Thelen Reid Brown Raysman & Steiner LLP Client Secures Appellate Victory in Patent Infringement Case
Thelen Reid Brown Raysman & Steiner LLP announced today that its client Illinois Tool Works (ITW) recently obtained affirmance of a judgment rendered in January 2006 by the United States District Court for the District of Massachusetts after a three week, non-jury trial. The judgment and mandate of the Court of Appeals affirmed the District Court's order in its entirety.

The Court of Appeals judgment upholds the District Court decision rejecting the patentee's allegations that ITW's trays for storing and testing ball grid array integrated circuit chips infringed three claims of the plaintiff's patent, as well as allegations that ITW engaged in trade libel by publishing statements related to the validity of the patent.

In the trial decision, United States District Judge Richard G. Stearns ruled that the R.H. Murphy carrier tray patent was "invalid because two prior art trays [which had been designed and sold by ITW] rendered the patent obvious." Judge Stearns found that the "prior art, tweaked with minor and obvious modifications, anticipated all of the essential elements of the patent as the assignee (R.H. Murphy) defined them."

Judge Stearns further found that R.H. Murphy "failed to rebut the showing of obviousness based upon secondary factors, because the assignee did not present sufficient evidence of commercial success, satisfaction of a long-felt but unresolved need, the failure of others, or copying."

"I am very pleased with these victories for ITW at the trial and appellate levels," said Frederick Whitmer, a New York-based Thelen Reid Brown Raysman & Steiner partner, and lead trial and appellate counsel for ITW in the case. "ITW itself has a deep respect for patent rights and is widely recognized as a leader in innovation and patent protection.

BINGHAM CONSULTING GROUP EXPANDS MULTI-STATE PRACTICE
Sarah G. Reznek, former chief counsel of consumer protection at the National Association of Attorneys General (NAAG), has joined Bingham Consulting Group (BCG) as a senior consultant in Washington. She also joins Bingham McCutchen LLP as of counsel.
As a former trial attorney at the Federal Trade Commission (FTC) and through her nine-year career at NAAG, Reznek brings an extensive understanding of state and federal actions, and their legal, regulatory and legislative impact on the business community.
“Sarah’s vast experience complements Bingham Consulting’s focus in resolving matters investigated and reviewed at the state level, particularly by state attorneys general, and helping businesses navigate the federal, state and local regulatory waters,” said Bingham Chairman Jay Zimmerman. A subsidiary business of Bingham, BCG assists companies in designing and executing strategies to address litigation and regulation by the states in a variety of areas, including pharmaceuticals, energy, financial services, health care, information technology and telecommunications.
For Reznek, joining BCG is a logical extension from her 17-year public-sector career.
“During my years at NAAG, I was involved in a number of multi-state investigations and have worked with Bingham Consulting, the premier firm in dealing with attorneys general,” said Reznek, 53, who also spent eight years at the FTC. “This is an opportunity for me to use the skills that I have developed at NAAG to represent major companies for a variety of industries.”
While at NAAG, Reznek interacted with all 50 state attorney general offices on a myriad of issues, including consumer protection, enforcement issues, legislative matters, training, and public education. She also worked with the attorneys general in areas such as privacy, telecommunications, financial services, and pharmaceutical pricing. While at the FTC, Reznek supervised and conducted all phases of investigation and litigation of unfair and deceptive marketing practices cases before federal district courts throughout the country.
Reznek is BCG’s most recent addition from the public sector. In October, Tom Gede, former executive director of the Conference of Western Attorneys General (CWAG) and a former senior officer in the California Attorney General’s office, joined BCG as a principal. BCG is the largest and most experienced firm in the country dedicated to resolving matters raised by
state attorneys general, including some of the most complex multi-state investigations and regulatory reviews undertaken by state attorneys general in the past several years. Among the group’s principals are former New Hampshire Governor and Attorney General Stephen Merrill, who is BCG president, and former California Governor Pete Wilson and former Suffolk County District Attorney Ralph Martin.
The insight offered by BCG will be valuable to businesses as a Democratic-controlled Congress convenes in January, noted Merrill. “Investigations into hedge funds, telecom, pharmaceuticals, securities and other business transactions will likely intensify,” he said. “Activism will increase, and we may see parallel investigations with Congress and state AGs, who will use a national platform to promote their cases and interests.”
Bingham Consulting Group is one of four Bingham subsidiary businesses, along with Bingham Strategic Advisors, Bingham Legg Advisers and Bingham Sports Consulting.

Immigration Attorney Robert Divine Returns from Government to Baker Donelson
Baker, Donelson, Bearman, Caldwell & Berkowitz, PC announces that Robert C. Divine has returned to the Firm from his service as Chief Counsel of U.S. Citizenship and Immigration Services (USCIS). Mr. Divine departed the Firm in July 2004 when he was appointed by George W. Bush to serve as the first Chief Counsel in USCIS, the world's largest immigration services agency within the new Department of Homeland Security (DHS). Mr. Divine has rejoined Baker Donelson as a shareholder leading the Immigration Group within the Firm's Labor & Employment Department.

Mr. Divine is the author of Immigration Practice (Juris Publishing, 2004-05 ed.), a 1,600-page practical treatise covering all aspects of United States immigration law. He wrote the book in 1994 and has rewritten it each year since then to cover the constant changes in the complex field.

"Immigration is not only an important political issue for the nation, but it is a very problematic issue for many businesses," said Ben Adams, the Firm's CEO. "Robert has 20 years' experience as an immigration lawyer, he has the knowledge represented by his professionally well-regarded book, and he has very recent experience in the most important government job an immigration lawyer can have. Robert had many choices upon leaving government, and we are delighted that he is returning to Baker Donelson."

After one year serving as Chief Counsel, Mr. Divine served for six months as Acting Director of USCIS, then six more months as Acting Deputy Director. Despite the level of his positions held, Mr. Divine is not prohibited from dealing with his former agency in handling immigration matters for clients, because he voluntarily avoided the salary levels that trigger automatic one-year disqualification. "I am truly grateful for the unexpected opportunity to serve among the impressive men and women in USCIS and related agencies. But immigration law is what I did for 18 years before I entered government," said Divine. "I could not afford to leave government and then be unable to work for a year."

During his government service Mr. Divine commuted each week to Washington, D.C., from his home in Chattanooga, Tennessee, and he will work from Baker Donelson's Chattanooga office as well as from its D.C. office, which was established by former Senator Howard Baker. During Mr. Divine's government service, the Firm has grown from 350 to more than 450 attorneys and public policy and international advisors in 11 markets in Washington, D.C. and the south central U.S. as well as a representative office in Beijing, China. The Firm has several immigration lawyers and paralegals in other offices, but it expects to expand the Immigration Group significantly under Mr. Divine's leadership.
