Attorney Joseph J. Tierney Elected Partner at YCR
Joe practices primarily in the areas of professional liability and commercial litigation. Joe was admitted to the South Carolina Bar in 1997 and is also a member of the American Bar Association and all state courts. Jack Isselmann Joins Tonkon Torp's Government Relations and Public Policy Practice
Prominent Oregon lobbyist Jack Isselmann has joined the Government Relations and Public Policy Practice Group at Tonkon Torp LLP. He brings additional strength and depth to the firm's strategic counsel and advocacy on behalf of private and public companies.

Isselmann most recently was principal of his own public affairs and government relations consulting practice, representing some of Oregon's most prominent technology and consumer products companies. He also served as a senior advisor to the re-election campaign of Governor Ted Kulongoski. Isselman's experience with state government issues began with his work as deputy directory of Oregon's Oregon Economic and Community Development Department (OECDD) and on the Governor's staff, from 2003 to 2005. Prior to that, he was a corporate lawyer, both in-house and in private practice, for Silicon Forest technology companies.

"Tonkon Torp is creating a top quality government relations and public policy practice in Oregon with full capabilities to meet our clients' federal, state and local needs," said Mark L. Cushing, who launched Tonkon Torp's government relations practice group last June after representing corporate clients in Washington, D.C. "Our practice gets a tremendous boost with Jack joining our firm as one of the rising lobbyists in the State Capitol."

Tonkon Torp's government relations practice emphasizes high level strategic counsel to companies regarding federal, state and local government legislative and regulatory issues, as well as counsel to organizations seeking to sell goods or services in the government market place.

"It is a great privilege to practice alongside the attorneys of Tonkon Torp, who occupy the pinnacle of professional representation in Oregon," said Isselmann. Isselmann is a Phi Beta Kappa graduate of the University of Southern California and earned his law degree with honors from the University of Maryland School of Law. He has served on the board of trustees for OMSI and the Oregon chapter of the National Multiple Sclerosis Society. He recently served as a member of the Academic Excellence/Economic Development Working Group of the Oregon State Board of Higher Education.

Center City Park Garden Named in Honor of Greensboro Attorney
A garden in Greensboro's new Center City Park has been named in honor of an attorney whose 50-year practice has included distinguished service to the city and to the downtown area. The garden will be known as the Charles E. Melvin, Jr. Triangle Garden, in honor of Smith Moore attorney Charlie Melvin. The recognition was made possible by a donation to the Center City Park campaign by Melvin's current and former law partners and colleagues.

"Charlie has worked tirelessly in support of Greensboro, and we thought there should be a permanent marker of his contributions to the city," said Smith Moore attorney Garrett Walker.

Along with his lengthy service at Smith Moore, Melvin is the past chairman of the Greensboro Chamber of Commerce and the past president of Greensboro Development Corporation. He also serves as a board member for Downtown Greensboro, Inc. and Greensboro Business Center.

The garden will feature a plaque identifying the space as the Charles E. Melvin, Jr. Triangle Garden, with the inscription, "In recognition of his distinguished service to the legal profession and the City of Greensboro. By his partners and colleagues at Smith Moore LLP and its predecessor firms. Spring, 2006." The donation by Melvin's partners and colleagues also provided for the naming of a park bench in the Park, with the inscription, "In honor of Charles E. Melvin, Jr. and his wife, Jackie."

In addition to the recognition in the garden and on the park bench, Melvin will be listed on the Park's Founder's Wall.

Prince Lobel Grows Corporate Practice
Prince, Lobel, Glovsky & Tye LLP recently welcomed two new attorneys to their Corporate Group. The growth in experience and capability allows the firm to provide their current and potential clients with additional sophisticated services.

John Bradley joins the Corporate Group as Of Counsel. John has extensive experience in representing clients in mergers and acquisitions, commercial contracts, shareholder arrangements, technology licensing, executive compensation arrangements, corporate financings, securities law matters, asset-based financing transactions and various regulatory matters. John received his B.A. and J.D. from Stanford University in Stanford, California.

Tom Westort joins the Corporate Group as an Associate. Tom concentrates his practice in general corporate law, focusing his time on mergers and acquisitions, commercial and venture financing, and early stage companies. Tom received his B.A. from the University of Massachusetts and his J.D. from the University of Pennsylvania.

JMBM Receives Excellence in Business Award for Entrepreneurship
Jeffer, Mangels, Butler & Marmaro LLP (JMBM), one of California’s foremost full-service law firms, announced that it has been awarded the Los Angeles Business Journal's first Excellence in Business Award for Entrepreneurship. The award recognized the Firm's "creative entrepreneurial spirit" and the excellent leadership provided by its managing partner Bruce P. Jeffer.

"On behalf of the Firm, I am honored to receive this recognition, and I thank the many clients who we've had the opportunity of representing during our 25 years as an independent, mid-sized law firm," said Bruce P. Jeffer, one of the Firm's founding partners. All of the founders still practice law with almost 150 other lawyers who share their vision of providing personal and superior service.

The Firm was nominated for the award by its long-time client, Union Bank of California. "This Los Angeles-based law firm's unsurpassed integrity, its ability to solve complex business issues, and its dedication to clients in this community during the past 25 years warranted our recommendation for the award," said Louis B. Desser, regional vice president and Katherine Murray, vice president and manager of Union Bank of California. Union Bank and accounting firm Jefferson Wells are sponsors of the Excellence in Business Awards.

"The list of JMBM's legal victories is diverse and fascinating…but the common theme throughout is the belief in 'hand-crafted solutions' for each case," the Los Angeles Business Journal said in describing its decision to recognize JMBM. The weekly newspaper cited several JMBM cases in its analysis, including one in which the Firm's client, a Los Angeles-based orthopedic surgeon, received a total payment of $1.35 billion in an intellectual property dispute.

JMBM partners Kenneth Bovard and Guy Maisnik accepted the honor at a dinner ceremony held on October 24, 2006, at the Regency Club in Los Angeles from Los Angeles Business Journal publisher Mathew Toledo.

Alan Milstein on Pfizer and Torcetrapib
The media coverage of the recent termination of the Pfizer torcetrapib clinical trial has been nothing short of startling in this age of aggressive investigative journalism. In short, the stories have been about Money, Money, Money. In announcing the halt of this experiment after a finding that human subjects had died because of their participation, the New York Times announced, “End of Drug Trial is a Big Loss for Pfizer.” Bloomberg broke the story by observing: “Pfizer Shares Drop After Company Abandons Cholesterol Drug.” The Toronto Star had a different take: ‘Drug Failure Cost Pfizer 23 Billion.”

In its front page story, the New York Times further added this remarkable conclusion: “Pfizer will not face the product liability lawsuits that have dogged Merck over its painkiller, Vioxx . . . Patients in clinical trials must sign waivers confirming that they understand the risks they face when they take unapproved medicines in clinical trials.” Do they?

Why am I skeptical? Money. Money. Money. Pfizer had long touted this drug in meetings with shareholders, actual and potential, as the Mother of all Blockbusters. Could this potential have delayed the end of this experiment, even though some researchers had long warned that such drugs might actually pose more risks than benefits.

Two aspects of this trial, what surprisingly little we know about it, trouble me. First, the experiment took place largely in the offices of thousands of cardiologists across the country. What this means is that the subjects may have been induced to participate by their long trusted physician and signed on not to better mankind (or “Pfizer”) but because they believed their physician thought it was in their best therapeutic interest to do so. This might make the informed consent document neither voluntary nor informed.

Second, Pfizer says the delay in halting the trial was because this was a double blinded experiment with one arm taking Lipitor only and the other adding torcetrpib. Only when the data managing subcontractor removed the blinds were the devastating results revealed.
