received his juris doctorate in 1993 from Indiana University.

Kids In the Middle, a nonprofit organization, is a primary resource for families experiencing difficult and challenging family transitions in the St. Louis area. The organization strengthens family relationships by providing quality, affordable therapy, education and support to children and families coping with divorce and other transitions. They offer a variety of group and individual therapy sessions at their facility, through the St. Louis City court system, and area public and private schools.

Miller Nash Attorney Appointed to Education Committee
Elizabeth Thomson Denecke, an attorney from Miller Nash LLP, was recently appointed to serve on the National Association of College and University Attorneys (NACUA) Committee on Legal Education (CLE). NACUA improves the quality of legal assistance by providing publications, sponsoring CLE seminars, and serving as a clearinghouse through which attorneys representing higher education institutions are able to share knowledge and information regarding legal concerns and interests. The CLE committee members collaborate to develop and coordinate cutting-edge curriculum and workshops on the latest laws, regulations and issues emerging in the industry. It recently presented a seminar on sponsored research, compliance and technology transfer. The committee is also presently working on a spring CLE workshop addressing the latest developments in higher education employment law.

Attorneys on the committee have extensive expertise and background in education. Denecke focuses her practice in the area of education law. For nine years she represented the Oregon University System Institutions at the Oregon Department of Justice, assisting the University of Oregon, Portland State University, and Southern Oregon University with their general legal needs, including risk management.

“Serving on this national committee allows me to work with the most knowledgeable attorneys in the field, while staying current on the latest legal issues facing higher education institutions,” said Denecke. “This knowledge, then, will naturally allow me to provide better service to the firm's clients.”

Denecke is a current member of the Lake Oswego School District Foundation Board and is a past member of the board of trustees of the Catlin Gabel School. She has served on the boards of directors of the Junior League of Portland, of Youth Contract, Inc., and of Marylhurst Early Childhood Center.

Luce Forward Names Three New Partners
Luce Forward attorneys Karen M. Clemes, Karolina A. Ericsson, and Jason A. Femrite have been elected partners of the firm, effective January 1, 2007.

“Karen, Karolina, and Jason are extremely accomplished attorneys, who have demonstrated the integrity, excellence and commitment necessary to achieve a successful and significant professional career. Their skill and dedication have provided important contributions to the successes of our clients and the betterment of for our community,” said Robert J. Clemes, who practices in the firm's downtown San Diego office, specializes in employment discrimination and harassment, wrongful termination, retaliation, disability claims, wage and hour issues and trade secret issues as a part of the firm's Labor and Employment Practice Group. Her practice includes both litigation (including class action defense) and preventative counseling and training. She serves as Vice Chair, Board of Directors of Partnerships With Industry, an organization that provides job training, placement, and ongoing support services for adults with developmental disabilities to work in the community. Clemes is also Chair-Elect, Board of Directors for the J. Reuben Clark Law Society. She earned both Bachelor of Arts and Master of Arts degrees from Brigham Young University, and a Juris Doctor degree summa cum laude from California Western School of Law. Clemes began practicing at Luce Forward in 1999, and previously served as Law Clerk to the Honorable David R. Thompson, U.S. Court of Appeals, Ninth Circuit.

Ericsson is also based in the firm’s downtown San Diego office, and specializes in real estate transactions including asquisitions as a part of the firm’s tenant-in-common (TIC) specialization. A member of Luce Forward’s Real Estate Practice Group, Ericsson’s practice also includes affordable housing issues. She is a Board Member of the Wakeland Housing and Development Corporation, an organization that works to develop quality affordable housing projects with resident-education programs for low-income families. She is a Mentor Attorney and Advisory Committee member of VIP Mentors, an organization that matches parolees from the California Youth Authority (CYA) with lawyers who act as mentors. Ericsson is also a Board Member of Community Connection, and a member of the San Diego Housing Federation Board. Prior to joining Luce Forward, Ericsson served as a Law Clerk to the Honorable Napoleon A. Jones, Jr., U.S. District Court, Southern District. She earned a Bachelor of Science degree from the University of California San Diego and a Juris Doctor from Stanford Law School. Femrite, is based in the firm’s Carmel Valley / Del Mar office and has been practicing with Luce Forward for over seven years. He is a member of the firm’s Business / Corporate Practice Group, for which he serves as Co-Chair of the Mergers and Acquisitions and Corporate Finance Sections. His practice includes an emphasis on mergers and acquisitions, as well as private equity, corporate and venture finance, securities and general corporate matters. He represents both private and publicly held companies, funds and investment firms in a wide range of transactions from structure and formation to capitalization, finance and acquisition. Femrite represents clients in many industries, including biotechnology, life sciences, action sports, venture finance, manufacturing and homebuilding. He earned a Bachelor of Arts degree from the University of California San Diego, and a Juris Doctor, cum laude and Order of the Coif from the University of San Diego.

Collier County Women's Bar Association Honors Jeanne Seewald 2006 Woman Lawyer of the Year
Jeanne L. Seewald will be honored as the 2006 Woman Lawyer of the Year and Gerri Moll will be honored as the 2006 Distinguished Executive by the Collier County Women’s Bar Association at its Holiday Reception on December 11, 2006.

Seewald, the managing shareholder of the Naples office of Fowler White Boggs Banker, concentrates her practice in the areas of general business and corporate transactions, mergers and acquisitions, intellectual property, and technology. She is AV rated by Martindale-Hubbbell (its highest rating) and was selected by her peers for inclusion in The Best Lawyers in America® in 2006. Seewald currently serves on the Executive Council of the Business Law Section of the Florida Bar and Chairs its Intellectual Property Law Committee. She also serves on the Boards of Directors of the Greater Naples Chamber of Commerce, the Collier County Women’s Bar Association, and the Collier County Bar Association, as well as the Editorial Board of Gulfshore Business magazine.

Jeanne had to have gained the confidence of both her male and female partners to be asked to take on this role.” Past recipients of the Woman Lawyer of the Year award include: Kathleen Passidomo (2005), Tara Miller Dane (2004), Carolyn Coukos (2003), Amira Dajani Swett (2002), Christine Greider (2001), Melinda Riddle (2000), Sharon Hanlon (1999), Jill Burzynski (1998), Jean Rawson (1997), and Helen Sundgren (1996).

Moll currently serves as President of Bank of America Southwest Florida. She is also a member of the Board of Trustees of NCH Healthcare Systems, Board of Directors of the Forum Club of Southwest Florida, and member of the Community Foundation of Collier County’s Chairman’s Circle. Previously, she served on the Florida Department of Education Board of Governors, Florida Gulf Coast University Board of Trustees, Florida Gulf Coast University Foundation Board, the Leadership Florida Board of Regents, and the Collier County Economic Development Council.

“Although Gerri’s career and community accomplishments are nothing short of extraordinary, the Collier County Women’s Bar is honoring Gerri for her commitment to her colleagues and to the balance of work and family,” Clary continued. “The Distinguished Executive is awarded to a woman or man who leads in the workplace with vision, determination, and compassion, and who has created productive working environments. Balancing work and family remains one of the greatest challenges for women in general and women lawyers in particular. We hope that honoring leaders who go above and beyond to create woman friendly working environments will raise awareness and encourage others to become more sensitive to the importance of retaining women in the work place and the legal profession.” The first Distinguished Executive Award was presented to Martha Marland, Senior Vice President at Northern Trust, N.A., in 2005.
